West Sulawesi Erupts In Protest Over Sand Mining

More than 250 members of Indigenous and local communities gathered in Indonesia’s Merauke district to demand an end to government-backed projects of strategic national importance, or PSN, which they say have displaced them, fueled violence, and stripped them of their rights.

PSN projects, including food estates, plantations and industrial developments, have triggered land conflicts affecting 103,000 families and 1 million hectares (2.5 million acres) of land, with Indigenous communities reporting forced evictions, violence and deforestation, particularly in the Papua region.

In Merauke itself, the government plans to clear 3 million hectares (7.4 million acres) for rice and sugarcane plantations, despite Indigenous protests; some community members, like Vincen Kwipalo, face threats and violence for refusing to sell their ancestral land, as clan divisions deepen.

Officials have offered no concrete solutions, with a senior government researcher warning that continued PSN expansion in Papua could escalate socioecological conflicts, further fueling resentment toward Jakarta and potentially leading to large-scale unrest.

Hundreds of protesters, including young and Indigenous peoples from three coastal villages, have demanded the closure of sand dredging in Indonesia’s West Sulawesi over environmental concerns and permit violations.

The protest earlier this month marked the latest in a series of demonstrations by residents of Karossa, Pasangkayu and Kalukku, who have voiced opposition to sand mining in Mamuju and Central Mamuju districts since November 2024. Tensions escalated after the West Sulawesi provincial investment office issued a mining business permit in March 2024 to PT Alam Sumber Rezeki (ASR), which plans to operate at the mouth of the Benggaulu River in Karossa.

The May 5 rally at the West Sulawesi governor’s office was sparked by a public statement from Governor Suhardi Duka, who dismissed the opposition as “thuggery” and insisted the mining permit had been issued in accordance with the law.

“That statement shows that our leaders still greatly lack a sense of solidarity with the people and the ability to understand what we are going through,” said Taufik Rama Wijaya, youth coordinator at the Indigenous Peoples Alliance of the Archipelago (AMAN) in West Sulawesi.

For nearly three hours of the protest, no government official came to address the crowd. It was reported that the governor and his team were on their way to Jakarta — some 2,000 kilometers (1,240 miles) to the west from his office. Frustrated, the protesters attempted to force their way into the governor’s office, sparking a clash with security forces. Several demonstrators were drenched by water cannons during the confrontation.

“So why is it so difficult for us to simply meet the governor and directly express our concerns?” said Zulkarnain, a coordinator of the Alliance of West Sulawesi People Against Mining.

PT Alam Sumber Rezeki holds a 69.9-hectare (173-acre) mining concession, according to Minerba One Map Indonesia (MoMI), an area that largely overlaps with community-owned land and fishponds. An investigation by the Alliance of West Sulawesi People Against Mining into the company’s feasibility study indicates that sand extracted from the river will be transported to North Penajam Paser district in East Kalimantan to support the construction of Indonesia’s new capital, Nusantara.

Many environmentalists have warned of the extensive footprint of environmental degradation brought on by the development of the city’s core and supporting infrastructure — not just in the interior of East Kalimantan, but across the island and beyond.

“The presence of sand and rock mining operations in several parts of West Sulawesi meant to supply materials for the new capital (IKN) or for sand exports poses a serious threat to communities living near the extraction sites,” the group said. “This is currently being experienced by residents in Mamuju and Central Mamuju.”

The protest in West Sulawesi is part of a long-running resistance. Residents had previously organized demonstrations at the village, subdistrict and regency levels and repeatedly participated in public hearings with the West Sulawesi provincial legislature and the mining company.

Yet, the government pushed ahead with the permit while public opposition was still mounting. The decision has not only intensified tensions between the community and the company but also led to criminalization of at least 21 residents (18 from Central Mamuju and three from West Kalukku) reported to the West Sulawesi police for rejecting the mining operation.

“Community involvement in issuing permits must not be merely a formality because they are the ones most affected by the mining,” AMAN’s Rama said.

Rama and his group demanded the closure of harmful mining operations in areas such as Karossa, Kalukku and Pasangkayu while also condemning the West Sulawesi governor’s remark equating anti-mining protests with thuggery and calling for a public apology. They also denounced police repression of peaceful demonstrators, urged the release of three detained protesters and called for an end to all environmentally destructive mining activities.

“The Indigenous youth and communities will not remain silent. We will continue to speak the truth and stand with the people,” Rama said.

Forest Bird Trade Flies Quietly Under Social Media Radar

  • During the COVID-19 pandemic, a young documentary filmmaker began quietly joining a growing number of Facebook community groups run by traders of rare Indonesian birds.
  • Over the following two years, a reporting team from several news organizations uncovered a wide network of actors offering species for sale for as little as 250,000 rupiah ($15). These individuals included a serving naval officer.
  • One shop owner selling birds in Morowali, the epicenter of Indonesia’s nickel mining and smelting boom, said they began trading in birds in 2018, after ships began docking in the local port bringing oil and cement.

KENDARI, Indonesia — In 2021, as the world grappled with the COVID-19 pandemic, Irwan watched online as a flurry of new social media groups dedicated to parrots sprang up across Indonesia.

When Irwan, whose name Mongabay has changed to protect his identity, first began participating in these online marketplaces, he saw a rainbow of parrot species offered for as little as $15 a bird, but with little further information about the species.

Two years later, after careful research, Irwan helped uncover a diffuse network of operators quietly transporting rare birds from eastern Indonesia for sale. He set out to establish whether the birds were bred in captivity or plucked from protected forests around the industrial boomtown of Kendari, his home in Southeast Sulawesi province.

“This was never detailed,” Irwan told Mongabay Indonesia. “That’s what interested me about it.”

Illegal trade in wildlife around the world is worth up to $23 billion each year, with one out of four global bird and mammal species falling victim to the business, according to BirdLife International.

As in other criminal enterprises, researchers emphasize that the true extent of the illegal trade dwarfs the number of seizures by authorities.

Much of the trade is conducted on social media. In 2016, Facebook partnered with WWF and other environmental groups to form the Coalition to End Wildlife Trafficking Online, aiming to reduce wildlife trade on the platform by 80% within four years.

In 2019, Facebook banned all live animal trade on its platform, allowing only verified sellers with legitimate business reasons. By 2020, the partnership introduced an alert system that notified users about the illegality of trading wildlife products whenever relevant search terms were used.

Mongabay Indonesia worked with other news outlets including Garda Animalia, which reports exclusively on the wildlife trade in Indonesia, to track and document the illegal bird trade in Sulawesi, an important transit hub for wildlife in the archipelago.

Reporters saw protected species advertised openly on social media, including the yellow-crested cockatoo (Cacatua sulphurea), black-capped lory (Lorius lory) and Moluccan eclectus (Eclectus roratus).

One account was traced to an individual whom reporters dubbed by their initials, WL: a university student in Puwatu, a subdistrict of Kendari. Reporters found WL in a two-story house fenced in by concrete and iron walls, with a plastic sheet obscuring the view of a terrace. Parrots native to the island of New Guinea perched in an enclosure outside.

WL said he’d obtained the parrots from a contact known by the Facebook pseudonym “M Parrot.” He claimed the man held a breeding permit from the provincial conservation agency in Southeast Sulawesi, the BKSDA.

WL and M Parrot were members of the same Facebook groups, where they interacted. WL said he understood that M Parrot kept around 20 pairs of birds, and that they could be identified by rings on the birds’ talons used to show certification.

“If it turns out that it’s against the law … well, don’t blame me,” WL told our reporting team. “I’m just a buyer.”

The student said the trade in birds from New Guinea likely came from hunters based in the island, whose western half is part of Indonesia.

Meanwhile, parrots in Kendari are often sourced from Obi Island in North Maluku province, and sent to port in Morowali by weekly ship. From there, the cages are switched to an overland transfer to Kendari.

Boomtown birds

Bungku harbor serves the industrial heartland of Morowali, which is undergoing rapid development as part of Indonesia’s nickel mining boom. The port was undergoing renovations and there wasn’t a ship to be seen when reporters visited this year.

A port worker said he usually saw crates of birds endemic to Maluku and Papua unloaded every week as large ships docked in Morowali. From here, the bird trade fans out into this part of Sulawesi, the world’s 11th largest island.

We met a man on the roadside of the main highway north of Morowali selling various types of parrots, without any official documents.

“This is 650,000 rupiah [$40],” he said, offering us a cage. “It’s a Maluku parrot.”

The man said he obtained the birds from crew members of ships anchored in Morowali, and that he would occasionally purchase birds from a trader in South Bungku, a subdistrict of Morowali.

The main road was packed with thousands of motorcycles of workers from the vast Morowali nickel smelting complex, a key node in the global electric vehicle industry. Inside one small shop by the road we found two black-capped lories, the birds’ feet chained to a small perch. Three yellow-streaked lories (Chalcopsitta scintillata) idled in their cages above a thin base of sand.

The black-capped lories were each priced at 1.8 million rupiah ($110), while the asking price for a yellow-streaked lory was 800,000 rupiah ($50). A contact number was displayed in front of the shop.

The owner said he’d been trading in birds since 2018, after ships bringing oil and cement started docking more frequently in Morowali to feed the mining boom in the region.

Later, when asked to identify the source of the birds via a WhatsApp message, the shop owner didn’t respond.

In October 2023, our reporting team visited the Southeast Sulawesi office of Indonesia’s conservation agency, the BKSDA, to obtain information on breeding permits for birds in the province.

The agency held only one such permit on file. It had been authorized in March 2023 in the name of Asriaddin.

Erni Timang, forest ecosystem lead for the Southeast Sulawesi BKSDA, said that documentation held by the conservation agency showed the permit holder didn’t have a license to deal in the birds.

“He can only breed, he can’t trade yet,” Erni told Mongabay. “You need to have a distribution permit first.”

Ahmar, the BKSDA’s conservation lead for Kendari, said his office had on several occasions attempted to clarify the trading status of the permit holder. However, Ahmar said that on every occasion, Asriaddin was unavailable at his registered address because he was on duty at the Kendari naval base. A public relations officer at the base confirmed that Asriaddin was a serving naval officer.

Mongabay visited the registered address in late March. At the home we saw cages containing various colorful parrot species, exotic imports as well as eastern Indonesian endemics, including black-capped lories, yellow-crested cockatoos, and a black lory (Chalcopsitta atra).

“In the past there were many, but now there are fewer,” a resident at the address told reporters.

On May 25, reporters reached Asriaddin by phone and asked about his status as a trader of birds.

“That’s not correct, it’s just speculation,” Asriaddin said.

When asked whether he had failed to report any breeding activities to the government conservation agency, Asriaddin claimed to not properly understand the reporting requirements.

Singky Soewadji from the Indonesian Wildlife Lovers Alliance (Apecsi), a civil society organization, criticized the awarding of breeding permits by the BKSDA conservation agency, which is part of the Ministry of Environment and Forestry.

“The director-general of the BKSDA should carry out its control function,” Singky said, “not wait until there is a violation of the law.”

Editor’s Note: The Halmahera Island in Indonesia is the only known home to the Hongana Manyana tribe. Unfortunately, it is also the home to vast reserves of nickel. Mining companies are now evading the indigenous rights and ecological rights of the inhabitants of the island, as well as of the island herself, to steal the nickel. The nickel is going to be used for manufacturing electric cars. The following piece is taken from Survival International.

Guardians of their forest

The Hongana Manyawa – which means ‘People of the Forest’ in their own language – are one of the last nomadic hunter gatherer tribes in Indonesia, and many of them are uncontacted.

They have a profound reverence for their forest and everything in it: they believe that trees, like humans, possess souls and feelings. Rather than cut down trees to build houses, they make their dwellings from sticks and leaves. When forest products are used, rituals are performed to ask permission from the plants, and offerings are left out of respect.

The Hongana Manyawa root their whole lives to the forest, from birth to death. When a child is born, the family plant a tree in gratitude, and bury the umbilical cord underneath: the tree grows with the child, marking their age. At the end of their lives, their bodies are placed in the trees in a special area of the forest that is reserved for the spirits.

If there is no more forest, then there will be no more Hongana Manyawa.

Providing for themselves almost entirely from hunting and gathering, the Hongana Manyawa are nomadic; setting up home in one part of the forest before moving on and allowing it to regenerate. They have unrivalled expertise in the Halmahera rainforest, hunting wild boar, deer and other animals and maintaining a close connection with the sago trees – now threatened by deforestation from mining – which provide their main source of carbohydrate. They also have incredible medicinal knowledge and can treat many sicknesses with local plants, although this has become increasingly difficult following the new diseases brought by forced contact and resettlement in villages.

It’s more convenient for me to keep moving because the food is much more diverse and available, I can go hunting regularly. Permanently staying in the village is very uncomfortable and there is a lack of food.

Avoiding contact to stay alive

The arrival of the mining companies is just the latest threat to the Hongana Manyawa and their land. In recent decades, Indonesian governments have repeatedly tried to force contact onto the Hongana Manyawa, with the aim of stopping their nomadic way of life and evicting them from their ancestral forest home. They say this is to “civilize” them: they have tried to settle the Hongana Manyawa and have built Indonesian-style houses for them. The Hongana Manyawa say these new houses, with roofs made of metal sheets rather than palm leaves, made them feel “like animals in a cage”.

One Hongana Manyawa woman told Survival:

We are so happy living by the forest with different kinds of meat and food, where we can collect roof materials so we can replace the zinc roof the government has built for us.

As with uncontacted tribes the world over, forced contact has proved disastrous for the Hongana Manyawa. They were immediately exposed to diseases to which they had no immunity – from the late 1970s to the early 1990s, terrible outbreaks of diseases which the Hongana Manyawa refer to as “the plague” affected the newly-settled villages, leading to widespread suffering and even death.

We had many different diseases when first settled, some of the sickness led to deaths, some people had fever that went on for days and nights and endless coughing for days and even weeks.

The contacted Hongana Manyawa also serve as convenient scapegoats for the police, who frequently blame them for crimes they have had nothing to do with. Several of them have been imprisoned for murders they did not commit and have languished in jail for many years.

It’s better to live in the forest so we don’t get accused of these things. We feel unsafe and many of the men moved into the forest and then came to get their wives and families. Some are deep in the forest…they are deeply traumatized.

Far from being respected for their unique and self-sufficient ways of living, the Hongana Manyawa experience severe racism and are regularly described by Indonesian officials and the media as ‘primitive’. There is a widespread belief that they would benefit from ‘integration’ into wider society: a belief that comes with disastrous and deadly consequences.

Many Hongana Manyawa are now living in government-built villages. Many others – traumatised by the government’s forced settlement attempts, like other peoples around the world who have experienced forced contact – have returned to their forest.

The uncontacted Hongana Manyawa have made it clear time and time again that they do not want to settle or have outsiders coming into their forest. They are very much aware of the dangers – including fatal epidemics of disease – which forced contact brings. As with the uncontacted Sentinelese tribe of India, it is little wonder that they are defending their lands and shooting arrows at those who force their way in.

But now they face the threat not just of being forced out of the forest that sustains them, but of seeing it all destroyed by corporations rushing to provide a supposedly ‘sustainable’ and ‘environmentally friendly’ lifestyle to people thousands of miles away.

‘Green’ mining threatens the lives of uncontacted tribal people  

The greatest threat to the Hongana Manyawa today comes from a supposedly ‘green’ industry.

Their rainforest sits on lands rich in nickel, a metal increasingly sought after as an ingredient in the manufacture of electric car batteries. Indonesia is now the world’s largest producer of nickel, and Halmahera is estimated to contain some of the world’s largest unexploited nickel reserves. Nickel is not essential for these batteries, but now that the nickel market is booming, mining companies are homing in and tearing up huge swathes of rainforest.

The uncontacted Hongana Manyawa are on the run. Without their rainforest, they will not survive. These cars are marketed as ecofriendly alternatives to fossil fuel powered cars, but there is nothing ecofriendly about the way nickel is being mined in Halmahera.

It goes without saying that uncontacted tribes cannot give their Free, Prior and Informed Consent to exploitation of their land – which is legally required for all ‘developments’ on Indigenous territories under international law.

Nevertheless, Weda Bay Nickel (WBN) – a company partly owned by French mining company Eramet – has an enormous mining concession on the island which overlaps with Hongana Manyawa territories. WBN began mining in 2019 and now operates the largest nickel mine in the world. Huge areas of rainforest which the Hongana Manyawa call home have already been destroyed. The company plans to ramp up the mining to many times its current rate and operate for up to 50 years.

If we don’t support the fight for their forest, my uncontacted relatives will just die. The forest is everything, it is their heart and life. My parents and siblings are in the forest and without support they will die. Everything in the forest is getting destroyed now – the river, the animals, it is gone.

The Indonesian government claims that nickel mining is “critical for clean energy technologies” yet coal-fired power stations are being constructed at IWIP to process the nickel. The International Energy Agency estimates that 19 metric tons of carbon are released for every metric ton of nickel smelted and there is evidence from a similar project in Sulawesi of this leading to respiratory diseases for locals. Not only is this mining (accompanied by roads, smelters and other huge industrial projects) devastating the Hongana Manyawa’s rainforests, it is also polluting the air and damaging the rivers. The processing of nickel is often highly toxic, involving a host of chemicals which produce almost two metric tons of toxic waste for every metric ton of ore processed.

Survival is fighting against false solutions to the climate crisis, which are destroying Indigenous lands and lives. 

They are poisoning our water and making us feel like we are being slowly killed.

Eramet, Tesla and connected companies

International companies are involved, directly or indirectly, in the mining of uncontacted Hongana Manyawa land.

WBN is a joint venture between several companies, but French company Eramet is part-owner and responsible for the mining itself. Eramet prides itself on its environmental and human rights credentials, claiming that it will “set the standard” and “be a benchmark company” when it comes to human rights. Yet it continues to mine on the territory of the uncontacted Hongana Manyawa.

Survival has learned that German chemical company BASF is also planning to partner with Eramet to build a refining complex in Halmahera and that a possible location for this may be on uncontacted Hongana Manyawa territory. This would be devastating for the uncontacted Hongana Manyawa in the area, who are already in hiding from mining.

Survival has been told that uncontacted Hongana Manyawa are now fleeing further and further into the rainforest, traumatized by the attacks on their forests and way of life.

Trees are gone and replaced with the big road, where giant machines go in and out making noise and driving the animals away.

Tesla, the world’s largest electric vehicle company, has signed contracts worth billions of US dollars to buy Indonesian nickel and cobalt for its batteries. Its CEO Elon Musk has also had high level negotiations with the Indonesian government to open an electric car battery factory in the country. Indonesia’s President Joko Widodo has even offered Tesla a ‘nickel mining concession.’

Tesla’s Indigenous rights policy states: “For all raw material extraction and processing used in Tesla products, we expect our mining industry suppliers to engage with legitimate representatives of indigenous communities and include the right to free and informed consent in their operations.”

Yet Tesla has now signed deals with Chinese companies Huayou Cobalt and CNGR Advanced Material, both of which have links to nickel mining in Halmahera. While supply chains are secretive and often obscure, Tesla’s interests in Indonesia and the scale of the planned mining in Halmahera make it possible that nickel mined from Halmahera could well end up in Tesla cars.

I do not give consent for them to take it…tell them that we do not want to give away our forest.

Demand for electric cars is driving the destruction of uncontacted people’s lands. 

Rather than destroying yet more of the natural world, and the people who defend it, in the name of combating climate change, we should be supporting uncontacted tribes to defend their rainforests and their land rights; they are the guardians of the green lungs of the planet.

We the Hongana Manyawa, do not want a mining company to come, because it will destroy our forest. We will protect this forest as much as we can. If the forest is destroyed, where will we live?

Take Urgent Action for the Hongana Manyawa

The Hongana Manyawa are running out of forest and running out of time. They desperately need international support to stop the destruction of their homelands before it’s too late.

The Hongana Manyawa’s land rights must be recognised. Survival is calling for the declaration of an emergency zone for the uncontacted Hongana Manyawa. Around the world, Survival has successfully campaigned for the land rights of uncontacted tribes, defending them from outsiders bringing in deadly diseases and devastating development projects which could destroy them.

We are calling for:

– Eramet and the other companies mining in Halmahera, to immediately abide by international law and stop mining and other developments on the lands of uncontacted tribal people.
– Tesla and other car companies to publicly commit to ensure that none of the nickel or cobalt they buy ever comes from the lands of the uncontacted Hongana Manyawa in Halmahera.
– The Indonesian government to establish an ‘Uncontacted Tribe No-Go Zone” to protect the uncontacted Hongana Manyawa and their territories.

With your support, the territories of the uncontacted Hongana Manyawa can be protected from mining so that they can continue to live as they choose on their own land.

Editor’s Note: The following Mongabay article is based on a recent study that found that marginalized subsistence communities are driving deforestation due to poverty. The article also writes that deforestation caused by these communities cannot still be compared to industrial deforestation. It is understandable that basic needs may drive people towards deforestation. But where does the poverty come from? It is unfortunate that the communities that once lived harmoniously with the forests are now doing the opposite. Why are they now unable to do so in the same forests?

It may be that the forests that they live in now do not produce as much as they used to in the past, or that the number of people dependent on the forests now exceeds the carrying capacity of the forests. Both of these are a possibility. Humans are currently in a population overshoot. Forests across the world are being used for industrial purposes, leaving less for the subsistence communities. In addition, the overall destruction of the environment has impacted the health, and hence productivity, of natural communities. In technical terms this is called “absolute poverty,” where a person’s basic needs are unmet. A related concept is that of “relative poverty,” where a person’s income is far less than the societal norms. In this type of poverty, the person thinks of himself/herself as poor in comparison to others he/she is exposed to on a daily basis. Exposure to the industrial culture is a tool that different states have employed to assimilate indigenous populations and, thus, destroy their culture. This turns indigenous cultures against their landbases: harmonious relationships are replaced by exploitative ones. While it is necessary to acknowledge this trend, it is also worth pointing out that a lot of the indigenous communities are risking their lives to protect their landbases.

Subsistence communities, those who live off the forest and lead largely sustainable lifestyles, can actually become drivers of forest loss and degradation under certain circumstances, according to a new study. This happens when external changes put pressure on their traditional lifestyles.

This could be anything from market demands that shift agriculture practices to increased populations in need of resources living in forest areas. These shifts could make communities another alarming source of carbon emissions, say researchers.

Subsistence communities have often been associated with low environmental impact and a small carbon footprint. But as external pressures and demand for natural resources increase, these communities tend to intensify their forest activities to meet their basic needs, at the same time releasing more carbon stocks into the atmosphere from forest destruction, according to researchers.

In the new study published in the journal Carbon Footprints, researchers set out to look at this phenomenon on a global scale. They did a systemic review of 101 scientific reports, all based in the tropics, to see if they could identify the livelihood activities and triggers that lead to forest degradation. Thirty-nine reports are in Africa, 33 in Asia, and 29 in Latin America.

The authors point out that these are the same sustainable communities, such as Indigenous and local people (IPLCs), that will be the first ones impacted by forest loss and climate change, as they continue to depend on these diminishing forests and tend to be materially poor or deprived.

About 90% of people living in extreme poverty depend on forest resources for their survival, according to the U.N. Food and Agriculture Organization (FAO).

“At the end of the day, these communities need support, and their impact, I think, while it has not been quantified to its true extent, their impact is still minimal compared to what the energy industry does,” says Wendy Francesconi, author of the report and senior environmental scientist with the Alliance of Bioversity International and CIAT.

Their initial aim of the research was to collect data about how much forest cover is lost due to sustainable communities, but this proved too challenging to track, says Francesconi. Their impact is minimal and not documented as well as larger scale or industrial drivers of deforestation.

“I think one of the key messages is that we have to start paying more attention to these communities and how to support them better because they also have power in numbers—and impact in numbers,” she tells Mongabay via video call.

The authors identified two main activities the communities engaged in that became the main drivers of forest loss or degradation: intensified wood collecting (particularly for firewood or charcoal) and agriculture.

Other activities include illegal practices such as illicit crops or illegal logging and mining. The latter has been a growing concern for environmentalists who have seen Indigenous communities engage in illegal mining in Brazil and logging in Indonesia to supplement their income.

The factors pushing these changes include increased local population pressures in conjunction with changing lifestyles, availability of alternative labor, land tenure rights, market access, governance, migration, and access to technology.

External factors were highly context-dependent, however, and not all of them led to forest loss in all cases. A larger household size, for example, was associated with higher deforestation in most cases; but some case studies showed a higher likelihood for large families to share resources among each other, resulting in lower demand for resources and less forest loss, such as one case in Ethiopia.

It’s important to understand these dynamics so we don’t start to see “a more vicious cycle, where deforestation creates more poverty, then more deforestation, then more poverty, etc.” Martha Vanegas Cubillos, senior research associate at the Alliance for Biodiversity International and CIAT and another author of the study, tells Mongabay via video call.

Changing livelihoods in Indonesia

One of the studies analyzed from Asia looks at the impact of mangrove deforestation in South Sulawesi, Indonesia, and its socioeconomic consequences. The 2016 study identified that the total area of mangroves decreased by 3,344 hectares (8,263 acres), or 66.05%, in the study area of the Takalar District between 1979 and 2011.

The majority of this loss was for the creation of shrimp ponds, mainly driven by local fishermen changing their livelihoods to shrimp farming. There are two reasons for this shift: as an export product, shrimp have more stable prices, but also government incentives, like credit and subsidies, were available for farmers to expand shrimp ponds, says the report.

This forest loss had a number of impacts on the local community, as it reduced the area where they could continue with their traditional use of the mangroves, like collecting firewood, house materials, and fish traps. It also exposed them to coastal erosion and saltwater into their territory, and released the rich carbon stocks stored in the mangrove trees, says the report.

This shift in production made the communities here more vulnerable, as they put all their eggs in one basket, centralizing their earnings in shrimping, and removing the protective cover of the mangroves from climate changes, says Ole Mertz, professor in the department of geosciences and natural resource management at the University of Copenhagen, and one of the authors of the South Sulawesi study.

But Mertz is skeptical that any global generalizations can be made from a literature review alone, referring to the Carbon footprints study, saying these drivers are often context-dependent.

Speaking from his experience working with communities in South East Asia, the most important driver of forest loss by smallholder communities – a term he prefers to ‘sustainable communities’, which he considers an inaccurate generalization – has been the political pressure to develop land to something more productive.

This includes policies to promote industries like palm oil, rubber, or, in the case of South Sulawesi, shrimp ponds, which has more to do with political decisions rather than the community’s socioeconomic situation, he says.

“Poverty might in some cases be driving deforestation, but I think it’s always in combination with other things, with other drivers,” he tells Mongabay.

More energy needs, more deforestation in the DRC

Communities in the Democratic Republic of the Congo (DRC) are already feeling these external pressures, says Raymond Achu Samndong, a manager at the Tenure Facility, an IPLC organization based in Sweden.

In his 2018 paper – which was included in the Carbon footprints literature analysis – Samndong and fellow researchers take a closer look at deforestation at the community level in the Bikoro and Gemena regions, two REDD+ project areas in the DRC. After conducting interviews in the communities, 82% of households said they engaged in some type of forest clearing in the year prior to the study, despite the REDD+ incentives not to deforest.

All of them said it was for agriculture purposes, like moving or expanding crop area, while some also said it was for wood collection, either for charcoal production or artisanal logging. Charcoal and firewood are the main sources of energy in the DRC, with only 9% of the population having access to electricity, including in the capital Kinshasa.

As energy needs increase, particularly for businesses and restaurants in the city, the traditional use of charcoal is now a concerning driver of deforestation.

The main decision to clear forests in the REDD+ areas was economic poverty, lack of alternative livelihood or income generation, and lack of basic infrastructure and services, says the study.

Samndong says communities he’s worked with in the DRC are already seeing the effects of climate change, as changing weather patterns have reduced their harvest. They are aware that more deforestation will contribute to climate change and biodiversity loss, but community members tell him they don’t have any economic alternatives, “it’s like a survival strategy,” he tells Mongabay by a video call from his home in Sweden.

Solutions to deforestation should look at all the dimensions and drivers of it, not just depend on one economic incentive, like REDD+, to address it, adds the study. Better land use planning, tenure rights to communities, and more accountable institutions are among the needed solutions, researchers point out.

But Samndong says it’s essential that communities be involved in these plans. Billions of dollars have already been spent on development programs in the region over the years and nothing has changed, he elaborates.

“The problem is that development programs have been very challenging in Congo because they are mostly top-down,” he tells Mongabay, adding local communities still know and understand their local forests better than experts in the capital, or abroad.

Conflict and cash crops in Colombia

Deforestation in Colombia has long been a problem but has skyrocketed since 2016 when the FARC guerrillas and the Colombian government signed peace agreements to try to stem the conflict. Deforestation in parts of Colombia then accelerated—reaching a peak in 2017 with 219,552 hectares (542,524 acres) of forest loss—as the FARCs left many strongholds in the forests and mountainsides, which opened up previously forested areas to illegal economic development, such as growing small coca fields for cocaine production as cash crops.

One study published in 2013 takes a closer look at the conditions under which local communities plant coca. Their research, included in the Carbon Footprints analysis, found a direct correlation between coca cultivation areas and those deemed Rural Unsatisfied Basic Needs areas, indicating that poverty was a major factor in areas where communities engage in coca cultivation. The others include weakness and low presence of the state, violence and armed conflict, inaccessibility, and favorable biophysical conditions.

Vanegas Cubillos, who has long been working with communities in Colombia and Peru, says Colombia is a very particular case, as the ongoing armed conflict has greatly impacted rural communities. Migration and forced displacements have forced communities to inhabit new territories, often causing some level of deforestation in areas where fertile lands are scarce.

Both in Colombia and on a global scale, there are opportunities for both the public and private sectors to create economic benefits for communities, and to break the cycle of deforestation, she says.

“Until they realize that they really have to pay attention to these communities,” she says, “I think that this is a problem that can continue to get worse.”

How Corrupt Governments Use The Law to Punish Environmentalists

Editor’s note: Monday’s article covered the murder of environmentalists—at least 207 were killed last year. These killings are the extreme end of a spectrum of violence and repression used against environmentalists and land defenders. Another weapon on that spectrum is draconian laws that prioritize business interests over communities and the natural world.

These laws are common globally. Here in the United States, for example, corporations have more rights than human beings and protests are increasingly criminalized. Today’s story comes from Indonesia, where a new mining law is being used to punish activists. These measures are a predictable corporate/government response to grassroots resistance movements, and they must be fought.

It’s also noteworthy that these laws may unintentionally lead to an increase in underground action and eco-sabotage, as clandestine action may be both a safer and a more effective option when civil dissent is outlawed.

JAKARTA — In the nearly two years since Indonesian lawmakers passed a controversial mining law, the legislation has increasingly been used by police to arrest villagers and local activists opposed to mining operations on their lands.

Human rights activists, including the national rights commission, Komnas HAM, have criticized the law, an amendment to an old mining law, for its provisions that are widely seen as undermining the rights of local communities for the benefit of mining companies.

“After the revision of the mining law [in May 2020], Article 162 has often been used to silence people’s fights against mining operations,” Melky Nahar, campaign head for watchdog group Mining Advocacy Network (Jatam), told Mongabay, referring to the most contentious provision in the new law.

Article 162 states that “anyone who hinders or disturbs mining activities by permit holders who have met the requirements … may be punished with a maximum prison term of one year and maximum fines of 100 million rupiah [$7,000].”

Of the 53 people subjected to criminal charges for opposing mining companies in 2021, at least 10 were charged with violating Article 162, according to Satrio Manggala, environmental policy manager at the Indonesian Forum for the Environment (Walhi).

“So these people protested [against mining activity], but in their protests, they’re perceived as hindering and disturbing mining activity,” he said at a recent online press conference.

Hairansyah, a commissioner with the government-funded Komnas HAM, called the article “a major setback” as it poses “a serious threat to human rights defenders.” He said the article goes against the 2009 law on environmental protection, which states that no criminal charges may be brought against anyone for campaigning for their right to a clean environment. Activists warn that Article 162 adds to a growing list of measures encouraging the prosecution of dissent against extractive and other environmentally harmful activities.

‘To cripple people’s fight’

Prosecutions under these measures are known as SLAPP, or strategic lawsuits against public participation, and in the case of the mining law’s Article 162, they have proliferated in the past two years.

In December 2020, state-owned tin miner PT Timah pressed charges against 12 residents of the fishing village of Matras, on the island of Bangka off Sumatra, after they boarded one of its vessels in a protest. The company said the villagers had disrupted its operations, in violation of Article 162.

The villagers justified their actions as an act of protest against the company’s mining activities that they said had disrupted their livelihoods, reducing their daily fish catches by nearly 90%.

In November 2021, residents of Tuntung village on the island of Sulawesi blocked the road leading to a nickel mine run by PT Koninis Fajar Mineral (KFM), also in protest against the environmental impact of the company’s activities. They saidthe water in their village had been polluted by KFM’s operations.

Following the protest, local police summoned and questioned at least 13 of the protesters under the pretext of Article 162 violations.

On Dec. 29, some of the villagers reported the police to the local office of Komnas HAM, saying they felt they were being criminalized under Article 162. On Jan. 4 this year, the rights commission sent a letter to the police asking them to stop any legal proceedings against the villagers.

In the letter, Komnas HAM called Article 162 a contentious tool for silencing the voices of people defending their rights against mining activities, and pointed out that the public’s rights to gather and express their opinions are guaranteed under the Constitution and the 1999 law on human rights.

Jatam’s Melky said there was no question that the use of Article 162 by the police was aimed at stifling grassroots opposition. “This increasing trend of criminalization is not an effort to uphold the law, but to cripple people’s fight [against mining],” he said.

‘A devious policy’

The most recent case involving the use of Article 162 was the arrest of 10 people, including villagers and  activists, in Pasar Seluma village in southern Sumatra.

On Dec. 23, the protesters set up an encampment in the mining area of PT Faminglevto Bakti Abadi (FBA), an iron ore miner that they say never obtained their permission to operate in their area, and whose activities since 2010 have been mired in irregularities.

On Dec. 27, police bulldozed the protesters’ tents and arrested them, including Ayu Nevi Anggraeni, a villager who said they were dragged out of their tents like animals.

“We and our children were forcibly dragged. The police didn’t care for us,” she said at an online press conference. “We’re being treated like a thief or an animal even though we did nothing wrong. We didn’t provoke [anyone]. From deep within our heart, we want the mine to be closed.”

Another villager, who did not give her name, said she felt the same.

“We’re just asking for justice,” she said. “When we were being kicked out of the protest site, some police officers called us stupid. Why? We just want to defend our territory.”

The Pasar Seluma police chief, Darmawan Dwiharyanto, told local media that the forced eviction was a last resort after previous attempts to persuade the villagers to leave the site had failed.

Saman Lating, a lawyer representing the villagers, said police investigators had told him the villagers were arrested for disrupting FBA’s activities — that is, for violating Article 162.

“We know that this article is a powerful one in the mining law used by the powers that be,” he said at the online press conference. “This article is meant to perpetuate all mining activities in Indonesia.”

But Saman questioned the use of Article 162 in this case, given that it’s ostensibly meant to protect businesses that have the proper permits. This doesn’t appear to be the case for FBA, he said.

The company is allegedly operating without having conducted an environmental impact assessment, known locally as an Amdal, or obtaining an environmental permit. It has also allegedly failed to pay its post-mining reclamation deposit to the state as of 2018. The deposit, which is required of all miners, is meant to ensure that funds are available for rehabilitating the site once mining operations have ended.

FBA was also included on a list of companies whose mining permits were revoked by the Ministry of Energy and Mineral Resources in 2016. Rere Christanto, manager of the mining division at Walhi, said FBA had also violated at least 15 regulations by operating in coastal and protected areas.

Usin Abdisyah Putra Sembiring, a provincial councilor in Bengkulu, where Pasar Seluma is located, said FBA isn’t fit to operate because it hasn’t fulfilled all of its obligations. In addition to allegedly not having an Amdal and an environmental permit, he said, the company has never reported its environmental monitoring and management plan to the local environmental agency.

Mongabay has reached out to the environmental agency in Bengkulu to confirm the allegations but hasn’t received a response.

If all these allegations are true, said Saman the lawyer, then the police had no grounds for evicting and arresting the villagers protesting against FBA’s presence. By doing so, he said, “the law enforcers are working to justify the mistakes of the company.”

Walhi’s Rere said the case in Pasar Seluma is evidence of how the mining law has become a serious threat to people’s rights.

“What’s happening in Pasar Seluma further convinces us that the mining law is a devious policy used to eradicate people’s participation [in fighting for their rights],” he said.

Constitutional challenge

Activists from Walhi and from mining watchdog Jatam’s office in East Kalimantan province in June last year filed a constitutional challenge against the mining law. The challenge, known as a judicial review, seeks to strike down nine articles from the law on constitutional grounds, including Article 162.

In a hearing at the Constitutional Court on Jan. 5, Ridwan Jamaludin, the director-general of minerals and coal at the Ministry of Energy and Mineral Resources, said the article isn’t aimed at silencing protesters, but at providing legal certainty for investors.

It’s meant, he said, “to protect them from irresponsible people in a government effort to build a healthy climate for investment.”

Jatam’s Melky said this reasoning shows how the government is siding with companies instead of the people.

“His statement shows that the government is not working to guarantee people’s safety and [the rights to] their land, but just to make sure that the interests of companies are guaranteed without hurdles,” he said.

Melky added that during the legislative process to pass the mining bill into law, there was no public participation allowed. This, he said, explains the inclusion of provisions like Article 162.

“The problem is that nearly all mining policies in Indonesia [are issued] without involving the public as the rightful owners of land [in the country],” he said. “All [deliberation] is done behind closed doors.”

Walhi’s Satrio said this isn’t the first time Article 162 has been challenged in court.

The previous mining law also contained the same article, which critics challenged three times at the Constitutional Court. The court eventually ruled that the restrictions prescribed in the article could only be applied to people who have sold their lands to mining companies, and not to all individuals who oppose mining operations, Satrio said.

But when lawmakers passed the amended law in 2020, they reinstated the same old article that the court had ruled unconstitutional, and not the updated version from the court.

“We initially thought that when the mining law was amended in 2020, the article would disappear, or at least the version from the Constitutional Court will be used,” Satrio said. “However, the article reappeared in its complete form, which led to many victims [of criminalization] in 2021.”
