One morning in 2009, I sat on a creaky bus winding its way up a mountainside in central Costa Rica, light-headed from diesel fumes as I clutched my many suitcases. They contained thousands of test tubes and sample vials, a toothbrush, a waterproof notebook and two changes of clothes.

I was on my way to La Selva Biological Station, where I was to spend several months studying the wet, lowland rainforest’s response to increasingly common droughts. On either side of the narrow highway, trees bled into the mist like watercolours into paper, giving the impression of an infinite primeval forest bathed in cloud.

As I gazed out of the window at the imposing scenery, I wondered how I could ever hope to understand a landscape so complex. I knew that thousands of researchers across the world were grappling with the same questions, trying to understand the fate of tropical forests in a rapidly changing world.

Our society asks so much of these fragile ecosystems, which control freshwater availability for millions of people and are home to two thirds of the planet’s terrestrial biodiversity. And increasingly, we have placed a new demand on these forests – to save us from human-caused climate change.

Plants absorb CO₂ from the atmosphere, transforming it into leaves, wood and roots. This everyday miracle has spurred hopes that plants – particularly fast growing tropical trees – can act as a natural brake on climate change, capturing much of the CO₂ emitted by fossil fuel burning. Across the world, governments, companies and conservation charities have pledged to conserve or plant massive numbers of trees.

But the fact is that there aren’t enough trees to offset society’s carbon emissions – and there never will be. I recently conducted a review of the available scientific literature to assess how much carbon forests could feasibly absorb. If we absolutely maximised the amount of vegetation all land on Earth could hold, we’d sequester enough carbon to offset about ten years of greenhouse gas emissions at current rates. After that, there could be no further increase in carbon capture.

Yet the fate of our species is inextricably linked to the survival of forests and the biodiversity they contain. By rushing to plant millions of trees for carbon capture, could we be inadvertently damaging the very forest properties that make them so vital to our wellbeing? To answer this question, we need to consider not only how plants absorb CO₂, but also how they provide the sturdy green foundations for ecosystems on land.

 

How plants fight climate change

Plants convert CO₂ gas into simple sugars in a process known as photosynthesis. These sugars are then used to build the plants’ living bodies. If the captured carbon ends up in wood, it can be locked away from the atmosphere for many decades. As plants die, their tissues undergo decay and are incorporated into the soil.

While this process naturally releases CO₂ through the respiration (or breathing) of microbes that break down dead organisms, some fraction of plant carbon can remain underground for decades or even centuries. Together, land plants and soils hold about 2,500 gigatonnes of carbon – about three times more than is held in the atmosphere.

Because plants (especially trees) are such excellent natural storehouses for carbon, it makes sense that increasing the abundance of plants across the world could draw down atmospheric CO₂ concentrations.

Plants need four basic ingredients to grow: light, CO₂, water and nutrients (like nitrogen and phosphorus, the same elements present in plant fertiliser). Thousands of scientists across the world study how plant growth varies in relation to these four ingredients, in order to predict how vegetation will respond to climate change.

This is a surprisingly challenging task, given that humans are simultaneously modifying so many aspects of the natural environment by heating the globe, altering rainfall patterns, chopping large tracts of forest into tiny fragments and introducing alien species where they don’t belong. There are also over 350,000 species of flowering plants on land and each one responds to environmental challenges in unique ways.

Due to the complicated ways in which humans are altering the planet, there is a lot of scientific debate about the precise quantity of carbon that plants can absorb from the atmosphere. But researchers are in unanimous agreement that land ecosystems have a finite capacity to take up carbon.

If we ensure trees have enough water to drink, forests will grow tall and lush, creating shady canopies that starve smaller trees of light. If we increase the concentration of CO₂ in the air, plants will eagerly absorb it – until they can no longer extract enough fertiliser from the soil to meet their needs. Just like a baker making a cake, plants require CO₂, nitrogen and phosphorus in particular ratios, following a specific recipe for life.

In recognition of these fundamental constraints, scientists estimate that the earth’s land ecosystems can hold enough additional vegetation to absorb between 40 and 100 gigatonnes of carbon from the atmosphere. Once this additional growth is achieved (a process which will take a number of decades), there is no capacity for additional carbon storage on land.

But our society is currently pouring CO₂ into the atmosphere at a rate of ten gigatonnes of carbon a year. Natural processes will struggle to keep pace with the deluge of greenhouse gases generated by the global economy. For example, I calculated that a single passenger on a round trip flight from Melbourne to New York City will emit roughly twice as much carbon (1600 kg C) as is contained in an oak tree half a meter in diameter (750 kg C).

Peril and promise

Despite all these well recognised physical constraints on plant growth, there is a proliferating number of large scale efforts to increase vegetation cover to mitigate the climate emergency – a so called “nature-based” climate solution. The vast majority of these efforts focus on protecting or expanding forests, as trees contain many times more biomass than shrubs or grasses and therefore represent greater carbon capture potential.

Yet fundamental misunderstandings about carbon capture by land ecosystems can have devastating consequences, resulting in losses of biodiversity and an increase in CO₂ concentrations. This seems like a paradox – how can planting trees negatively impact the environment?

The answer lies in the subtle complexities of carbon capture in natural ecosystems. To avoid environmental damage, we must refrain from establishing forests where they naturally don’t belong, avoid “perverse incentives” to cut down existing forest in order to plant new trees, and consider how seedlings planted today might fare over the next several decades.

Before undertaking any expansion of forest habitat, we must ensure that trees are planted in the right place because not all ecosystems on land can or should support trees. Planting trees in ecosystems that are normally dominated by other types of vegetation often fails to result in long term carbon sequestration.

One particularly illustrative example comes from Scottish peatlands – vast swathes of land where the low-lying vegetation (mostly mosses and grasses) grows in constantly soggy, moist ground. Because decomposition is very slow in the acidic and waterlogged soils, dead plants accumulate over very long periods of time, creating peat. It’s not just the vegetation that is preserved: peat bogs also mummify so-called “bog bodies” – the nearly intact remains of men and women who died millennia ago. In fact, UK peatlands contain 20 times more carbon than found in the nation’s forests.

But in the late 20th century, some Scottish bogs were drained for tree planting. Drying the soils allowed tree seedlings to establish, but also caused the decay of the peat to speed up. Ecologist Nina Friggens and her colleagues at the University of Exeter estimated that the decomposition of drying peat released more carbon than the growing trees could absorb. Clearly, peatlands can best safeguard the climate when they are left to their own devices.

The same is true of grasslands and savannahs, where fires are a natural part of the landscape and often burn trees that are planted where they don’t belong. This principle also applies to Arctic tundras, where the native vegetation is covered by snow throughout the winter, reflecting light and heat back to space. Planting tall, dark-leaved trees in these areas can increase absorption of heat energy, and lead to local warming.

But even planting trees in forest habitats can lead to negative environmental outcomes. From the perspective of both carbon sequestration and biodiversity, all forests are not equal – naturally established forests contain more species of plants and animals than plantation forests. They often hold more carbon, too. But policies aimed at promoting tree planting can unintentionally incentivise deforestation of well established natural habitats.

A recent high-profile example concerns the Mexican government’s Sembrando Vida programme, which provides direct payments to landowners for planting trees. The problem? Many rural landowners cut down well established older forest to plant seedlings. This decision, while quite sensible from an economic point of view, has resulted in the loss of tens of thousands of hectares of mature forest.

This example demonstrates the risks of a narrow focus on trees as carbon absorption machines. Many well meaning organisations seek to plant the trees which grow the fastest, as this theoretically means a higher rate of CO₂ “drawdown” from the atmosphere.

Yet from a climate perspective, what matters is not how quickly a tree can grow, but how much carbon it contains at maturity, and how long that carbon resides in the ecosystem. As a forest ages, it reaches what ecologists call a “steady state” – this is when the amount of carbon absorbed by the trees each year is perfectly balanced by the CO₂ released through the breathing of the plants themselves and the trillions of decomposer microbes underground.

This phenomenon has led to an erroneous perception that old forests are not useful for climate mitigation because they are no longer growing rapidly and sequestering additional CO₂. The misguided “solution” to the issue is to prioritise tree planting ahead of the conservation of already established forests. This is analogous to draining a bathtub so that the tap can be turned on full blast: the flow of water from the tap is greater than it was before – but the total capacity of the bath hasn’t changed. Mature forests are like bathtubs full of carbon. They are making an important contribution to the large, but finite, quantity of carbon that can be locked away on land, and there is little to be gained by disturbing them.

What about situations where fast growing forests are cut down every few decades and replanted, with the extracted wood used for other climate-fighting purposes? While harvested wood can be a very good carbon store if it ends up in long lived products (like houses or other buildings), surprisingly little timber is used in this way.

Similarly, burning wood as a source of biofuel may have a positive climate impact if this reduces total consumption of fossil fuels. But forests managed as biofuel plantations provide little in the way of protection for biodiversity and some research questions the benefits of biofuels for the climate in the first place.

Fertilise a whole forest

Scientific estimates of carbon capture in land ecosystems depend on how those systems respond to the mounting challenges they will face in the coming decades. All forests on Earth – even the most pristine – are vulnerable to warming, changes in rainfall, increasingly severe wildfires and pollutants that drift through the Earth’s atmospheric currents.

Some of these pollutants, however, contain lots of nitrogen (plant fertiliser) which could potentially give the global forest a growth boost. By producing massive quantities of agricultural chemicals and burning fossil fuels, humans have massively increased the amount of “reactive” nitrogen available for plant use. Some of this nitrogen is dissolved in rainwater and reaches the forest floor, where it can stimulate tree growth in some areas.

As a young researcher fresh out of graduate school, I wondered whether a type of under-studied ecosystem, known as seasonally dry tropical forest, might be particularly responsive to this effect. There was only one way to find out: I would need to fertilise a whole forest.

Working with my postdoctoral adviser, the ecologist Jennifer Powers, and expert botanist Daniel Pérez Avilez, I outlined an area of the forest about as big as two football fields and divided it into 16 plots, which were randomly assigned to different fertiliser treatments. For the next three years (2015-2017) the plots became among the most intensively studied forest fragments on Earth. We measured the growth of each individual tree trunk with specialised, hand-built instruments called dendrometers.

We used baskets to catch the dead leaves that fell from the trees and installed mesh bags in the ground to track the growth of roots, which were painstakingly washed free of soil and weighed. The most challenging aspect of the experiment was the application of the fertilisers themselves, which took place three times a year. Wearing raincoats and goggles to protect our skin against the caustic chemicals, we hauled back-mounted sprayers into the dense forest, ensuring the chemicals were evenly applied to the forest floor while we sweated under our rubber coats.

Unfortunately, our gear didn’t provide any protection against angry wasps, whose nests were often concealed in overhanging branches. But, our efforts were worth it. After three years, we could calculate all the leaves, wood and roots produced in each plot and assess carbon captured over the study period. We found that most trees in the forest didn’t benefit from the fertilisers – instead, growth was strongly tied to the amount of rainfall in a given year.

This suggests that nitrogen pollution won’t boost tree growth in these forests as long as droughts continue to intensify. To make the same prediction for other forest types (wetter or drier, younger or older, warmer or cooler) such studies will need to be repeated, adding to the library of knowledge developed through similar experiments over the decades. Yet researchers are in a race against time. Experiments like this are slow, painstaking, sometimes backbreaking work and humans are changing the face of the planet faster than the scientific community can respond.

Humans need healthy forests

Supporting natural ecosystems is an important tool in the arsenal of strategies we will need to combat climate change. But land ecosystems will never be able to absorb the quantity of carbon released by fossil fuel burning. Rather than be lulled into false complacency by tree planting schemes, we need to cut off emissions at their source and search for additional strategies to remove the carbon that has already accumulated in the atmosphere.

Does this mean that current campaigns to protect and expand forest are a poor idea? Emphatically not. The protection and expansion of natural habitat, particularly forests, is absolutely vital to ensure the health of our planet. Forests in temperate and tropical zones contain eight out of every ten species on land, yet they are under increasing threat. Nearly half of our planet’s habitable land is devoted to agriculture, and forest clearing for cropland or pasture is continuing apace.

Meanwhile, the atmospheric mayhem caused by climate change is intensifying wildfires, worsening droughts and systematically heating the planet, posing an escalating threat to forests and the wildlife they support. What does that mean for our species? Again and again, researchers have demonstrated strong links between biodiversity and so-called “ecosystem services” – the multitude of benefits the natural world provides to humanity.

Carbon capture is just one ecosystem service in an incalculably long list. Biodiverse ecosystems provide a dizzying array of pharmaceutically active compounds that inspire the creation of new drugs. They provide food security in ways both direct (think of the millions of people whose main source of protein is wild fish) and indirect (for example, a large fraction of crops are pollinated by wild animals).

Natural ecosystems and the millions of species that inhabit them still inspire technological developments that revolutionise human society. For example, take the polymerase chain reaction (“PCR”) that allows crime labs to catch criminals and your local pharmacy to provide a COVID test. PCR is only possible because of a special protein synthesised by a humble bacteria that lives in hot springs.

As an ecologist, I worry that a simplistic perspective on the role of forests in climate mitigation will inadvertently lead to their decline. Many tree planting efforts focus on the number of saplings planted or their initial rate of growth – both of which are poor indicators of the forest’s ultimate carbon storage capacity and even poorer metric of biodiversity. More importantly, viewing natural ecosystems as “climate solutions” gives the misleading impression that forests can function like an infinitely absorbent mop to clean up the ever increasing flood of human caused CO₂ emissions.

Luckily, many big organisations dedicated to forest expansion are incorporating ecosystem health and biodiversity into their metrics of success. A little over a year ago, I visited an enormous reforestation experiment on the Yucatán Peninsula in Mexico, operated by Plant-for-the-Planet – one of the world’s largest tree planting organisations. After realising the challenges inherent in large scale ecosystem restoration, Plant-for-the-Planet has initiated a series of experiments to understand how different interventions early in a forest’s development might improve tree survival.

But that is not all. Led by Director of Science Leland Werden, researchers at the site will study how these same practices can jump-start the recovery of native biodiversity by providing the ideal environment for seeds to germinate and grow as the forest develops. These experiments will also help land managers decide when and where planting trees benefits the ecosystem and where forest regeneration can occur naturally.

Viewing forests as reservoirs for biodiversity, rather than simply storehouses of carbon, complicates decision making and may require shifts in policy. I am all too aware of these challenges. I have spent my entire adult life studying and thinking about the carbon cycle and I too sometimes can’t see the forest for the trees. One morning several years ago, I was sitting on the rainforest floor in Costa Rica measuring CO₂ emissions from the soil – a relatively time intensive and solitary process.

As I waited for the measurement to finish, I spotted a strawberry poison dart frog – a tiny, jewel-bright animal the size of my thumb – hopping up the trunk of a nearby tree. Intrigued, I watched her progress towards a small pool of water held in the leaves of a spiky plant, in which a few tadpoles idly swam. Once the frog reached this miniature aquarium, the tiny tadpoles (her children, as it turned out) vibrated excitedly, while their mother deposited unfertilised eggs for them to eat. As I later learned, frogs of this species (Oophaga pumilio) take very diligent care of their offspring and the mother’s long journey would be repeated every day until the tadpoles developed into frogs.

It occurred to me, as I packed up my equipment to return to the lab, that thousands of such small dramas were playing out around me in parallel. Forests are so much more than just carbon stores. They are the unknowably complex green webs that bind together the fates of millions of known species, with millions more still waiting to be discovered. To survive and thrive in a future of dramatic global change, we will have to respect that tangled web and our place in it.

12 Billion Tons of Greenland Ice Melts in 24 Hours | July 2019 Hottest Month Ever

Official temperature records for July 2019 show that it was the hottest July and hottest single month ever recorded globally, at 1.2°C hotter than the pre-industrial average.

This comes after a June that was the hottest June every recorded, and a January, February, March, April, and May that were all in the top four hottest months every recorded.

The last four years, 2015, 2016, 2017, and 2018 are the four hottest years on record globally, but 2019 may break the new record for the hottest year ever recorded.

As we recently noted, climate chaos is accelerating. Industrial civilization and the global capitalist economy are wreaking havok on the planet. And as Christian Parenti has written, “Climate change arrives in a world primed for crisis. The current and impending dislocations of climate change intersect with the already-existing crises of poverty and violence. I call this collision of political, economic, and environmental disasters “the catastrophic convergence.”

The Unfolding Climate Chaos

The scale of unfolding catastrophe is almost unimaginable. One report concluded that “The number of climate refugees could increase dramatically in future. Researchers of the Max Planck Institute for Chemistry and the Cyprus Institute in Nicosia have calculated that the Middle East and North Africa could become so hot that human habitability is compromised.”

William R. Freudenburg, and professor of Environmental Sociology, released a report in 2010 finding that new scientific findings almost always underestimate the severity and speed of global warming.

“Reporters need to learn that, if they wish to discuss ‘both sides’ of the climate issue, the scientifically legitimate ‘other side’ is that, if anything, global climate disruption is likely to be significantly worse than has been suggested in scientific consensus estimates to date,” he said.

Solutions to the Climate Crisis

Deep Green Resistance does not believe that climate marches will save the planet. This has been happening  for decades, and no progress has been made. Emissions are higher than ever. The U.S. is now the world’s leading oil producer and mainstream climate movements have had zero success in stopping this.

Instead, we advocate for organized militant resistance, including coordinated sabotage against the industrial system. We don’t believe the ruling class will stop the murder of the planet unless they are literally forced to stop.

Here is an excerpt from the Deep Green Resistance book:

Historians now believe that Allied reluctance to attack early in the war may have cost many millions of civilian lives. By failing to stop Germany early, they made a prolonged and bloody conflict inevitable. General Alfred Jodl, the German Chief of the Operations Staff of the Armed Forces High Command, said as much during his war crimes trial at Nuremburg….

[In this future scenario,] Resisters aimed to reduce consumption and industrial activity, so it didn’t matter to them that some facilities had backup generators or that states engaged in conservation and rationing. They celebrated nationwide oil conservation and factories running on reduced power. They remembered that in the whole of its history, the mainstream environmental movement never even stopped the growth of fossil fuel consumption. To actually reduce it was unprecedented… Targeting energy networks was a high priority to resisters. Many electrical grids were already operating near capacity, and were expensive to expand. They became more important as highly portable forms of energy like fossil fuels were partially replaced by less portable forms of energy. Resisters recognized that energy networks often depend on a few major continent-spanning trunks, which were very vulnerable to disruption.”

Questioning Unquestioned Beliefs: What the Lake Erie Bill of Rights Teaches Us

It should be clear to anyone following the events surrounding attempts by the citizens of Toledo, OH, with help from nonprofit law firm the Community Environmental Legal Defense Fund (CELDF), to protect Lake Erie with the Lake Erie Bill of Rights, that the American legal system and all levels of government in their current form exist to protect corporations’ ability to destroy nature in the name of profit and protect those corporations from outraged citizens injured by corporate activities.

In the scorching summer heat of August 2014, nearly half a million people in Toledo, OH were told not to use tap water for drinking, cooking, or bathing for three days because a harmful algae bloom poisoned Lake Erie. Harmful algae blooms on Lake Erie have become a regular phenomenon. They produce microcystin, a dangerous toxin. Microcystin “causes diarrhea, vomiting, and liver-functioning problems, and readily kills dogs and other small animals that drink contaminated water.” The Ohio Environmental Protection Agency reports that mere skin contact with microcystin-laden harmful algae blooms can cause “numbness, and dizziness, nausea…skin irritation or rashes.” Scientists have also discovered that harmful algae blooms produce a neurotoxin, BMAA, that causes neurodegenerative illness, and is associated with an increased risk of ALS, and possibly even Alzheimer’s and Parkinson’s. In 2018, a federal judge found that the principal causes of Lake Erie’s perennial harmful algae blooms are “phosphorus runoff from fertilizer, farmland manure, and, to a lesser extent, industrial sources and sewage treatment plant discharges.”

The Environmental Working Group and Environmental Law and Policy Center report that, not surprisingly, between 2005 and 2018 the number of factory farms in the Maumee river watershed – a river that flows into Lake Erie and boasts the largest drainage area of any Great Lakes river

“exploded from 545 to 775, a 42 percent increase. The number of animals in the watershed more than doubled, from 9 million to 20.4 million. The amount of manure produced and applied to farmland in the watershed swelled from 3.9 million tons each year to 5.5 million tons.”

The groups also state that “[t]he amount of phosphorus added to the watershed from manure increased by a staggering 67 percent between 2005 and 2018.” And, “69 percent of all the phosphorus added to the watershed each year comes from factory farms in Ohio.”

Many Americans believe regulatory laws like the Clean Water Act and regulatory agencies like the United States Environmental Protection Agency (EPA) exist to protect against phenomena like harmful algae blooms. But, Senior US District Court Judge James G. Carr recently described how regulatory laws and agencies have failed to protect Lake Erie. In a 2018 decision in a case brought by the Environmental Law and Policy Center under the Clean Water Act for the failures of the US and Ohio EPAs, Carr described, “Ohio’s long-standing, persistent reluctance and, on occasion, refusal, to comply with the [Clean Water Act].” He also wrote:

“As a result of the State’s inattention to the need, too long manifest, to take effective steps to ensure that Lake Erie (the Lake) will dependably provide clean, healthful water, the risk remains that sometime in the future, upwards of 500,000 Northwest Ohio residents will again, as they did in August 2014, be deprived of clean, safe water for drinking, bathing, and other normal and necessary uses.”

Despite Carr explaining that he “appreciate[s] plaintiffs’ frustration with Ohio’s possible continuation of its inaction,” he ruled that he could not expedite Ohio’s compliance with the Clean Water Act because he could not determine that Ohio had “clearly and unambiguously” abandoned its obligations under the Clean Water Act.

In response to the regulatory framework’s failure to stop harmful algae blooms, on Tuesday, February 26, 2019, citizens in Toledo, OH voted to protect Lake Erie with the Lake Erie Bill of Rights (“LEBOR” or “the Bill”). The Bill “establishes irrevocable rights for the Lake Erie Ecosystem to exist, flourish, and naturally evolve, a right to a healthy environment for the residents of Toledo” and “elevates the rights of the community and its natural environment over powers claimed by certain corporations.”

Toledoans for Safe Water (TSW) is the grassroots coalition of local Toledo citizens who ushered the Bill through Ohio’s constitutional citizen initiative process. Ohio’s citizen initiative process allows citizens to draft and propose laws and to place those laws on a ballot so citizens can directly vote on the law’s enactment. Typically, laws are drafted, proposed, and voted on solely by legislators. Initiative processes like Ohio’s are some of the only avenues American citizens have for directly proposing and enacting laws and providing a direct check and balance on an “out of touch” or corrupt legislature. It is important to understand, however, that, even with citizen initiative processes, it is incredibly difficult to not only democratically enact laws that would actually protect the natural world, but it is incredibly difficult to even place rights of nature laws on the ballot in the first place.

Toledoans for Safe Water’s experience is enlightening. Formed after the harmful algae bloom of August 2014, TSW worked tirelessly to pass an initiative protecting their water source including overcoming efforts by the Lucas County Board of Elections and BP North America to keep such an initiative off the ballot. First, TSW had to gather 5,244 signatures to place LEBOR on the ballot. They far exceeded that total by gathering approximately 10,500 signatures. Despite gathering much more than the necessary signatures, the Lucas County Board of Elections voted against putting the initiative on the November 2018 ballot.

Toledoans for Safe Water members sought an order from the Ohio Supreme Court to put the measure on the ballot, but the Court denied the request in September 2018. Fortunately, in October 2018, in another case involving a different charter initiative, the Ohio Supreme Court ruled that city councils may force county boards of election to place charter amendment initiatives on the ballot. This ruling expressly overruled precedent previously relied on to prevent Toledo citizens from voting on LEBOR. Armed with this new ruling, TSW successfully asked the Toledo City Council to put LEBOR on the ballot. However, in December 2018, a Toledo citizen sought a writ of prohibition from the Ohio Supreme Court to block LEBOR. TSW found themselves in front of the Ohio Supreme Court once again. This time TSW won.

After ensuring LEBOR made it to the ballot, Toledoans for Safe Water had to convince enough voters to vote for the Bill before it could be enacted. In the weeks leading up to the election, BP North America wired $302,000 to the Toledo Coalition for Jobs and Growth, the primary group opposing LEBOR. In the end, TSW spent $7,762 in support of LEBOR, while Toledo Coalition for Jobs and Growth, with the massive donation from BP North America, spent $313, 205 to stop LEBOR. Despite this disparity, LEBOR passed with 61 percent of the 15,000 Toledoans who voted.

But, mere hours after the City of Toledo certified LEBOR’s election results, Drewes Farms Partnership sued the City seeking an injunction against enforcing LEBOR and a court ruling that LEBOR is unconstitutional. Several Toledo city-council members spoke out against the enactment of LEBOR before the election, and it appears that the City will not enforce LEBOR. Yes, you read that correctly: After LEBOR won with 61% of the vote (nearly two-thirds of those who voted), the City of Toledo agreed to an injunction prohibiting them from enforcing the law.

In response to such bald face tactics, we must ask, if a local city government agrees not to enforce the will of its citizens, then what really is left of the notion of a government for and by the people? And the inevitable answer must be, nothing. Indeed, as environmental author Derrick Jensen explains in his book Endgame:

“Surely by now there can be few here who still believe the purpose of government is to protect us from the destructive activities of corporations. At last most of us must understand that the opposite is true: that the primary purpose of government is to protect those who run the economy from the outrage of injured citizens.”

Jensen’s conclusion eerily reflects the very plain statement by Attorney General Richard Olney, who served under President Grover Cleveland in 1894 about the newly-formed Interstate Commerce Commission. The ICC was the very first federal regulatory agency, created to ‘regulate’ the railroad industry, but as Olney (a former railroad attorney, himself) said:

“The Commission…is, or can be, made of great use to the railroads. It satisfies the popular clamor for a government supervision of railroads, at the same time that that supervision is almost entirely nominal. Further, the older such a commission gets to be, the more inclined it will be found to take the business and railroad view of things.”

Nearly 200 years later, Jensen’s observation reflects the reality that not only does our regulatory system not protect the interests of the people of this country; it was never intended to. It was created to protect industry.

And so the parade of horribles that Toledoans for Safe Water have encountered should come as no surprise. A little over two months after the lawsuit was filed by the agriculture industry to strike down LEBOR, the State of Ohio requested, and was granted, the right to intervene to argue with Drewes Farms Partnership that LEBOR should be invalidated. TSW also tried to intervene on behalf of Lake Erie, exercising their new rights under LEBOR and arguing that the City is not an adequate representative of LEBOR. The City neither opposed TSW’s intervention in the case, nor denied that it would be an inadequate representative of LEBOR. Regardless, on Tuesday, May 7, Judge Jack Zouhary, a U.S. District Judge in the Northern District of Ohio, Western Division denied Toledoans for Safe Water’s intervention. Lake Erie and TSW asked the Sixth Circuit Court of Appeals to stay (legalese for postpone) the case while they appealed Zouhary’s denial of their intervention. But, the Sixth Circuit refused to stay the case.

Because Zouhary has denied Toledoans for Safe Water’s intervention and the Sixth Circuit did not grant Lake Erie’s and TSW’s request to stay the case, it will proceed with no one who supports LEBOR present to argue on behalf of Lake Erie or the citizens of Toledo for the remainder of a case that will decide the fate of a law enacted by the citizens of Toledo. To be clear, the City government, popularly assumed to represent the will of the City’s people, is specifically not representing the will of the people.

About an hour after denying Lake Erie and Toledoans for Safe Water’s intervention, Zouhary scheduled a phone conference for Friday, May 17 while ordering the parties to the lawsuit to send him letters regarding a Motion for Judgment on the Pleadings. Typically, parties to a lawsuit file motions and briefs describing their arguments and these motions and briefs become part of the public record so that the public can see why legal decisions are made. In specifically asking for letters, Zouhary shielded Drewes Farms Partnership’s, the State of Ohio’s, and the City of Toledo’s arguments from public scrutiny.  Here we see how the will of the people, expressed through the legislative process, can be effectively silenced by the judicial process. The courts, commonly thought of as a check on abuses of power by the legislative branch of government that encroach on fundamental rights of individuals, have now been unmasked as a vehicle to silence and overturn the will of the people and to legitimize further violations of fundamental rights of the people ­– in this case the simple and essential right to clean water.

And to round out the evidence that we do not live in a democracy, on Thursday, May 9, the Ohio House of Representatives adopted its 2020-2021 budget with provisions that prohibit anyone, including local governments, from enforcing rights of nature laws. The State of Ohio is using its power of preemption – a long-established legal doctrine that defines the relationship of municipal governments to state and federal governments as one of parent to a child – to prevent Ohio residents from protecting the natural world with rights of nature at any time in the future.

This is a perfect example of why CELDF lawyer and executive director Thomas Linzey often states that, “Sustainability itself has been rendered illegal under our system of law.” And:

“Under our system of law, you see, it doesn’t matter how many people mobilize or who we elect – simply because the levers of law can’t be directly exercised by them. And even when they do manage to swing the smallest of those levers, they get swung back (either through the legislature or the courts) by a corporate minority who claimed control over them a long time ago.”

Toledoans for Safe Water swung “the smallest of those levers” and now they have been “swung back” by both the legislature and the courts in favor of the corporate minority. We see then, that under our current system of laws, there is no government actor that validates and protects the will of the people. In the case of Lake Erie, the City of Toledo, the State of Ohio, two levels of federal courts (the District Court for the District of Ohio and the Sixth Circuit Court of Appeals), have all actively undermined the health and welfare and the express political will of the citizens of Toledo – all in the name of preserving and protecting the freedom of agricultural interests to continue polluting Lake Erie for the sake of their own profits.

With it being all but certain that the Lake Erie Bill of Rights will soon be officially invalidated, has Toledoans for Safe Water’s work been in vain?

Not entirely.

“Unquestioned beliefs are the real authorities of a culture,” critic Robert Coombs tells us. Right now, the culture of profit in our country, sanctioned by the legal system is destroying the planet. Informing this dominant culture is a collection of unquestioned beliefs that authorize and allow the massive environmental destruction we currently witness. Stopping the destruction requires changing the dominant culture and changing the dominant culture requires publicly challenging unquestioned beliefs so those unquestioned beliefs are exposed to the light where they can be seen, understood, and condemned.

Perhaps surprisingly, one of the unquestioned beliefs authorizing ecocide is the belief that we live in a democracy and, because we live in a democracy, that our government reflects the will of the governed. This mistaken belief leads to more mistaken beliefs including a belief that the best way to make change is to petition your elected representatives, and if they won’t listen, to elect new ones who will. This misconception includes the further mistaken belief that the American regulatory framework exists to protect the natural world and the humans who depend on Her and that therefore filing lawsuits under the Endangered Species Act, the National Environmental Policy Act, and the Clean Air and Clean Water Acts can stop the destruction of endangered species, our habitat, and the air and water we require.

We should all know the truth, by now. We do not live in a democracy, and our government was never intended to reflect the will of the governed. Our elected representatives only listen to us when the corporations they’re beholden to aren’t telling them what to do. The regulatory framework does not exist primarily to protect the natural world; it exists to issue permits, to give permission, to legalize the harm corporate projects wreak on the natural world, and to make it near impossible for the citizenry to oppose those projects.

Even some of the current government’s most sacred documents, such as the Declaration of Independence, the Ohio State Constitution, as well as many other state constitutions, declare that people have a right to reform, alter, or even abolish the very governments those documents create when those governments fail to reflect the will of the people. The people of Toledo tried to exercise that right by passing LEBOR. Regardless, the very institutions supposedly tasked with honoring these documents are preventing the people from exercising the rights asserted in the Declaration of Independence and protected by the Ohio State Constitution.

We should all know the truth, by now, but most people still don’t. It’s one thing to tell people the truth. And, it’s another to show them. A major question, then, for social and environmental justice advocates is: How do we show people the truth?

One way is through acts of civil disobedience like enacting the Lake Erie Bill of Rights. A primary purpose of civil disobedience is to expose unquestioned beliefs for what they really are. In the case of the regulatory fallacy described above, these unquestioned beliefs serve as propaganda intended to pacify the people. Civil disobedience can stage the truth of our situation for the public to behold. Properly applied, civil disobedience can illuminate unquestioned beliefs and unveil their falsehoods.

CELDF attacks unquestioned beliefs through what it calls “organizing jujitsu.” CELDF helps communities suffering from destructive corporate projects (like fracking, factory farms, and toxic waste storage) ban those projects by passing local laws establishing rights of nature and invalidating judicially-created corporate rights. These laws, however, are currently illegal under American law and are, inevitably, struck down by the courts.

So, why does CELDF keep helping communities pass laws that are almost always struck down? This is where the organizing jujitsu happens. The laws that CELDF helps communities pass are frontal challenges to long-settled legal doctrines. When judges rule against local laws, judges’ rulings can be used as proof of how the structure actually operates. In CELDF’s words:

“Much like using single matches to illuminate a painting in a dark room, enough matches need to be struck simultaneously (and burn long enough) so that the painting can be viewed in its entirety. Each municipality is a match, and each instance of a law being overturned as violative of these legal doctrines is an opportunity for people to see how the structure actually functions. This does the necessary work of penetrating the denial, piercing the illusion of democracy, and removing the blinders that prevent a large majority of people from seeing the reality on the ground.”

With the indicators of ecological collapse constantly intensifying, it is imperative that we penetrate the denial, pierce the illusion of democracy, and remove the blinders that prevent people from seeing reality as quickly as possible. Due to the thoroughness of American indoctrination, the education civil disobedience can provide needs to be supported by real-time commentary that highlights why a specific tactic failed. This real-time commentary will help the public see the truth.

Toledoans for Safe Water has used every legal means at their disposal to protect Lake Erie and, yet, the Lake Erie Bill of Rights is not being enforced and is almost certain to be invalidated in court. Meanwhile, the poisoning of Lake Erie intensifies. Toledoans for Safe Water’s civil disobedience, despite challenging a widespread faith in the American legal system, has failed to physically protect Lake Erie. Breaking this faith is a necessary, but not sufficient, step towards dismantling the dominant culture and replacing it with a new culture rooted in a humble recognition of our dependency on the natural world. For those who see the truth that neither the legal system nor the government will protect us, the question becomes: What are we willing to do to protect ourselves?

Washington Post: Number of trees has fallen by 46 Percent since advent of civilization

In a blockbuster study released Wednesday in Nature, a team of 38 scientists finds that the planet is home to 3.04 trillion trees, blowing away the previously estimate of 400 billion. That means, the researchers say, that there are 422 trees for every person on Earth.

However, in no way do the researchers consider this good news. The study also finds that there are 46 percent fewer trees on Earth than there were before humans started the lengthy, but recently accelerating, process of deforestation.

“We can now say that there’s less trees than at any point in human civilization,” says Thomas Crowther, a postdoctoral researcher at the Yale School of Forestry and Environmental Studies who is the lead author on the research. “Since the spread of human influence, we’ve reduced the number almost by half, which is an astronomical thing.”

Carbon emissions estimated to reach record 35.6 billion tons in 2012

Global carbon dioxide (CO2) emissions are set to rise again in 2012, reaching a record high of 35.6 billion tonnes – according to new figures from the Global Carbon Project, co-led by researchers from the Tyndall Centre for Climate Change Research at the University of East Anglia (UEA).

The 2.6 per cent rise projected for 2012 means global emissions from burning fossil fuel are 58 per cent above 1990 levels, the baseline year for the Kyoto Protocol.

This latest analysis by the Global Carbon Project is published today in the journal Nature Climate Change with full data released simultaneously by the journal Earth System Science Data Discussions.

It shows the biggest contributors to global emissions in 2011 were China (28 per cent), the United States (16 per cent), the European Union (11 per cent), and India (7 per cent).

Emissions in China and India grew by 9.9 and 7.5 per cent in 2011, while those of the United States and the European Union decreased by 1.8 and 2.8 per cent.

Emissions per person in China of 6.6 tonnes of CO2 were nearly as high as those of the European Union (7.3), but still below the 17.2 tonnes of carbon used in the United States. Emissions in India were lower at 1.8 tonnes of carbon per person.

Prof Corinne Le Quéré, director of the Tyndall Centre for Climate Change Research and professor at UEA, led the publication of the data. She said: “These latest figures come amidst climate talks in Doha. But with emissions continuing to grow, it‟s as if no-one is listening to the entire scientific community.”

The 2012 rise further opens the gap between real-world emissions and those required to keep global warming below the international target of two degrees.

“I am worried that the risks of dangerous climate change are too high on our current emissions trajectory. We need a radical plan,” added Prof Corinne Le Quéré.

The analysis published in Nature Climate Change shows significant emission reductions are needed by 2020 to keep two degrees as a feasible goal.

It shows previous energy transitions in Belgium, Denmark, France, Sweden, and the UK have led to emission reductions as high as 5 per cent each year over decade-long periods, even without climate policy.

Lead author Dr Glen Peters, of the Centre for International Climate and Environmental Research in Norway, said: “Scaling up similar energy transitions across more countries can kick-start global mitigation with low costs. To deepen and sustain these energy transitions in a broad range of countries requires aggressive policy drivers.”

Co-author Dr Charlie Wilson, of the Tyndall Centre at UEA, added: “Public policies and institutions have a central role to play in supporting the widespread deployment of low carbon and efficient energy-using technologies, and in supporting innovation efforts”.

Emissions from deforestation and other land-use change added 10 per cent to the emissions from burning fossil fuels. The CO2 concentration in the atmosphere reached 391 parts per million (ppm) at the end of 2011.

These results lends further urgency to recent reports that current emissions pathways are already dangerously high and could lead to serious impacts and high costs on society. These other analyses come from the International Energy Agency, the United Nations Environment Programme, the World Bank, the European Environment Agency, and PricewaterhouseCoopers.
