Editor’s Note: In order to deter the tribal members and activists from fighting for Thacker Pass, Lithium Nevada has sued them. Unsurprisingly, as a corporation, they have greater funds to sustain their legal action. We appeal for all who can to support in whatever way you can. Lithium Nevada Corporation has filed a lawsuit against Protect Thacker Pass and seven people for opposing the Thacker Pass lithium mine.
The lawsuit is similar to what is called a “Strategic Lawsuit Against Public Participation,” or SLAPP suit, aimed at shutting down free speech and protest. The suit aims to ban the prayerful land defenders from the area and force them to pay monetary damages which could total millions of dollars.
“This lawsuit is targeting Native Americans and their allies for a non-violent prayer to protect the 1865 Thacker Pass massacre site,” said Terry Lodge, attorney working with the group. “These people took a moral stand in the form of civil disobedience. They are being unjustly targeted with sweeping charges that have little relationship to the truth, and we will vigorously defend them.”
The lawsuit targets Dean Barlese, respected elder and spiritual leader from the Pyramid Lake Paiute Tribe, Dorece Sam from the Fort McDermitt Paiute-Shoshone Tribe, Bhie-Cie Zahn-Nahtzu (Te-Moak Shoshone and Washoe), Bethany Sam from the Standing Rock Sioux and Kutzadika’a Paiute Tribes, Founding Director of Community Rights US Paul Cienfuegos, and Max Wilbert and Will Falk of Protect Thacker Pass, which is also named in the suit.
They are charged with Civil Conspiracy, Nuisance, Trespass, Tortious Interference with Contractual Relations, Tortious Interference with Prospective Economic Advantage, and Unjust Enrichment.
As part of the lawsuit, Lithium Nevada has been granted a Temporary Restraining Order which restricts the defendants and “any third party acting in concert” with them from interfering with construction, blocking access roads, or even being in the area. The accused parties are not involved in planning further protest activity at the mine site.
Regardless, these allegations are alarming to the Great Basin Native American communities who believe their religious practices are protected by the American Indian Religious Freedom Act of 1978. The lawsuit’s language places fear in the hearts of Native American people who want to pray and visit their ancestors’ gravesites.
The case references instances of non-violent prayer and protest that took place on April 25th, and a prayer camp named after Ox Sam (survivor of the 1865 massacre and ancestor of Dorece Sam and Dean Barlese) which was established at Thacker Pass on May 11th. On June 8th, that camp was raided and dismantled by police. One young indigenous woman was arrested and transported to jail inside a pitch-black box. In the aftermath of the raid, a ceremonial fire was extinguished, sacred objects were put in trash bags, and tipi poles were broken.
The American Indian Religious Freedom Act states that it is “the policy of the United States to protect and preserve for American Indians their inherent right of freedom to believe, express, and exercise the traditional religion of the American Indian…including…access to sites.”
Dorece Sam, President of the Native American Church of the State of Nevada:
“I take my grandkids to Peehee Mu’huh to teach them to pray for our unburied ancestors whose remains are scattered there, to collect our holy plants, to hunt and fish, and to collect medicinal herbs. The ancestors who were killed at Thacker Pass have never been given the proper prayers for their spirits. Lithium Nevada is desecrating our unceded lands and our ancestors’ resting places.”
Dean Barlese, respected elder and spiritual leader from the Pyramid Lake Paiute Tribe:
“The Indian wars are continuing in 2023, right here. America and the corporations who control it should have finished off the ethnic genocide, because we’re still here. My great-great-grandfather fought for this land in the Snake War and we will continue to defend the sacred. Lithium Nevada is a greedy corporation telling green lies.”
Bethany Sam:
“Our people couldn’t return to Thacker Pass for fear of being killed in 1865, and now in 2023 we can’t return or we’ll be arrested. Meanwhile, bulldozers are digging our ancestors graves up. This is what Indigenous peoples continue to endure. That’s why I stood in prayer with our elders leading the way.”
Bhie-Cie Zahn-Nahtzu:
“Lithium Nevada is a greedy corporation on the wrong side of history when it comes to environmental racism and desecration of sacred sites. It’s ironic to me that I’m the trespasser because I want to see my ancestral land preserved.”
Paul Cienfuegos:
“Virtually every single accusation against us is a lie, and of course the corporation’s leaders know this. But our actions have scared them, so they are lashing out against classic nonviolent direct-action tactics. And this is yet another prime example of why we need to dismantle the structures of law that grant so many so-called constitutional ‘rights’ to business corporations, like access to the courts.”
Max Wilbert, Protect Thacker Pass:
“Around the world, a land defender is killed every two days. Murdering activists is hard to get away with in the United States, so corporations do this instead. This lawsuit is aimed at destroying the lives of people non-violently defending the land. But we’re not giving up. There are millions of people opposing this mine, and this fight will continue.”
Will Falk:
“I’ve been involved in directly petitioning the courts for two years to enforce tribal rights to consultation without success. Now Paiutes and Shoshones are being sued for peacefully defending the final resting places of their massacred ancestors. Lithium Nevada is just another mining corporation bullying Native Americans once again. This pattern has got to stop.”
Lithium Nevada corporation has been locked in legal battles since 2021, when four environmental groups, a local rancher, and several tribes sued the Federal Government to attempt to overturn the permits for the mine. The suits allege failures of consultation, violation of endangered species law and water laws, and dozens of other infractions. The most recent filing in an ongoing Federal Court case brought by three local tribes was filed on Friday, arguing that Lithium Nevada needs to halt construction while it consults with tribes about the Thacker Pass massacre sites. The 9th Circuit Court of Appeals in California will hear oral arguments in other cases later this month.
The news comes as Lithium Nevada’s parent corporation, Lithium Americas, has been implicated in four alleged human rights violations and environmental crimes related to their lithium mining operation in Cauchari-Oloroz, Argentina.

Radical Resilience and Restoration for Wetland Rights
On June 28th CELDF’s Kai Huschke will be presenting at the Society for Wetland Scientists annual conference. Joining Kai on the panel Socio-Ecological Resilience and Adaptation: Implementing Rights of Wetlands will be Senior Ecologist/Natural Climate Solutions Specialist Gillian Davis from BSC Group, Inc. and Tufts University Global Development & Environment Institute, Matthew Simpon, Director from the UK based organization 35percent, and Bill Moomaw, Tufts University Professor Emeritus. The four have been active as part of a global collective working on the community and national levels for the legal rights of wetlands.
Globally for the last 200 years the prevailing directive governmentally, legally, economically, scientifically, and culturally has been to extract and exploit the natural world for the wants and needs of a single species – humans. Colonization has never stopped; it has merely changed its stripes and patterns of speech but behaviorally it continues to conquer into submission and extinction the life forces of the planet with wetlands receiving a disproportionate amount of abuse.
The emergence of legal rights of nature efforts over the last 20 years in North America and across the globe is a potent force for the cultural shift necessary to actualize living from, in, with, and as nature. Wetlands restoration efforts in the name of rights of wetlands can only occur if there is a restoration of the human species on a massive scale that would allow for the healthy and harmonious balance of living from, in, with, and as nature. Science along with other aspects of the culture must reject colonizing systems of law, economics, governance, and even science itself and develop methods and systems outside the dominant one.

Focused on the fight against climate change, most environmental movements forget about other ongoing environmental disasters that are just as important, if not more so. One of the most serious is undoubtedly the destruction of biodiversity. Worse, in their frantic race to stop climate change – or rather in their frantic race to find alternative energies to carbon-based energies, and thus maintain the standard of living of Westerners and ensure the good health of the industrial machine in a context of climate change – they are doing everything to initiate an energy transition by promoting the development of so-called “green” energies, which are however very damaging to the planet.
Two weeks ago, DGR France was on the site where a lithium mine is planned to create the batteries that are essential for the operation of machines powered by “green” energy. This would be a local extraction, which would also allow France to be less dependent on distant imports. In short, from the point of view of environmentalists, it is a double victory.
However, there is nothing to celebrate. The site in question is a magnificent old forest, of which nearly a hundred hectares will have to be logged for the installation of the mine. What’s more, this forest is located in the Puy-de-Dôme, the water tower of France. From this forest flow many rivers that feed the region, springs and wells. In summer, when the rivers are almost dry, which is increasingly common with climate change, the water table replenishes the rivers so that they never run dry, allowing the maintenance of aquatic life. Unfortunately, by digging deep to extract the rock (granite), the water table will drop below the level of the rivers. In summer, the water table will not be able to feed the rivers. Worse, it is the rivers, who’s level is already very low, that will end up emptying themselves into the water table.
But that’s not all. Lithium is found in a specific rock, mica, which makes up 0.5% of granite. The mine will therefore extract phenomenal quantities of granite to reduce it to powder in order to get its hands on the mica. To do this, the operator will build huge basins in which the granite will be mixed with thousands of liters of chemicals to isolate the mica. The mica, once recovered, will be sent with water in a pipeline, whose implementation will ravage other natural areas of the region, to end up in a second plant that will be created for the occasion. The mica will then be immersed in very powerful baths of acids and bases, at very high temperatures, to finally obtain the precious lithium. It goes without saying that these on-site operations will consume phenomenal quantities of water, which will be pumped directly back into the aquifer, or at least what is left of it
Once you’ve taken the mica, you’re left with the rest of the granite, 95.5% of the chemical-soaked rock, which will then be put back underground. For centuries to come, rainwater will seep through this mine waste and be laced with arsenic, heavy metals and other chemicals used in the settling process, which will end up in the region’s waterways. That’s what a mine is. That’s why the US Environmental Protection Agency (EPA) ranks water contamination from mining activity as one of the top 3 threats to the world’s ecological security. And it’s not like we’re running out of water in France because of droughts…
One pinches oneself to believe it, but that is nevertheless ecology according to certain movements which militate in favour of some “energy transition”. By claiming to solve a problem, they aggravate and create others. In France, since the beginning of the 20th century, 67% of wetlands have disappeared, as well as 75% of pollinators. Two hundred species disappear every day in the world, and 92% of large fish have already disappeared, but this is apparently secondary. According to them, the important thing is to secure the energy future of industrial civilization.

World Environment Day Kangaroo Forum
Another exciting event is World Environment Day Kangaroo Forum which will be held from 10am Sunday 4th June 2023 at Boneo Community Hall on the Mornington Peninsula. This interactive forum will include short 5-10 minute presentations and then brainstorm break-outs, with the goal of raising awareness on kangaroo conservation and to develop a draft of a tailored wildlife protection plan for the peninsula kangaroos.

Editor’s Note: Title IX of the Educational Amendments of 1972 prohibits sex-based discrimination in US educational institutions receiving federal aid. The US Department of Education has proposed to amend the Title IX in relation to sex-related eligibility criteria for male and female athletic teams. If passed, this would mean that athletes would be allowed to compete based on their gender identity, rather than their sex. Sports has long been categorized on the basis of sex for a reason. There are some fundamental differences in the ways that male and female bodies develop, specifically in adolescence. Male sex hormones, especially testosterone, are responsible for increased muscle mass and bone density. Sex hormones account for the sudden height and weight increases in boys after puberty. These effects are long lasting, and cannot be curbed by taking cross-sex hormones. Recently, the debate has been ignited by the win of the trans-identifying swimmer Lia Thomas in the women’s category.

Green Alliance Files its Opposition to Proposed DoE Title IX Rule Revisions
Deadline looms to join effort to protect women’s sports from men’s participation
On Tuesday, May 9th, the membership of the Green Alliance for Sex-Based Rights approved comments which were that evening submitted to the U.S. Department of Education. In their comments, GASBR members participating in that evening’s call were unanimously agreed that:
We strongly oppose DOE’s proposed amendments, as they are utterly contrary to the statutory purpose of Title IX, which was enacted as a measure to help address the historic and systemic oppression and unequal treatment of women and girls in our educational institutions. The proposed amendments do so by conflating “gender identity” with “sex,” and accepting as a premise that recipients [of federal education funding] must accept trans-identifying males as being de facto females and must make accommodations that allow them to participate in girls’ and women’s sports.
The position statement adopted by GASBR can be reviewed in its entirety on the website of the Green Alliance. Its comments to the Department of Education are now a matter of public record and should be accessible on their website.
The Green Alliance urges others to join GASBR in opposing the Biden Administration’s efforts to destroy sports programs built for women and girls in tax-payer funded educational settings. Community Rights US to reorganize as Association
The following is a message from Paul Cienfuegos, the Founding Director of Community Rights US, regarding some news about his movement and virtual book talks on April 1 and April 17. You can join the event here.
Greetings to all of our thousands of loyal supporters!
The Community Rights US Board of Directors has come to the decision that we no longer have the capacity to continue our work to build the Community Rights movement across the US at anywhere near the scale or scope we had always envisioned. For some time now, we have been struggling to sustain a Board large enough to maintain the critical focus of our organization. We haven’t generated sufficient volunteer energy to support our project work. We’ve been unsuccessful in our grant writing efforts, and our ongoing fundraising efforts with our human supporters have not generated sufficient funds to maintain paid staff. And so it is with some sadness, I’m announcing that last month was our final month of existence as a formal non-profit tax-exempt organization.
On the good side, at least three members of our existing Board (including myself) will continue to meet monthly to discuss next steps for our work. We have absolutely no intention of vanishing into thin air. We just won’t exist as a non-profit corporation anymore. We plan to restructure ourselves as an Association.
So if you have been meaning to make a tax-deductible donation to us for awhile now, we’re sorry but it’s already too late to do so! But a NON-tax-deductible donation is still very much welcomed, by donating to me at my Patreon account here. Monthly donors will have access to a wide variety of provocative writings, talks, and interviews that I’ve done over these past years, and will continue to do albeit less frequently. I have been taking leadership in the Community Rights movement since 1995. As the founder of Democracy Unlimited of Humboldt County (California) in 1995. As the co-founder of Community Rights PDX (Oregon) in 2012, the Oregon Community Rights Network in 2013, and Community Rights US in 2017. That’s 28 years of sustained organizing and teaching and consulting and cheerleading efforts! And to be totally transparent with you, I am feeling deeply exhausted, and don’t have the same level of energy that has propelled me for so many years.
I have a strong desire to shift my priorities towards a lot more play and rest and reading and spacious friend time and deep nature and quiet time. I am extremely proud of the contributions I have made to this national movement, and to many other social movements in the decades prior to 1995.
Last year, I wrote and published my first-ever book, How Dare We? Courageous Practices to Reclaim Our Power as Citizens. Our board and small staff have been working hard to promote the book to media, bookstores, thought leaders, and activist groups. I could not have asked for a better support team from our board and staff!
I have been having a ton of fun and gratifying experiences promoting my book to audiences of every political stripe. On February 2nd, I came to the Midwest for a month-long book tour at bookstores and libraries to ten mostly rural communities (in Wisconsin, Iowa and Minnesota) where I spent six intensive and truly wonderful years teaching and consulting up until covid crashed everything.

As the latest Intergovernmental Panel on Climate Change (IPCC) report issues a final warning that “swift and drastic action” can avert irrevocable damage to the world, Utah becomes the 19th state to pass a draconian “critical infrastructure” bill where protesting fossil fuel infrastructure can lead to several years in prison. Jessica’s case is not isolated and unfortunately we are truly seeing that what happens to Jessica happens to all of us.
