A Transition to “Clean” Energy Is Hurting Indigenous Communities

Editor’s note: The FPIC (Free, prior and informed consent) and UNDRIP (UN Declaration of the Rights of Indigenous Peoples) are international standards, that some companies have adopted into their policies. The FPIC is an international human rights principle that protect peoples’ rights to self-determination. UNDRIP delineates and defines the individual and collective rights of indigenous peoples. Both of these are important principles that improve the sovereignty of indigenous peoples. However, neither of these are legally binding, which has disastrous outcomes.

Companies and countries alike are bypassing these principles in favor of profitable ventures, most recent of which are clean energy projects.

Right now, companies that advance the “clean” energy transition are threatening the land and the livelihoods of indigenous peoples and peasants. Demand for minerals like copper and lithium is skyrocketing, as every economic sector is being transitioned towards the fourth industrial revolution. But indigenous peoples need to have their right to a say in decisions affecting to their land. Ecosystems and people living with the land are being victimized to serve an economy that is desperately trying to save itself from collapsing.

When Francisco Calí Tzay, the United Nations special rapporteur on the rights of Indigenous peoples, spoke at the 22nd United Nations Permanent Forum on Indigenous Issues, or UNPFII, last week, he listed clean energy projects as some of the most concerning threats to their rights.

“I constantly receive information that Indigenous Peoples fear a new wave of green investments without recognition of their land tenure, management, and knowledge,” said Calí Tzay.

His statements — and those made by other delegates — at what is the world’s largest gathering of Indigenous peoples, made clear that without the free, prior, and informed consent of Indigenous people, these “green” projects have the capacity to seriously impede on Indigenous rights.

Free, prior and informed consent — known as FPIC — has always been an important topic at the UNPFII, but this year it’s taken on a renewed urgency.

Mining projects and carbon offsets put pressure on indigenous groups

“The strong push is because more and more of climate action and targets for sustainable development are impacting us,” said Joan Carling, executive director of Indigenous Peoples Rights International, an Indigenous nonprofit that works to protect Indigenous peoples’ rights worldwide.

Indigenous peoples around the world are experiencing the compounding pressures of clean energy mining projects, carbon offsets, new protected areas and large infrastructure projects on their lands as part of economic recovery efforts in the wake of Covid-19, according to The International Work Group for Indigenous Affairs 2023 report.

Green colonialism threatens ecosystems

As states around the world trend towards transitioning to “clean” energy to meet their national and international climate goals, the demand for minerals like lithium, copper, and nickel needed for batteries that power the energy revolution are projected to skyrocket. The demand could swell fourfold by 2040, and by conservative estimates could pull in $1.7 trillion in mining investments.

Although Indigenous delegates say they support “clean” energy projects, one of the issues is their land rights: more than half of the projects extracting these minerals currently are on or near lands where Indigenous peoples or peasants live, according to an analysis published in Nature.

This can lead to their eviction from territories, loss of livelihoods, or the deforestation and degradation of surrounding ecosystems.

“And yet […] we are not part of the discussion,” said Carling. “That’s why I call it green colonialism — the [energy] transition without the respect of Indigenous rights is another form of colonialism.”

However, standing at the doorway of a just “clean” energy transition is FPIC, say Indigenous delegates. FPIC is the cornerstone of international human rights standards like the U.N. Declaration on the Rights of Indigenous Peoples, known as UNDRIP. Though more than 100 countries have adopted UNDRIP, this standard is not legally binding.

Companies and governments don’t abide by communities

Because of this, delegates are calling on countries and companies to create binding policy and guidelines that require FPIC for all projects that affect Indigenous peoples and their lands, as well as financial, territorial and material remedies for when companies and countries fail to do so.

However, there is some push back. The free prior, informed consent process can lead to a wide variety of outcomes including the right for communities to decline a highly profitable project, which can often be difficult for countries, companies and investors to abide by, explains Mary Beth Gallagher, the director of engagement of investment at Domini Impact Investments, who spoke at a side event on shareholder advocacy.

Indigenous Sámi delegates from Norway drew attention to their need for legally enforceable FPIC protection as they continue to protest the Fosen Vind Project, an onshore wind energy complex on Sámi territory, that the country’s Supreme Court ruled violated their rights.

“We have come to learn the hard way that sustainability doesn’t end colonialism,” said a Sámi delegate during the main panel on Tuesday.

Across the globe indigenous peoples face eviction

In the United States, the Reno-Sparks Indian Colony, the People of Red Mountain and members of the Fort McDermitt Tribe filed lawsuits against the federal Bureau of Land Management for approving the permits for an open-pit lithium mine without proper consultation with the tribes. In the Colombian Amazon, the Inga Indigenous community presented a successful appeal for lack of prior consultation from a Canadian company that plans to mine copper, molybdenum and other metals in their highly biodiverse territory.

Consternation over governments and multinational companies setting aside FPIC has long extended over other sectors, like conservation and monoculture plantations for key cash crops. In Peru, the Shipibo-Konibo Indigenous peoples are resisting several large protected areas that overlap with their territory and were put in place without prior consultation.  In Tanzania and Kenya, the Maasai are being actively evicted from their lands for a trophy hunting and safari reserve. Indigenous Ryukyuan delegates condemn the ongoing use of their traditional lands and territories by the Japanese and U.S. governments for military bases without their free, prior, and informed consent.

Implementing the FPIC is truly sustainable

While delegates put a lot of emphasis on the lack of FPIC, they put equal emphasis on FPIC as a crucial part of the long-term sustainability of energy projects.

“FPIC is more than just a checklist for companies looking to develop projects on Indigenous lands,” said Carling. “It is a framework for partnership, including options for equitable benefit sharing agreements or memorandum of understanding, collaboration or conservation.”

The focus at this year’s conference has emphasized the growing role of FPIC in the private sector. Investors and developers are increasingly considering the inclusion of FPIC into their human rights due diligence standards. Select countries such as Canada have implemented UNDRIP in full, although First Nation groups have pointed out irregularities in how it is being implemented. The European Union is proposing including specific mandatory rights to FPIC in its corporate sustainability due diligence regulation. Side events at the UNPFII focused on topics like transmitting FPIC Priorities to the private sector and using shareholder advocacy to increase awareness of FPIC.

Gallagher of Domini Impact Investments said companies have a responsibility to respect human rights, which includes FPIC: “If they have a human rights commitment or they have a commitment in their policies not to do land grabs, we have to hold them to account for that.”

Indigenous leadership at the center of negotiations

In 2021, the world’s largest asset manager, BlackRock, published an expectation that companies “obtain (and maintain) the free, prior, and informed consent of Indigenous peoples for business decisions that affect their rights.” Large banks like Credit Agricole have included FPIC in their corporate social responsibility policy. But in most cases, even when companies have a FPIC policy it doesn’t conform to the standard outlined in UNDRIP and is not legally binding.

“It doesn’t do the work it’s supposed to do to protect self-determination,” said Kate Finn, director at First Peoples Worldwide. “It becomes a check-the-box procedure that’s solely consultations and stakeholder consultation instead of protection of rights and self-determination.”

“If communities aren’t giving their consent, a company has to respect that,” said Gallagher, who added “There’s obviously points of tension where investors have different agendas and priorities but ultimately, it’s about centering Indigenous leadership and working through that.”

Not properly abiding by FPIC can be costly to companies in countries that operate where it is a legal instrument. It comes with risks of losing their social operation to license, and financial damages. According to a study by First Peoples Worldwide, Energy Transfer and the banks that financed the now-completed Dakota Access Pipeline, lost billions due to construction delays, account closures, and contract losses after they failed to obtain consent from the Standing Rock Sioux Tribe in the United States.

Ultimately, Indigenous people need to be part of decision-making from the beginning of any project, especially “clean” energy projects mining for transition minerals on their territories, said Carling. “For us, land is life, and we have a right to decide over what happens on our land.”

There is growing evidence that our addiction to cell phones could be impacting brain functionality and be the cause of stress, anxiety, insomnia, and a lack of attention and focus.

A 2017 report found that human beings are not the only living things to be affected by society’s increasing dependence on wireless technology. Mammals, birds, insects, and even plants are likely being harmed by the electromagnetic radiation (EMR) emanating from Wi-Fi, cell phone towers, broadcast transmitters, and power lines, according to an analysis of 97 peer-reviewed studies conducted by EKLIPSE, a biodiversity and ecosystem project funded by the European Union.

Impact on Birds

The researchers said that “evidence is accumulating that mammals (e.g., bats and mice) have a magnetic sense” that is affected by radio-frequency-modulated electromagnetic fields (RF-EMR). Birds in particular may be highly susceptible. The researchers found that even weak magnetic fields in the radio frequency range can disrupt birds’ magnetoreception, their ability to use the Earth’s magnetic fields to orient themselves and find their way home.

Homing pigeons are well-known for their magnetoreception, but this sense has also been detected in other animals, like red foxes, and there is evidence that even large mammals like deer use the planet’s magnetic fields to sense direction. A number of invertebrates, including worms, mollusks, and fruit flies also use this ability.

“When you start to observe and realize that swallows and house martins no longer nest in towns and villages, when you realize that the sparrows have all disappeared, that in the evenings there are no bats flying in the dusk and that you no longer hear owls hooting, then you will begin to know what effect microwaves from cell towers and antennas are having on the environment,” said one commenter to a One World News article about the report.

Impact on Plants

The report also concluded that EMR can also alter the metabolism of plants, causing “significant changes … demonstrated at cellular and molecular levels.” The authors noted that even a low-level of exposure to EMR “caused a rapid increase in stress-related transcript accumulation in tomato [plants].” Transcription is the first phase in the expression of a gene, in which a specific segment of DNA is copied into RNA.

More Research Needed

The authors said that their findings indicate “an urgent need to strengthen the scientific basis of the knowledge on EMR and their potential impacts on wildlife,” specifically calling out the “need to base future research on sound, high-quality, replicable experiments so that credible, transparent and easily accessible evidence can inform society and policy-makers to make decisions and frame their policies.”

The UK charity Buglife, dedicated to the conservation of invertebrates, (which proposed the analysis) warned that there wasn’t enough research to determine limits to EMR pollution. The group said that “serious impacts on the environment could not be ruled out” and urged that 5G transmitters should not be placed near street lights, which attract nocturnal insects like moths, nor in areas near wildlife.

Credible Risk

Buglife CEO Matt Shardlow, who served on the expert steering group of the report, warned in 2018 that “there is a credible risk that 5G could impact significantly on wildlife.” He added:

“We apply limits to all types of pollution to protect the habitability of our environment, but as yet, even in Europe, the safe limits of electromagnetic radiation have not been determined, let alone applied. This is a classic case of out of sight out of mind, just because humans cannot see electromagnetic radiation this does not mean that animals cannot ‘see’ the pollution or be significantly impacted at a neural or cellular level. A proper research program and clear policy measures are long overdue.”

5G Network Threat

Shardlow specifically warned of the rollout of 5th-generation wireless systems, or 5G networks, and called on telecommunications firms to research the impact of their wireless technology on wildlife and make their findings public. In May 2018, Qatar became the first nation in the world to have a 5G network. The worldwide commercial launch of 5G occurred in 2020.

The report authors also said that strong EMR fields increase the temperature in living tissue, but the intensity needed to induce such heating is “not experienced by wildlife (so far).” It’s notable that they left the door open to this other potential emerging threat, as cell phone adoption rates are steadily rising globally. The number of smartphone users worldwide is forecast to grow from 2.1 billion in 2016 to around 2.5 billion in 2019, according to Statista, a market research firm. That means more cell towers—and more EMR being emitted into the environment.

Scientists Make Appeal to United Nations

The report comes on the heels of a 2015 appeal to the United Nations, signed by more than 200 scientists from 41 countries, urging the international body to address the risks posed electromagnetic fields (EMF), physical fields produced by objects charged by electromagnetic fields and radiofrequency radiation. Specifically, the scientists want the UN to “recognize that EMF exposure is an emerging health and environmental crisis that requires a high priority response.”

“Biologists and scientists are not being heard on the committees that set safety standards,” said Dr. Martin Blank of the Department of Physiology and Cellular Biophysics at Columbia University and signatory of the appeal, in a video address on the website of International EMF Alliance, a group founded in 2009 that disseminates information to policymakers and health authorities about the potential effects of electromagnetic radiation. “The biological facts are being ignored and as a result, the safety limits are much too high. They are not protective.”

Impact of Long-Term Low-Frequency Exposure

Though evidence is mounting that humans may also be physiologically affected by EMF, the jury is still out on the impact of long-term low-frequency exposure. The World Health Organization (WHO) concluded in 2016 that “current evidence does not confirm the existence of any health consequences from exposure to low level electromagnetic fields.” However, the agency does admit that “some gaps in knowledge about biological effects exist and need further research.”

But the WHO is partially responsible for the widespread concern. As Bob Berman points out in his 2017 book Zapped: From Infrared to X-rays, the Curious History of Invisible Light:

“Some of the fears are based on a report issued in 2011 by the World Health Organization’s International Agency for Research on Cancer (IARC). The agency had gathered in Lyon, France, to discuss scientific studies surrounding the question of whether there’s a relationship between radio-frequency-modulated electromagnetic fields (RF-EMF) and cancer. After intense deliberations, and to the great surprise of the world at large, experts decided to classify RF-EMF waves emitted by cell phones, cell towers, and Wi-Fi networks as category 2B, indicating a ‘possible human carcinogen.’”

EMF Safety Limits May Be Inadequate

For Dr. Blank and his colleagues raising the warning flag to the United Nations, the evidence is clear. “Cellphones, tablets, Wi-Fi, etc. Putting it bluntly, they are damaging the living cells in our bodies and killing many of us prematurely,” he said in his video address. “Rising exposure to electromagnetic radiation is a global problem. The World Health Organization and international standard-setting bodies are not acting to protect the public’s health and well-being. International exposure guidelines for electromagnetic fields must be strengthened.”

In his video address in 2016, Dr. Blank suggested that the current EMF safety limits may be inadequate due to the influence of the telecommunications industry on the policymakers. “More protection will probably result from full disclosure of possible conflicts of interest between regulators and industry,” he said.

“We have created something that is harming us, and it is getting out of control. Before Edison’s lightbulb, there was very little electromagnetic radiation in our environment. The levels today are very many times higher than natural background levels and are growing rapidly because of all the new devices that emit this radiation. An example that a lot of us have right now in our pockets is the cellphone.”

Ecosabotage: A Heroic Action Against Ecocide

Editor’s Note: The mainstream environmental movement has failed to save the natural world. A baby step in the right direction has been counterbalanced by a giant leap against Earth. DGR has been speaking up for sabotage of key infrastructures for the past decade. Now, more and more individuals and groups are waking up to the asymmetrical nature of our struggles and to the necessity to use any means that we can. The environmental movement has offered waves of demonstrations, petition drives, lobbying and other forms of protest. Yet, despite all that, Earth and its inhabitants are losing the war waged against us by capitalism. It follows that a reevaluation of strategy and tactics of the environmental movement is in order, including a closer examination of how nonviolence should be understood and practiced.

Consider first the current trajectory of global greenhouse gas emissions. Concentrations of carbon dioxide, methane and nitrous oxide, the three main greenhouse gases, continue to rise setting new records each year. Earth’s atmosphere now has carbon concentrations not encountered since 15 million years ago, about the time our ancestors became recognizably hominoid.

Alas, more is on the way. According to the International Monetary Fund: “Globally, fossil fuel subsidies were $5.9 trillion in 2020 or about 6.8 percent of GDP and are expected to rise to 7.4 percent of GDP in 2025.” Moreover, global direct subsidies nearly doubled in 2021, and to facilitate fossil fuel transport, more than 24,000 kilometers of new oil pipelines are under development around the world.

While it is true that renewable energy systems are also expanding worldwide at a rapid pace, solar panels, wind turbines and the like neither help nor harm the climate. What matters for the climate are greenhouse gas concentrations, and, as noted above, those are on the rise. By its very nature, capitalism expands in all profitable directions, and fossil fuels continue to be profitable.

In this context, we need to ask ourselves whether the destruction of planet-killing machinery is necessarily an act of violence. The answer should be no, because it prevents violence against nature. But, as a whole, the environmental movement’s dedication to the strict avoidance of property destruction is extreme in comparison to virtually all other social justice movements.

As Andreas Malm ironically writes about the movement in his book, How to Blow Up a Pipeline “admittedly, violence occurred in the struggle against slavery, against male monopoly on the vote, against British and other colonial occupations, against apartheid, against the poll tax, but the struggle against fossil fuels is of a wholly different character and will succeed only on the condition of utter peacefulness.” Has nonviolence, even against the machinery of planetary ecocide, devolved from a tactic to a fetish?

The Example of Jessica Reznicek and Ruby Montoya

Consider the case of Jessica Reznicek and Ruby Montoya. In the summer of 2016, Jessica Reznicek, then a 35-year-old spiritual activist following the tradition of the Catholic Worker and the Plowshares movements, and Ruby Montoya, a 27-year-old former preschool teacher and Catholic Worker, carried out multiple acts of sabotage against pipelines and machinery used in the construction of the Dakota Access Pipeline at Standing Rock.

During the night Donald Trump was elected president, the two women trespassed onto the construction site of Energy Transfer, the conglomerate of companies behind the pipeline, and burned down five pieces of heavy machinery. Thereafter they learned how to use welding torches to destroy valves on steel pipes, and during the year 2017 managed to sabotage pipelines up and down the state of Iowa. They also successfully continued their arson attacks against the heavy machinery used in the construction of the pipeline. Both took great care to make sure that no people were ever harmed by their actions, and their campaign of sabotage was not precipitous. In a press release just after their arrests in 2017, Reznicek and Montoya wrote:

After having explored and exhausted all avenues of process, including attending public commentary hearings, gathering signatures for valid requests for Environmental Impact Statements, participating in Civil Disobedience, hunger strikes, marches and rallies, boycotts and encampments, we saw the clear deficiencies of our government to hear the people’s demands.

Instead, the courts and public officials allowed these corporations to steal permissions from landowners and brutalize the land, water, and people. Our conclusion is that the system is broken and it is up to us as individuals to take peaceful action and remedy it, and this we did, out of necessity…

If there are any regrets, it is that we did not act enough.

Water is Life, oil is death.

Both women had previously locked themselves to backhoes and had been arrested several times for nonviolent civil disobedience, but with little impact. By way of contrast, the organization Stop Fossil Fuels described Reznicek and Montoya’s eco-sabotage as “1000 times more efficient than the above ground campaigns,” resulting in a two-month delay of the pipeline completion, from their solo actions alone. Their destruction of heavy machinery and steel pipes was impressively effective, but their protection of Earth’s biosphere came at a high cost.

Following one of the most aggressive prosecutions of environmentalists in U.S. history, Reznicek and Montoya each faced a maximum of 110 years in prison. After accepting plea agreements, Reznicek expected to get four years, but Judge Rebecca Ebinger added a terrorism enhancement to her sentence which doubled her time in prison to eight years. Subsequently, Montoya was given a terrorism enhancement by the same judge resulting in a sentence of six years. Each has been ordered to pay $3.2 million in restitution.

The severity of the sentences given to Reznicek and Montoya may be contrasted with sentences meted out to January 6, 2021, attackers of the U.S. Capitol. During the January 6 attack, defendant David Judd launched a lit object into a tunnel full of police and others in order to clear a path so that the mob could stop the transfer of power from Trump to Joe Biden. The judge, Trevor McFadden, sentenced Judd to 32 months, barely over a third of what prosecutors had requested, and declined to add a terrorism enhancement requested by prosecutors.

Another January 6 attacker, Guy Reffitt, was shown in court to have “carried a firearm, was a member of a right wing militia group and threatened a witness afterward.” The Judge, Dabney Freidrich, rejected a terrorism enhancement and sentenced Reffitt to 7.25 years, less time than Reznicek’s sentence.

Based on the decisions of the three federal judges involved in these cases, one may conclude that the U.S. legal system considers defending Earth in the manner of the Plowshares Movement as terrorism, whereas attempting to overthrow the U.S. government via a right-wing coup is not. This conclusion is reinforced by the recent charges of domestic terrorism of 42 forest defenders in Atlanta. Even legendary environmental activist Erin Brockovich has been linked to terrorist threats by Ohio police. The real purpose of lengthy prison terms and the “terrorism” designation is to defend the interests of capital above all else.

Certainly, Reznicek and Montoya are not the only activists who have made major personal sacrifices in the defense of nature. More than 1,700 environmental defenders from around the world have been murdered between 2012 and 2021 for that cause, and more recently, forest defender Manuel Esteban Paez Terán (Tortuguita) was killed by Georgia police. There are also other courageous U.S. activists, including “valve turners” facing prison terms, but they have largely been ignored and neglected by the U.S. environmental movement.

The Future

Using current technology, researchers have unequivocally demonstrated that renewable energy generation, electrified mass transportation, regenerative agriculture, and sustainable building structures are easily within the grasp of humanity. Alternative, eco-socialist systems of human relations that could replace the cancer of capitalism have also been discussed and proposed. Such a future is still possible, but barely so. It is time to put more emphasis on resistance, as opposed merely to protest. Ultimately, saving the planet from the worst effects of the climate crisis will require global working-class leadership and self-emancipation, together with broad support from the middle classes.

At the time of this writing, the environmental movement is losing the struggle to save the biosphere and losing badly. Punishments for civil disobedience are increasing and can be as severe as punishments for property destruction. Republican legislatures in 34 states have introduced 81 anti-protest bills in 2021 alone. These range from criminalizing protests and making blocking traffic on a highway a felony, to granting immunity to drivers who injure or kill protesters.

The kinds of actions carried out by Reznicek, Montoya and others have the potential to capture greater attention, galvanize a broader mobilization, and thus play a critical role in resisting the destruction of the planetary biosphere. As Malm puts it in How to Blow Up a Pipeline:

The immediate purpose of such a campaign against CO2 emitting property, then, would be twofold: establish a disincentive to invest in more of it and demonstrate that it can be put out of business. The first would not require that all new devices be disabled or dismantled, only enough to communicate the risk. Strict selectivity would need to be observed.

Not every environmental activist is willing to risk the long prison terms, or worse, that could result from such actions. Nor should they be expected to. That kind of commitment requires extraordinary courage and self-sacrifice, like that exhibited by Reznicek and Montoya. But the rest of us can at least honor and support those who do take those risks.

These two women, now languishing in prison, deserve more support from U.S. environmentalists than they have received so far (though an online petition is available). Demanding presidential pardons would be a first step. But beyond that, nominations for awards to recognize their sacrifices and contributions would be an important step forward. Nominating Reznicek and Montoya for awards such as the Right Livelihood Award, Nobel Peace Prize, the Congressional Gold Medal, or Presidential Medal of Freedom would go a long way in advancing the movement to save Mother Earth.

If climate justice activists are unable to recognize and offer full-throated support to the most selfless and courageous among us, what chance do we have to reverse the course of destruction of our planet?

Treasure Hunt for Coastal Gaslink [Communique]

Editor’s Note: The Earth is dying and the industrial civilization is killing it. Decades of the environmental movement has not only failed to stop the ecocide, let alone even to slow it down. By the time you finish reading this article, a species will have gone extinct. We’ve tried peaceful negotiations. We’ve lobbied. We’ve protested. We’ve organized non violent direct action. Yet, what seems to be the most effective action is sabotage of infrastructures, be it the attack on Saudi oil wells or on the Niger Delta. DGR is an aboveground organization, yet believes that it is necessary to use any means necessary to bring down the industrial civilization. Over the past few months, several sections of the coastal gaslink pipeline have been vandalized. Financially, the consequences of each act were minor: a few holes in the pipeline here, some corroded welding seams there, damaged concrete here. Our goal was to contribute to the small delays in a project that was already well over budget.

  1. We drilled holes less than a penny wide in a section of pipe that had not yet been lowered into the trench. We covered the holes with fiberglass film, which temporarily prevents leaks in the pipes, but only lasts a few months. We know that welded sections of coated pipe are assessed before being lowered into the trench. After the trench is backfilled, they are tested under pressure. The holes were sealed in the hope that they would pass the first pressure test, but will have to be excavated and repaired before the pipeline is completed. This occurred during the last week of October on section 8 of the pipeline, between Kilometers 610 and 613.
  2. Between 585 and 588 kilometers of the pipeline, we found a section of pipe that had been dug out, so we damaged the coating at the joints by chipping and sanding it off in less visible places. This coating is needed to protect the pipe from corrosion and rust. We did this in early November. We liked this approach because the damage is not visible, but can still have a significant long-term structural impact if corrosion and rust show up, so it will need to be fixed.
  3. We drilled very small holes and filled them this time with an epoxy putty, somewhere between Kilometers 605 and 608 of the pipeline route (that’s in section 8.) We did this in the second week of November. We weren’t sure if the sealant would withstand the pressure test, but decided it was worth a try since this sealant is easier to source and use than the fiberglass coating.
  4. At the end of November, we drilled and filled holes in the pipe string before it would be lowered into section 6 of the pipeline between Kilometers 486 and 489.
  5. In early December, we chipped and busted the welds on a section of pipe that had not yet been lowered into the trench between Kilometers 606 and 609.
  6. We damaged the protective coating on a section of pipe by chipping and grinding, and chipped a welded seam on several sections of pipe before they were backfilled between Kilometer 377 and 380 of section 5 of the pipeline. This work was performed in early January.
  7. Near Kilometer 27 of North Hirsch forestry road we damaged welds and coating on a pipe section in the middle of January.
  8. We poured hydrochloric acid on the concrete pipes we knew were meant for the tunnel under Wedzin Kwa and used a concrete drill inside the pipe to weaken them even further. The concrete pipes are designed to protect the pipe itself from the pressure of the surrounding soil. Given the heightened security and surveillance of concrete pipe storage, we can’t say when this happened.
  9. In early December, we grinded and chipped the coating on the welded seams of the pipe sections between Kilometers 598 to 601.
  10. In mid February, we scraped and chipped large portions of the pipe coating of the string between Kilometers 626 and 629.

Or is that in fact what happened? Only some of these activities have actually taken place. We waited to share this information all at once, complete with some additional false reports, so the only way to know where repairs are really needed is to excavate and re-examine all the above-mentioned pipes. Cracked concrete or rusted and patched pipes can lead to small leaks and large-scale spills, which is why every action, whether genuine or falsified, is being brought to the attention of the public long before the pipeline is operational.

While we would prefer to write only completely honest report backs, we also believe that we should be resourceful and use every means at our disposal to delay construction as best we can. Editor’s note: Dams change the way rivers function and they impact water quality. Slow-moving or still artificial lakes heat up. This results in abnormal temperature fluctuations which affect sensitive species and lead to algal blooms and decreased oxygen levels. Organic materials build up behind dams and start to produce the perfect environment for carbon dioxide and methane producing microbes. Particularly, migratory species are badly affected by the presence of dams.

Although dams are being taken down in Europe and the US because people have begun to realize the dam-age they do to ecosystems, they are not coming down fast enough. Additionally, new ones continue to be built. At this point in the human caused ecological collapse of the planet’s life support systems, it would be best to leave dam building to the beavers.

The 1999 demolition of the Edwards Dam on Maine’s Kennebec River set off a wave of dam removals across the United States. Since then some 1,200 dams have come down to help restore rivers and aquatic animals, improve water quality, and boost public safety — among other benefits.

Across the Atlantic, European nations have been busy removing thousands of river barriers, too. But until recently the efforts have gone largely unnoticed, even among experts.

Pao Fernández Garrido can attest to that.

An engineer and expert in ecosystem restoration from Spain, Fernández Garrido was finishing her master’s thesis in 2012 when she attend a dam-removal training in Massachusetts that was part of a conference on fish passage.

She was floored to learn about the United States’ widespread dam-removal efforts and returned to Europe determined to learn what was happening with dam removals on the continent — and to be a part of the action.

So did Herman Wanningen, a freshwater consultant  from the Netherlands, who also attended the conference. Fernández Garrido joined him when he founded the World Fish Migration Foundation in 2014. Soon after they helped form a coalition organization called Dam Removal Europe that also includes European Rivers Network, WWF, Rewilding Europe, the Rivers Trust, Wetlands International and the Nature Conservancy.

One of the first things Fernández Garrido and her colleagues wanted to know was the extent of river fragmentation on the continent. That wasn’t easy: While the United States has an exhaustive inventory of its 90,000 dams, not every European country, they learned, had collected similar data.

At the time not much was known beyond the fact that Europe had 7,000 large dams. But as their project to map river barriers, known as AMBER, got underway, they learned the on-the-ground reality included many smaller dams and other barriers — at least 1.2 million river barriers in 36 European countries.

Fernández Garrido and her colleagues spent more than three years on research, including river surveys in 26 countries, to gather the more robust data. Their results, published in Nature in 2020, found that on average river barriers occur almost every half mile.

Two-thirds of these barriers are under seven feet tall, but small doesn’t mean insignificant. Low-head dams and smaller obstructions like weirs and sluices can still block the movement of some fish, as well as aquatic plants, invertebrates, and the flow of sediment and nutrients.

Many of the dams — around 150,000 — are also obsolete and no longer provide any beneficial functions.

The good news, though, is that they also found that 4,000 European river barriers had already come down in the previous 20 years, with France, Finland, Sweden, Spain and the United Kingdom being the most active.

These efforts, though, had largely flown under the radar.

“Nobody was talking about these, nobody,” says Fernández Garrido. “The United States is celebrating that it has removed 1,200 and nobody’s celebrating in Europe because nobody knows.”

That’s changed as they continued with their work to compile research, organize supporters across the continent, and push policymakers for action.

In 2019 the researchers delivered a report on case studies of dam removals and their benefits to the European Commission. The following year the World Fish Migration Foundation published the first-ever Living Planet Index on the global state of migratory fish. It found that migratory freshwater fish populations in Europe had dropped 93% since 1970, much higher than the already dismal global average of 76%.

The cumulative weight of those findings may have had a big impact on policy.

That same year the European Commission published its biodiversity strategy for 2030.

“For the first time ever in history, it stated that we should free at least 25,000 kilometers (15,500 miles) of river in Europe from barriers by 2030,” says Fernández Garrido.

While that was welcome news, it was still only a guideline — not legally binding.

In May 2022, however, the commission followed up with a proposal called the EU Nature Restoration Law. “In this law, they say we must start removing dams,” she says. And the proposed language calls for restoring 15,500 miles of river to a “free-flowing state by 2030.”

The European Parliament will need to ratify the law in the next couple of years. “In the meantime politicians could work to weaken it,” she says. “That’s why environmental groups are working hard to keep it strong.”

On the ground, the work to restore free-flowing rivers continues.

Last year 239 river barriers were removed in 17 European countries, including more than 100 in Spain. Finland is in the process of removing three hydroelectric dams on the Hiitolanjoki River, which will aid salmon populations. And France is home to the tallest dam removal on the continent yet, the 118-foot Vezins Dam on the Sélune River in Normandy, which was removed in 2020. Demolition began this summer on a second dam on the river, La Roche Qui Boit, which will allow the Sélune to run free for the first time in 100 years. Migratory fish populations like salmon are expected to return, and the dam removals will also reduce toxic algae that pooled in the warm waters of the reservoirs during summer.

Some of this work — and more — is showcased in a new documentary, #DamBusters, by director Francisco Campos-Lopez of Magen Entertainment. The film follows Fernández Garrido across Europe as she meets dam-removal heroes in Spain, France, Estonia, Lithuania and Finland.

“Restoring nature is probably the job of our time, our generation,” she says in the film.

But it’s a process that will also take time.

“There are some river systems, like for example in North America, where the benefits of dam removal are shocking and so amazing because that river system was only blocked for only 100 years,” she tells The Revelator. “But when you are talking about recovering our river systems in Europe that have been controlled and mismanaged for 500 years, 600 years, 1,000 years, we have to be cautious about what we expect.”

But even if ecological restoration comes more gradually, political movement has been swift.

“The progress since we started in 2016 until now — having policies proposed at the European level — it’s amazing,” Fernández Garrido says. “It’s really an achievement.”

The combination of research, policy reports, political pressure and movement-building have kickstarted a river restoration effort that shows no signs of slowing down — and could be a model for other regions.
