Tiehm’s Buckwheat, Under Review for Federal Protection, Loses up to 40% of Population

LAS VEGAS— Conservationists discovered over the weekend that someone had dug up and destroyed more than 17,000 Tiehm’s buckwheat plants, a rare Nevada wildflower the U.S. Fish and Wildlife Service said this summer may warrant protection under the Endangered Species Act.

As much as 40% of the flower’s global population, which exists on just 21 acres in western Nevada, may have been destroyed.

This is an absolute tragedy,” said Patrick Donnelly, Nevada state director at the Center for Biological Diversity. “Tiehm’s buckwheat is one of the beautiful gems of Nevada’s biodiversity and some monster destroyed thousands of these irreplaceable flowering plants.”

A routine visit to the site by Center staff revealed substantial impacts to all six subpopulations of the flower, with some subpopulations nearly wiped out. Plants were dug up or mangled with shovels, with taproots cut and most of the dead buckwheats hauled off-site.

Tiehm’s buckwheat has been the subject of recent controversy.

An Australian mining company, Ioneer Corp., has proposed an open-pit lithium mine that would destroy the vast majority of Tiehm’s buckwheat’s habitat. This spring Ioneer Corp.’s biological consulting firm placed a “missing” poster for the buckwheat at the general store in the nearby town of Dyer, offering a $5,000 reward to anyone who locates a new population of the rare flower.

After a whistleblower revealed mismanagement of the species by the Bureau of Land Management, the Center submitted an emergency petition to protect the plant under the Endangered Species Act in 2019. In response the Fish and Wildlife Service said in July the plant’s protection “may be warranted” and initiated a year-long review.

After the initial discovery of the incident, a field survey conducted by Donnelly and Dr. Naomi Fraga, director of conservation at the California Botanic Garden, revealed approximately 40% mortality to the species across all subpopulations, due to removal or destruction.

“This appears to have been a premeditated, somewhat organized, large-scale operation aimed at wiping out one of the rarest plants on Earth, one that was already in the pipeline for protection,” said Donnelly.

“It’s despicable and heartless.”

In a letter sent on Tuesday to the Bureau, U.S. Fish and Wildlife Service, Nevada Division of Forestry and Ioneer Corp., Fraga and Donnelly made a series of recommendations to the agencies including: fencing the site, 24-hour security, immediate stabilization and rehabilitation of affected plants, and immediate termination of any monetary rewards, including Ioneer’s, for finding Tiehm’s buckwheat.

Plants can recover from extreme trauma such as that inflicted upon Tiehm’s buckwheat if given protection and potential assistance through plant care, propagation and transplanting. The letter urges the agencies to immediately commence a protection and restoration program.

“I was absolutely devastated when I discovered this annihilation of these beautiful little wildflowers,” said Donnelly. “But we’re not going to let this stop our fight against extinction. We’ll fight for every single buckwheat.”

Eastside Forest Scam–The Proposed Removal of the 21-inch Rule.

The Forest Service has begun a 30 day comment period on its proposal to eliminate the 21-inch rule or what is known as the Eastside screens. The plan would remove a prohibition against cutting trees larger than 21 inches in the drier forests east of the Cascades in Oregon and Washington. The agency suggests that forests are denser than historical conditions and have shifted in their species composition. Not all researchers agree with this interpretation, but since these scientific studies don’t support more logging, they are usually ignored.

The agency researchers conclude that thinning forests is necessary to promote “forest health” and cutting of larger trees will hasten this transition. Since big trees enhance the profitability of timber sales, there is intense pressure from the timber industry for cutting big trees. However, the elimination of the 21- inch rule will increase the removal of large trees critical to healthy forest ecosystems.

The 21-inch rule was implemented in 1994 to protect larger trees from logging, partially in response to the realization that big trees have a disproportional ecological influence. Unlike the ancient forests west of the Cascades inhabited by the spotted owls, which gained some protection from the Endangered Species Act, eastside forests were vulnerable to the removal of old-growth forests.

In response to the loss of large trees created by excessive logging, Congress convened a scientific panel to review the issue. However, unlike many such scientific panels that rely exclusively on forestry schools and/or the Forest Service for advice, Congress asked the Wildlife Society, the American Fisheries Society, the Society for Conservation Biology, and the American Ornithologists’ Union to produce the Eastside Forests Scientific Society Panel report.  The panel came out with 13 suggestions, including a prohibition on cutting larger trees older than 150. The Forest Service adopted this policy recommendation.

But times have changed.

With the advent of the Trump Administration, there is intense pressure to increase the cut of timber. This pressure, along with collaborators who are more than willing to accommodate the timber industry’s and Forest Service demands (and rely exclusively on their science), many members of collaboratives including some so-called environmental groups support more logging.

In yet another example of the tail wagging the dog, the Forest Service now suggests that to “restore” eastside forests, and “save” them from (god forbid) death from wildfire or beetles, the agency must log the forest.

Part of the underlying assumption behind restoration is that forests are denser now than in the historical past due to fire suppression. The idea that you can restore the forest to some “historic” condition ignores the fact that all vegetation is a reflection of climate. The reason we see more mortality from fires, beetles, drought, and other ecological processes is primarily to changing climate. It’s warmer and drier. With less precipitation, higher temperatures, and more drought, you have the perfect ingredients for wildfire and bark beetle mortality.

There are many things wrong with this perspective.

Trying to emulate the historic forest condition created by the climate at that point in time, is not relevant to the forest structure today.

Furthermore, natural evolutionary processes like bark beetles, drought, and fire are better, selecting which trees should and will survive than a logger with a chainsaw.  For instance, it has been demonstrated that some trees have greater resilience to bark beetle predation, but this genetic advantage is not readily visible to foresters. By randomly logging/thinning the forest, logging may reduce the number of trees with genetic resistance to natural stresses, degrading the “resiliency” of the forest.

In a sense, the Forest Service and its collaborative allies see natural ecological processes like fire and beetles as the “enemy”. Somewhat like the attitude of some hunters view predators like wolves and cougars as “damaging” the deer and elk herds, many foresters and agency personnel view natural mortality from fires and beetles as counter to forestry goals of “green trees” and a source of fodder for sawmills.

This industrial forestry perspective is widely held in the timber industry, Forest Service, and its collaborative allies.

Yet dead trees are essential to healthy forest ecosystems.

They store carbon. They provide habitat as snags and down wood to many species from salamanders to animals as large as bears. For instance, grizzly bears rely on ants found in down trees for a significant proportion of their summer diet. And down trees in streams enhance the productivity of aquatic ecosystems. A substantial portion of birds and other wildlife utilize snags and dead trees at some point in their lifecycles. This is why some researchers have reported high biodiversity in the snag forests that result after a wildfire or bark beetle attacks.

Another rationale for eliminating the 21-inch rule is to reduce competition for resources and increase the remaining trees’ growth. Fast-growing trees are a goal of the Industrial Forestry Paradigm, but it is not necessarily good for healthy forest ecosystems. Slow-growing trees have denser wood, which makes the snags and down wood that remains after they die more resistant to rotting. Therefore, such dense wood is retained longer in the environment providing the above wildlife habitat and carbon storage benefits.

Although it is seldom admitted, one of the chief reasons for removing the 21-inch rule is to increase the economic viability of logging projects.

This is revealed in a recent review of the 21 inch rule in a paper recently published by the Forest Service. In that review, the authors suggest, ” Including larger trees in restoration prescriptions can increase the acreages where fuel treatments are financially feasible. Prestemon et al. (2012) showed that allowing the harvest of live trees over 21 inches increased the acreage in the West where fuel treatments were economically viable, even without considering avoided damage values”.

The paper goes on to note that: “Throughout the West, including live trees over 21 inches in fuel treatment harvests increased the viable treatment area by 2.6 times.” The review also notes: “It is important for managers and stakeholders to consider how large harvested trees can be processed locally to support local mills and be consistent with collaborative group goals.”

Here we see that meeting the goals of the collaboratives is more important than preserving healthy forest ecosystems.

The review admits that: “if no timber products could be sold from forest restoration actions, there was no place on the east side where the expected net economic benefit from fuel treatment would be positive, even when accounting for avoided wildfire damage.” As a consequence, we get to the heart of the issue. Without logging big trees, most thinning and other projects on eastside forests make no economic sense.

One way logging is further justified is by stewardship contracts. Stewardship contracts permit the Forest Service to take profits from timber sales and utilize for other forest projects like mitigating the ecological damage from previous logging projects by removal of culverts or closure of roads.  I have often heard the so-called environmental representatives on collaboratives justify logging to me by saying, “ ?”

Of course, I support closing roads, but we don’t need to build more roads and log the forest to get some money to fix the damage from previous logging projects. Given the amount of money, the FS typically loses on timber sales. Putting agency funds towards road closure and other real restoration could be accomplished without having to log the forest to pay for these projects.

The Moral Argument for Ecological Revolution

In 1941, as World War II thundered across half the planet, my grandfather was drafted into the United States military.

Faced with the prospect of being sent overseas to kill other young men in World War II, his morality rebelled. He refused to join the military and applied for conscientious objector status, which he was eventually granted.

This was not a popular stand to take. Among 10 million draftees, about 43,000, or less than half of one percent, became COs. He and other COs were widely criticized, attacked, and ostracized. Their beliefs were tested by draft boards, families, and communities who rejected their moral convictions and labeled them cowards, deserters, and traitors.

Nearly fifty years later, I was born into a family that looked up to my grandfather’s example. He was a warm, kind grandfather to me. When I was a child, discussions of war, imperialism, racism, exploitation of women, oppression, and the destruction of the planet were not unusual among my family. I was taught that these things must be ended. Social change was a necessity, and non-violent resistance was the method.

Faced with the prospect of World War II, what choices would I have made in my grandfather’s place? On the one hand, the Nazi regime was one of unspeakable evil, and imperial Japan’s actions were equally horrific. On the other hand, the actions of US empire—before, during, and after the war—were not exactly benevolent. As Howard Zinn writes, before the war broke out the United States:

“had opposed the Haitian revolution for independence from France at the start of the nineteenth century. It had instigated a war with Mexico and taken half of that country. It had pretended to help Cuba win freedom from Spain, and then planted itself in Cuba with a military base, investments, and rights of intervention. It had seized Hawaii, Puerto Rico, Guam, and fought a brutal war to subjugate the Filipinos. It had “opened” Japan to its trade with gunboats and threats. It had declared an Open Door Policy in China as a means of assuring that the United States would have opportunities equal to other imperial powers in exploiting China. It had sent troops to Peking with other nations, to assert Western supremacy in China, and kept them there for over thirty years.”

And of course, this is just a partial list. In 1942, the U.S. was still a rigorously segregated society (which it remains today) committed to extracting value from people of color using any means necessary. Slavery built the wealth of the United States, and literally built the White House. And of course, the entire country was built on a settler-colonial genocide—a genocide that Hitler took as inspiration for his “final solution.”

Many prominent Americans, like Henry Ford, were supporters of the Nazi regime. The U.S. government not only failed to speak out against persecution of German Jews before the war, despite clear evidence, but actively rejected those seeking refuge and thereby condemned them to death.

The United States did not fight because of fascism, although individual soldiers may have. Critical history tells us that the U.S. fought Germany, Italy, and Japan primarily for geopolitical reasons: to control a competitor in Germany, to contain communist Russia, and to expand control of the Pacific.

For example, historian Gabriel Kolko says “the American economic war aim was to save capitalism at home and abroad.” This was achieved by consolidating American control over oil in the Middle East, gaining access to new markets formerly dominated by the British, and by a concentrated injection of public funds into private corporations: Boeing, Lockheed, and the other war profiteers.

And at the conclusion of the war, the United States killed 150,000 Japanese civilians in Hiroshima and Nagasaki, in the militarily unnecessary atomic bombing that P.M.S. Blackett calls “the first major operation of the cold diplomatic war with Russia.” In other words, 150,000 people were murdered not out of military necessity, but for the sake of geopolitical posturing.

The fascists needed to be stopped, yes. But the United States’ war was not a particularly just one.

I respect my grandfather’s choice. Most especially, I am impressed by the ethical toughness required to endure serious personal and professional consequences while maintaining his principled stance. There are not many people with that dignity and conviction.

Eighty years after the rise of Nazi Party, we’re faced with rising fascism around the world.

Trump, Bolsonaro, Duterte, Erdogan, Putin. Countless fascist political parties and grassroots movements are on the march. Their main systemic opposition comes from neoliberal capitalism, a soft fascism of it’s own and the primary force which has decimated the planet over the past 40 years. By dismantling public institutions, embracing corporate power and unbridled militarism, corrupting the language of justice, and doubling down on exploitation of the poor and the third world, neoliberals like Barack Obama and the Clintons have helped pave the way for the rise of outright fascism today.

Capitalism itself is a war against the planet and the poor. The global economy is built on exploited farmworkers, sweatshop labor, and a toxic electronics industry that drives workers to mass suicide. All this takes place on top of stolen indigenous lands and a legacy of ongoing genocide.

The material goods that drive economic growth are made from the dead bodies of the land. Mountains are mined and blown to pieces. Rivers are dammed and enslaved. Prairies are plowed under. Forests are scalped. The oceans are strained of all life. Biodiversity is collapsing, the oceans are collapsing, and global warming is advancing faster than the worst-case scenarios. Greenhouse gas emissions are higher year after year, despite slick marketing campaigns about green industry.

The mindset of exploitation and greed is mirrored in the dominant culture. Sexual assault is endemic. Black and brown people are disenfranchised and exploited for slave labor in the prison system, then regularly executed on the streets in a form of modern public lynching. The poor, the homeless, addicts and countless other people are treated as disposable in this society, and they die by the millions as people like Jeff Bezos enjoys a cruise in his latest $100 million yacht.

Now we must grapple with the same question our grandparents did.

What is the moral course of action in this world?

Before we can know the right course of action, we have to understand the root of the problems we face. This step of diagnosis is essential to proper cure. And in fact, the origin of the term radical comes from the Latin word meaning “root.”

Too many people in society today look only at surface-level causes. We must go deeper.

First, we must understand that the problems we face are not an accident or the result of a glitch in the system. This is the normal functioning of industrial civilization. This is business as usual. The economy is booming, and the wealthy are doing very well. Things are working perfectly.

For those in power, times are good

I’ve heard it said that capitalism is a war against the planet and the poor. This is not a metaphor. The dominant economic system is killing, maiming, and destroying the lives of countless billions of humans and trillions of non-humans.

As the world’s third-richest man, Warren Buffett, once said, “there’s class warfare alright, but it’s my class, the rich class, that’s making war, and we’re winning.”

This is a war, and it is a one-sided one.

Working people, the poor, and especially environmentalists often don’t see this system as a form of warfare against us. Relentless propaganda, fed to us through mass media and education, teaches us that we live in a beautiful, just society. All the problems we face—migration, climate disasters, terrorism, sexual abuse—are externalized. Instead of being factors integral to the American experience, these are regarded as someone else’s problem, or ignored completely.

Propaganda, besides inculcating American exceptionalism and the capitalist ethic, also enforces a rigid box of acceptable ways to change the world. Social struggles, we’re told, should take place via policy changes, at the ballot box, and in non-profit offices.

But these models aren’t working

Legislative change, for example, is rarely permanent. Long-standing policies like the Voting Rights Act can easily be struck down or undermined. This is happening right now. The Voting Rights Act, the Clean Water Act, the Endangered Species Act—all of these laws, which are very limited in the first place, are being gutted.

The business of running empire is firmly bipartisan. The Democratic and Republican parties in the United States play out a society-wide “good cop/bad cop” routine. They deceive us into believing that we live in a democracy. They allow robust debate within an extremely narrow range of acceptable politics, and therefore keep people distracted from the theft and violence of the ruling class.

The truth is we have little to no say in how our own communities operate, let alone in how the country is governed.

Constrained by felon disenfranchisement, gerrymandering, the electoral college, constant propaganda, and a representative system with zero accountability, our votes are largely meaningless.

We are so alienated from the concept of self-governance that we have a hard time even imagining it. When was the last time you made a meaningful decision about the political, economic, and social future of the neighborhood, the city, the state, or the country you live in?

For most of us, the answer is “never.”

To call the United States a democracy is laughable. Scholars have proven that our society is an oligarchy. Professor Martin Gilens and Professor Benjamin Page concluded, in their 2014 research paper, that “economic elites and organized groups representing business interests have substantial independent impacts on US government policy, while average citizens and mass-based interest groups have little or no independent influence.”

This is reflected in the nation’s capital. It has been decades since Congress passed a major bill that didn’t benefit the ultra-rich and corporations. Every major national policy decision is designed to steal more from the poor, to destroy the planet even faster, and in the process to make the owning class even more decadently wealthy.

The Non-profit Industrial Complex (NPIC)

Faced with a bankrupt political system, where do people go? Many turn to non-profits, expecting to find a world of small, fiery, organized groups fighting for social change. Instead, they find a new nightmare of bureaucracy, 60-hour work weeks, and starvation wages.

The non-profit system emerges from a liberal ideology that sees American-style capitalism as righteous. In this worldview, small gradual reforms are all that is needed to keep the system humming along happily.

Many of today’s largest foundations we’re created by tax-dodging ultra-wealthy elites in the early 20th century. These have been lucrative investments. Liberal foundations have long served to pacify social movements and prevent radical change.

One of the biggest examples of this is the professionalization of black resistance in the 1970’s and 1980’s. In the wake of revolutionary social upheavals of the 1960’s, foundations invested billions of dollars to create countless new non-profits and social service organizations. Vietnam War hawk McGeorge Bundy, head of the Ford Foundation, led a nationwide push to address racism. But behind the rhetoric was a desire not to address the roots of racism, but to pacify and assimilate oppositional black power movements into the dominant power structure.

Today’s non-profit movement politics reflect the same values: elitist liberalism, individual empowerment, and the optics of diversity. And they produce the same results: endless campaigning for progressive candidates, countless fundraising campaigns, and burnout.

What is absent is a revolutionary agenda for collective liberation from systems of oppression.

The Indian dissident Arundhati Roy, one of the most brilliant writers of our time, has a blistering critique of the non-profit system. She writes:

“Corporate-endowed foundations administer, trade and channelize their power and place their chessmen on the chessboard, through a system of elite clubs and think-tanks, whose members overlap and move in and out through the revolving doors.

Contrary to the various conspiracy theories in circulation, particularly among left-wing groups, there is nothing secret, satanic, or Freemason-like about this arrangement. It is not very different from the way corporations use shell companies and offshore accounts to transfer and administer their money—except that the currency is power, not money.

There are now millions of non-profit organizations, many of them connected through a byzantine financial maze to the larger foundations… The Privatization of Everything has also meant the NGO-isation of Everything. As jobs and livelihoods disappeared, NGOs have become an important source of employment, even for those who see them for what they are. And they are certainly not all bad. Of the millions of NGOs, some do remarkable, radical work and it would be a travesty to tar all NGOs with the same brush.

However, the corporate or Foundation-endowed NGOs are global finance’s way of buying into resistance movements, literally like shareholders buy shares in companies, and then try to control them from within. They sit like nodes on the central nervous system, the pathways along which global finance flows. They work like transmitters, receivers, shock absorbers, alert to every impulse, careful never to annoy the governments of their host countries.”

Greenwashing the environmental movement

One of the most damning examples of the bankruptcy of the non-profit system comes from the large environmental organizations. From The Sierra Club taking $25 million from the fracking industry to Greenpeace cooperating with the Canadian Lumber Industry to the Nature Conservancy’s collaboration with the world’s most polluting corporations, environmental non-profits have a track record of atrocities, compromises, and failures.

On their watch, everything is getting worse. And their solutions? Vote for a democrat, change your lightbulbs, and ride your bike. It’s pathetic.

Today, the global non-profit industrial complex serves as a “pressure relief valve” for budding revolutionary sentiments. By redirecting the energy that should demand fundamental change into piecemeal reformism, organizations like this are worse than distractions. They are in some ways complicit in the system that is killing the planet. Instead of radical change, these groups campaign for relatively minor reforms, such as a shift away from fossil fuels and towards green energy. These efforts are applauded by international conglomerates like General Electric, which stand to make billions in guaranteed government contracts in this so-called “green transition.”

Meanwhile, the forests continue to fall, mountains continue to be mined, and greenhouse gas emissions trend upwards.

Even in places like Germany, home to the supposed “green miracle” of wind and solar energy, emissions continue to rise and corporations grow ever more bloated on government handouts and electricity rebates, while the poor pay for big business to expand the electric grid. To be clear: big business is exempted from the taxes to pay for grid expansions and wind energy projects, then turns around and profits from the contracts to build these industrial megaprojects. Meanwhile, working people foot the bill.

This is a massive wealth transfer from poor to rich.

From one capitalist agenda to another, major environmental non-profits are shaped by what can get funded, and what gets funded is a de facto pro-corporate, pro-capitalist agenda of industrial energy production and “green products.” Driven by a results-oriented framework designed to please large donors, this system inherently deprioritizes radical critiques and revolutionary ideas in favor of what makes money and political sense in the short term.

In short, large non-profits are the social wing of the capitalist system.

Individuals within these non-profits may mean well, but intentions are not as important as outcomes when the fate of our world is at stake.

Cory Morningstar calls liberal climate activism “the hope industry,” writing that “350.org and friends serve a vital purpose . . . [by making] the public feel good about themselves. Simultaneously, they ensure obedience and passiveness to the state in order to secure current system/power structures and keep them intact… We have now reached the critical juncture where corporations will begin the slow process of ridding themselves of their toxic holdings while preparing for a new wave of unprecedented, unsurpassed ‘climate wealth.’ We are about to witness the global transition to profitable false solutions under the guise of ‘green economy’ . . . all while they simultaneously greenwash themselves as noble stewards of the Earth.”

This is how the ruling class rules

In his book Brave New World, Aldous Huxley wrote that an effective totalitarianism doesn’t look like pointing a gun at every person, all the time. “A really efficient totalitarian state,” he writes, “would be one in which the all-powerful executive of political bosses and their army of managers control a population of slaves who do not have to be coerced, because they love their servitude.”

Today’s elites have worked hard to create such a world. They ride the dynamic tension between reform and reaction. When political and economic conditions make it possible to do so, they mercilessly expand their exploitation of the planet and the poor. When groundswells of social discontent force concessions, they offer limited reforms. With the illusion of democracy provided by elections, legislative changes, and the non-profit industrial complex, the ruling class manipulate global society. In this way, they defuse revolutionary potential, expand their power, and consolidate their gains.

These elites, the owning class in global society, are waging an offensive struggle. Meanwhile, progressives and radicals are stuck in a reactionary position, defending ourselves against the latest assault and falling ever further behind. Our work is almost entirely defensive.

But as any experienced warrior knows, wars are not won defensively. These defensive measures can only end one way: in steady erosion of victories, slow slides into fascism, and eventual defeat. This is what we are experiencing right now.

Counter-revolutionary propaganda

Systems for social change have been co-opted by the corporate elite. But agents of oppression are never satisfied with dismantling organizations and institutions alone. They must murder revolutionary leaders, too.

When Che Guevara was on the firing line, his last words were: “Shoot, coward. You’re only going to kill a man.” Fred Hampton, murdered by the police as he lay drugged in his bed at the age of 21 years, once said “You can kill a revolutionary, but you can’t kill a revolution.” Thomas Sankara, the Burkinabé revolutionary sometimes called “Africa’s Che,” had the same message before he was killed: “While revolutionaries as individuals can be murdered, you can’t kill an idea.”

This hasn’t stopped those in power from murdering dangerous individuals and trying to smash dangerous ideas. Psychological and information warfare is constant in modern society. Popular music, television, movies, and other media, as well as institutions like the school system and non-profits, all promote vicious counter-revolutionary propaganda.

According to the psychologist John F. Schumaker we “are by far the most propagandized people in history.” Corporations are expected to spend $2.1 trillion on media in 2019.

Developing an effective offense requires that we discard the mythologies and misconceptions taught by these systems. In other words: as long as our minds are still colonized, we will not be able to fight and win.

One of the most pervasive misconceptions we must dismantle is the mythology of pacifism. This mythology is carefully constructed. School lessons around social movements—if the topic is covered at all—paint a picture of civil non-violent struggle. This is no accident. A whitewashed version of Martin Luther King, Jr. is emphasized, while the Black Panthers are never discussed. The bourgeois American Revolution is celebrated, while the Haitian Revolution is ignored. Women’s suffrage is mentioned, but the radical direct action of suffragists around the world is bypassed. In this way, the imaginations of entire societies are shaped and molded.

The reality, of course, is that social change is won through struggle. The history of our society is the history of class warfare. And revolution is the solution to the problems we face. But revolutionaries are ignored in our education system, slandered in the mass media, and actively opposed in US policy. We must reject these toxic lessons to have a chance.

Beyond non-violence

Non-violence is a profoundly moral way of changing society. In the right conditions, it can be highly effective. But deepening inequality, global ecological collapse, and the utter failure of established institutions to address these crises have led me to question non-violence—not as a moral guiding light, but as a practical strategy.

This morning, I am following the latest news from the Unist’ot’en Camp. In western Canada, the Unist’ot’en have stopped proposed tar sands and fracked gas pipelines for nearly a decade.

They have never ceded their land to the Canadian Government or signed a treaty. Under Canadian law, their land has been recognized as sovereign. But in December, the pipeline company applied for an injunction from Canadian courts. This injunction gives the police (the RCMP) authority to removing any blockades from the roads.

Now, as a result of the injunction, armed men are in Wet’suwet’en Territory to remove the land defenders and facilitate the fracking, logging, water poisoning, road building, and other destruction the pipeline will bring.

The late Secwepemc organizer and international leader on indigenous rights Arthur Manuel called injunctions the “ace in the sleeve of the Canadian government.” He said, “every time there is a dispute between indigenous people’s territories and industry, the court pulls out their court injunctions and sides with industry.”

This fight is still in progress. We don’t know how it will end. It might end in a victory, as did anti-fracking fights on Mi’kmaq territory in 2013. Or it might end in a defeat like at Standing Rock.

But we do know that, as this fight continues, industry is going about their business unimpeded elsewhere. We are not able to fight them everywhere at once. Around the world, coal oil and gas extraction is booming. Tar sands in South America, offshore drilling in the Arctic Ocean, fracking in the Marcellus Shale, coal mining in Mongolia. Major industrial projects are booming worldwide, and greenhouse gas emissions are rising to unprecedented levels as forests, wetlands, grasslands, and oceanic preserves are destroyed for industry. Carbon emissions in 2018 surged by 3.4 percent over the previous year—the largest increase in eight years. Time is short.

To have a chance of stopping the forces that are squeezing the life from the planet, defensive stands like Unist’ot’en Camp are crucial. But defense alone is not enough, and governments continue to side with industry. If we want to survive, we need legitimate offensive strategies.

What does offensive struggle look like?

Legislative change, voting, and the non-profit industrial complex are all controlled by the ruling class. Offensive struggle is, by design, essentially impossible in these arenas.

Real offensive struggle is inherently revolutionary. A revolution is “a forcible overthrow of a government, class, or social order, in favor of a new system.” While that force does not necessarily mean open violence, violence is a part of every revolutionary struggle.

Most people who want social and environmental justice have been taught that violent revolution is morally indefensible. Through fear and lies, elites have shamed us out of organizing and carrying out a revolution. Thus, they limit us to defensive action.

Breaking our allegiance to the dominant system is the first step to effective resistance. This requires we decolonize our minds and remember the true source of life. We all need to choose sides: life or the machine.

Which side do you choose?

Even the preeminent strategist on non-violence, Gene Sharp, talks about non-violent resistance as a form of war. Perceiving our struggle in this way is important. Defensive struggles are possible to undertake while denying that you are engaged in a war. But once you acknowledge that we are in a war, offensive struggle becomes a legitimate possibility.

Once our imaginations have expanded, we can attempt to answer the question: what does offensive struggle look like?

In military strategy, the purpose of offensive action is to destroy your opponents ability to wage war. After effective offensive action, they cannot continue to fight you, no matter how badly they want to.

In my analysis, the primary weapon of war being used against the planet and the poor is the global industrial economy. Therefore, offensive struggle today means breaking the supply lines of industrial capitalism by targeting and destroying key bottlenecks in the the global economic system, and dismantling the institutions of the dominant culture.

If this were carried out, it would change the balance of power globally. Those in power would no longer be physically able to destroy the world, and the way would be clear for alternative cultures, land restoration, and the Earth itself to begin the process of healing.

Ending the war

The war against the planet and the poor is raging right now. To end this war as quickly as possible and with the smallest possible loss of life, our only feasible path is to stop the aggressor’s ability to harm the poor and destroy the planet.

Capitalism has made this a life-or-death struggle. Voting isn’t working. Signing petitions isn’t working. Liberal institutions are in shambles. Those of us who reject this system cannot survive by trying to coexist with the system. At the current rate, it appears that either industrial civilization will survive, or the biosphere will.

War is terrible, and business as usual is a war. The faster the global industrial economy is ended, the less suffering there will be. Ending this war must be our overriding objective. This means destroying capitalism’s ability to wage war. Anything less is merely whistling on the way to our collective grave.

Fighting a war is dangerous, difficult, and demanding. Sometimes I imagine sitting this war out, becoming a modern conscientious objector, and living simply. But that path isn’t a moral one. Given our current political situation, we must make adult choices. The crisis we face is calling all of us to become revolutionaries.

I wish that my grandfather was still alive so I could sit down with him to discuss all of this. Alzheimer’s disease claimed him before I was fully grown. But I still know that, unlike so many, he would not flinch away from these realities. He would face the truth, think, and decide on the right course of action.

My political stances are extremely unpopular at every level. I have received death threats from racist far-right ideologues. I have been shouted down by the left and the environmental community. And I have been harassed by federal agents. When she heard about the FBI harassment, one of my aunties told me that my grandfather would have been proud of me. She told me that he would have said, “you must be doing something right.”

That is what we must do: what is right.

Questioning Unquestioned Beliefs: What the Lake Erie Bill of Rights Teaches Us

It should be clear to anyone following the events surrounding attempts by the citizens of Toledo, OH, with help from nonprofit law firm the Community Environmental Legal Defense Fund (CELDF), to protect Lake Erie with the Lake Erie Bill of Rights, that the American legal system and all levels of government in their current form exist to protect corporations’ ability to destroy nature in the name of profit and protect those corporations from outraged citizens injured by corporate activities.

In the scorching summer heat of August 2014, nearly half a million people in Toledo, OH were told not to use tap water for drinking, cooking, or bathing for three days because a harmful algae bloom poisoned Lake Erie. Harmful algae blooms on Lake Erie have become a regular phenomenon. They produce microcystin, a dangerous toxin. Microcystin “causes diarrhea, vomiting, and liver-functioning problems, and readily kills dogs and other small animals that drink contaminated water.” The Ohio Environmental Protection Agency reports that mere skin contact with microcystin-laden harmful algae blooms can cause “numbness, and dizziness, nausea…skin irritation or rashes.” Scientists have also discovered that harmful algae blooms produce a neurotoxin, BMAA, that causes neurodegenerative illness, and is associated with an increased risk of ALS, and possibly even Alzheimer’s and Parkinson’s. In 2018, a federal judge found that the principal causes of Lake Erie’s perennial harmful algae blooms are “phosphorus runoff from fertilizer, farmland manure, and, to a lesser extent, industrial sources and sewage treatment plant discharges.”

The Environmental Working Group and Environmental Law and Policy Center report that, not surprisingly, between 2005 and 2018 the number of factory farms in the Maumee river watershed – a river that flows into Lake Erie and boasts the largest drainage area of any Great Lakes river

“exploded from 545 to 775, a 42 percent increase. The number of animals in the watershed more than doubled, from 9 million to 20.4 million. The amount of manure produced and applied to farmland in the watershed swelled from 3.9 million tons each year to 5.5 million tons.”

The groups also state that “[t]he amount of phosphorus added to the watershed from manure increased by a staggering 67 percent between 2005 and 2018.” And, “69 percent of all the phosphorus added to the watershed each year comes from factory farms in Ohio.”

Many Americans believe regulatory laws like the Clean Water Act and regulatory agencies like the United States Environmental Protection Agency (EPA) exist to protect against phenomena like harmful algae blooms. But, Senior US District Court Judge James G. Carr recently described how regulatory laws and agencies have failed to protect Lake Erie. In a 2018 decision in a case brought by the Environmental Law and Policy Center under the Clean Water Act for the failures of the US and Ohio EPAs, Carr described, “Ohio’s long-standing, persistent reluctance and, on occasion, refusal, to comply with the [Clean Water Act].” He also wrote:

“As a result of the State’s inattention to the need, too long manifest, to take effective steps to ensure that Lake Erie (the Lake) will dependably provide clean, healthful water, the risk remains that sometime in the future, upwards of 500,000 Northwest Ohio residents will again, as they did in August 2014, be deprived of clean, safe water for drinking, bathing, and other normal and necessary uses.”

Despite Carr explaining that he “appreciate[s] plaintiffs’ frustration with Ohio’s possible continuation of its inaction,” he ruled that he could not expedite Ohio’s compliance with the Clean Water Act because he could not determine that Ohio had “clearly and unambiguously” abandoned its obligations under the Clean Water Act.

In response to the regulatory framework’s failure to stop harmful algae blooms, on Tuesday, February 26, 2019, citizens in Toledo, OH voted to protect Lake Erie with the Lake Erie Bill of Rights (“LEBOR” or “the Bill”). The Bill “establishes irrevocable rights for the Lake Erie Ecosystem to exist, flourish, and naturally evolve, a right to a healthy environment for the residents of Toledo” and “elevates the rights of the community and its natural environment over powers claimed by certain corporations.”

Toledoans for Safe Water (TSW) is the grassroots coalition of local Toledo citizens who ushered the Bill through Ohio’s constitutional citizen initiative process. Ohio’s citizen initiative process allows citizens to draft and propose laws and to place those laws on a ballot so citizens can directly vote on the law’s enactment. Typically, laws are drafted, proposed, and voted on solely by legislators. Initiative processes like Ohio’s are some of the only avenues American citizens have for directly proposing and enacting laws and providing a direct check and balance on an “out of touch” or corrupt legislature. It is important to understand, however, that, even with citizen initiative processes, it is incredibly difficult to not only democratically enact laws that would actually protect the natural world, but it is incredibly difficult to even place rights of nature laws on the ballot in the first place.

Toledoans for Safe Water’s experience is enlightening. Formed after the harmful algae bloom of August 2014, TSW worked tirelessly to pass an initiative protecting their water source including overcoming efforts by the Lucas County Board of Elections and BP North America to keep such an initiative off the ballot. First, TSW had to gather 5,244 signatures to place LEBOR on the ballot. They far exceeded that total by gathering approximately 10,500 signatures. Despite gathering much more than the necessary signatures, the Lucas County Board of Elections voted against putting the initiative on the November 2018 ballot.

Toledoans for Safe Water members sought an order from the Ohio Supreme Court to put the measure on the ballot, but the Court denied the request in September 2018. Fortunately, in October 2018, in another case involving a different charter initiative, the Ohio Supreme Court ruled that city councils may force county boards of election to place charter amendment initiatives on the ballot. This ruling expressly overruled precedent previously relied on to prevent Toledo citizens from voting on LEBOR. Armed with this new ruling, TSW successfully asked the Toledo City Council to put LEBOR on the ballot. However, in December 2018, a Toledo citizen sought a writ of prohibition from the Ohio Supreme Court to block LEBOR. TSW found themselves in front of the Ohio Supreme Court once again. This time TSW won.

After ensuring LEBOR made it to the ballot, Toledoans for Safe Water had to convince enough voters to vote for the Bill before it could be enacted. In the weeks leading up to the election, BP North America wired $302,000 to the Toledo Coalition for Jobs and Growth, the primary group opposing LEBOR. In the end, TSW spent $7,762 in support of LEBOR, while Toledo Coalition for Jobs and Growth, with the massive donation from BP North America, spent $313, 205 to stop LEBOR. Despite this disparity, LEBOR passed with 61 percent of the 15,000 Toledoans who voted.

But, mere hours after the City of Toledo certified LEBOR’s election results, Drewes Farms Partnership sued the City seeking an injunction against enforcing LEBOR and a court ruling that LEBOR is unconstitutional. Several Toledo city-council members spoke out against the enactment of LEBOR before the election, and it appears that the City will not enforce LEBOR. Yes, you read that correctly: After LEBOR won with 61% of the vote (nearly two-thirds of those who voted), the City of Toledo agreed to an injunction prohibiting them from enforcing the law.

In response to such bald face tactics, we must ask, if a local city government agrees not to enforce the will of its citizens, then what really is left of the notion of a government for and by the people? And the inevitable answer must be, nothing. Indeed, as environmental author Derrick Jensen explains in his book Endgame:

“Surely by now there can be few here who still believe the purpose of government is to protect us from the destructive activities of corporations. At last most of us must understand that the opposite is true: that the primary purpose of government is to protect those who run the economy from the outrage of injured citizens.”

Jensen’s conclusion eerily reflects the very plain statement by Attorney General Richard Olney, who served under President Grover Cleveland in 1894 about the newly-formed Interstate Commerce Commission. The ICC was the very first federal regulatory agency, created to ‘regulate’ the railroad industry, but as Olney (a former railroad attorney, himself) said:

“The Commission…is, or can be, made of great use to the railroads. It satisfies the popular clamor for a government supervision of railroads, at the same time that that supervision is almost entirely nominal. Further, the older such a commission gets to be, the more inclined it will be found to take the business and railroad view of things.”

Nearly 200 years later, Jensen’s observation reflects the reality that not only does our regulatory system not protect the interests of the people of this country; it was never intended to. It was created to protect industry.

And so the parade of horribles that Toledoans for Safe Water have encountered should come as no surprise. A little over two months after the lawsuit was filed by the agriculture industry to strike down LEBOR, the State of Ohio requested, and was granted, the right to intervene to argue with Drewes Farms Partnership that LEBOR should be invalidated. TSW also tried to intervene on behalf of Lake Erie, exercising their new rights under LEBOR and arguing that the City is not an adequate representative of LEBOR. The City neither opposed TSW’s intervention in the case, nor denied that it would be an inadequate representative of LEBOR. Regardless, on Tuesday, May 7, Judge Jack Zouhary, a U.S. District Judge in the Northern District of Ohio, Western Division denied Toledoans for Safe Water’s intervention. Lake Erie and TSW asked the Sixth Circuit Court of Appeals to stay (legalese for postpone) the case while they appealed Zouhary’s denial of their intervention. But, the Sixth Circuit refused to stay the case.

Because Zouhary has denied Toledoans for Safe Water’s intervention and the Sixth Circuit did not grant Lake Erie’s and TSW’s request to stay the case, it will proceed with no one who supports LEBOR present to argue on behalf of Lake Erie or the citizens of Toledo for the remainder of a case that will decide the fate of a law enacted by the citizens of Toledo. To be clear, the City government, popularly assumed to represent the will of the City’s people, is specifically not representing the will of the people.

About an hour after denying Lake Erie and Toledoans for Safe Water’s intervention, Zouhary scheduled a phone conference for Friday, May 17 while ordering the parties to the lawsuit to send him letters regarding a Motion for Judgment on the Pleadings. Typically, parties to a lawsuit file motions and briefs describing their arguments and these motions and briefs become part of the public record so that the public can see why legal decisions are made. In specifically asking for letters, Zouhary shielded Drewes Farms Partnership’s, the State of Ohio’s, and the City of Toledo’s arguments from public scrutiny.  Here we see how the will of the people, expressed through the legislative process, can be effectively silenced by the judicial process. The courts, commonly thought of as a check on abuses of power by the legislative branch of government that encroach on fundamental rights of individuals, have now been unmasked as a vehicle to silence and overturn the will of the people and to legitimize further violations of fundamental rights of the people ­– in this case the simple and essential right to clean water.

And to round out the evidence that we do not live in a democracy, on Thursday, May 9, the Ohio House of Representatives adopted its 2020-2021 budget with provisions that prohibit anyone, including local governments, from enforcing rights of nature laws. The State of Ohio is using its power of preemption – a long-established legal doctrine that defines the relationship of municipal governments to state and federal governments as one of parent to a child – to prevent Ohio residents from protecting the natural world with rights of nature at any time in the future.

This is a perfect example of why CELDF lawyer and executive director Thomas Linzey often states that, “Sustainability itself has been rendered illegal under our system of law.” And:

“Under our system of law, you see, it doesn’t matter how many people mobilize or who we elect – simply because the levers of law can’t be directly exercised by them. And even when they do manage to swing the smallest of those levers, they get swung back (either through the legislature or the courts) by a corporate minority who claimed control over them a long time ago.”

Toledoans for Safe Water swung “the smallest of those levers” and now they have been “swung back” by both the legislature and the courts in favor of the corporate minority. We see then, that under our current system of laws, there is no government actor that validates and protects the will of the people. In the case of Lake Erie, the City of Toledo, the State of Ohio, two levels of federal courts (the District Court for the District of Ohio and the Sixth Circuit Court of Appeals), have all actively undermined the health and welfare and the express political will of the citizens of Toledo – all in the name of preserving and protecting the freedom of agricultural interests to continue polluting Lake Erie for the sake of their own profits.

With it being all but certain that the Lake Erie Bill of Rights will soon be officially invalidated, has Toledoans for Safe Water’s work been in vain?

Not entirely.

“Unquestioned beliefs are the real authorities of a culture,” critic Robert Coombs tells us. Right now, the culture of profit in our country, sanctioned by the legal system is destroying the planet. Informing this dominant culture is a collection of unquestioned beliefs that authorize and allow the massive environmental destruction we currently witness. Stopping the destruction requires changing the dominant culture and changing the dominant culture requires publicly challenging unquestioned beliefs so those unquestioned beliefs are exposed to the light where they can be seen, understood, and condemned.

Perhaps surprisingly, one of the unquestioned beliefs authorizing ecocide is the belief that we live in a democracy and, because we live in a democracy, that our government reflects the will of the governed. This mistaken belief leads to more mistaken beliefs including a belief that the best way to make change is to petition your elected representatives, and if they won’t listen, to elect new ones who will. This misconception includes the further mistaken belief that the American regulatory framework exists to protect the natural world and the humans who depend on Her and that therefore filing lawsuits under the Endangered Species Act, the National Environmental Policy Act, and the Clean Air and Clean Water Acts can stop the destruction of endangered species, our habitat, and the air and water we require.

We should all know the truth, by now. We do not live in a democracy, and our government was never intended to reflect the will of the governed. Our elected representatives only listen to us when the corporations they’re beholden to aren’t telling them what to do. The regulatory framework does not exist primarily to protect the natural world; it exists to issue permits, to give permission, to legalize the harm corporate projects wreak on the natural world, and to make it near impossible for the citizenry to oppose those projects.

Even some of the current government’s most sacred documents, such as the Declaration of Independence, the Ohio State Constitution, as well as many other state constitutions, declare that people have a right to reform, alter, or even abolish the very governments those documents create when those governments fail to reflect the will of the people. The people of Toledo tried to exercise that right by passing LEBOR. Regardless, the very institutions supposedly tasked with honoring these documents are preventing the people from exercising the rights asserted in the Declaration of Independence and protected by the Ohio State Constitution.

We should all know the truth, by now, but most people still don’t. It’s one thing to tell people the truth. And, it’s another to show them. A major question, then, for social and environmental justice advocates is: How do we show people the truth?

One way is through acts of civil disobedience like enacting the Lake Erie Bill of Rights. A primary purpose of civil disobedience is to expose unquestioned beliefs for what they really are. In the case of the regulatory fallacy described above, these unquestioned beliefs serve as propaganda intended to pacify the people. Civil disobedience can stage the truth of our situation for the public to behold. Properly applied, civil disobedience can illuminate unquestioned beliefs and unveil their falsehoods.

CELDF attacks unquestioned beliefs through what it calls “organizing jujitsu.” CELDF helps communities suffering from destructive corporate projects (like fracking, factory farms, and toxic waste storage) ban those projects by passing local laws establishing rights of nature and invalidating judicially-created corporate rights. These laws, however, are currently illegal under American law and are, inevitably, struck down by the courts.

So, why does CELDF keep helping communities pass laws that are almost always struck down? This is where the organizing jujitsu happens. The laws that CELDF helps communities pass are frontal challenges to long-settled legal doctrines. When judges rule against local laws, judges’ rulings can be used as proof of how the structure actually operates. In CELDF’s words:

“Much like using single matches to illuminate a painting in a dark room, enough matches need to be struck simultaneously (and burn long enough) so that the painting can be viewed in its entirety. Each municipality is a match, and each instance of a law being overturned as violative of these legal doctrines is an opportunity for people to see how the structure actually functions. This does the necessary work of penetrating the denial, piercing the illusion of democracy, and removing the blinders that prevent a large majority of people from seeing the reality on the ground.”

With the indicators of ecological collapse constantly intensifying, it is imperative that we penetrate the denial, pierce the illusion of democracy, and remove the blinders that prevent people from seeing reality as quickly as possible. Due to the thoroughness of American indoctrination, the education civil disobedience can provide needs to be supported by real-time commentary that highlights why a specific tactic failed. This real-time commentary will help the public see the truth.

Toledoans for Safe Water has used every legal means at their disposal to protect Lake Erie and, yet, the Lake Erie Bill of Rights is not being enforced and is almost certain to be invalidated in court. Meanwhile, the poisoning of Lake Erie intensifies. Toledoans for Safe Water’s civil disobedience, despite challenging a widespread faith in the American legal system, has failed to physically protect Lake Erie. Breaking this faith is a necessary, but not sufficient, step towards dismantling the dominant culture and replacing it with a new culture rooted in a humble recognition of our dependency on the natural world. For those who see the truth that neither the legal system nor the government will protect us, the question becomes: What are we willing to do to protect ourselves?

A Modern Eco-Sabotage Manifesto

The woman places an arrow on her bow, draws to her cheek, and fires.

The arrow arcs over a high-voltage electrical transmission line, carrying a non-conductive rope. She jogs to her arrow, and begins to reel in the rope. As she pulls it over the lines, a conductive cable is revealed to be attached to its end. As the cable bridges the three-phase power lines, a short-circuit ripples down the lines. Miles away, an aluminum smelter grinds to a halt.

This is the opening of the new film Woman at War from director Benedikt Erlingsson. The film follows a one-woman ecosabotage campaign against the Icelandic aluminum industry.

Whenever I watch a film, especially a film grappling with the ecological crisis, I expect it to disappoint me. Ethan Hawke’s First Reformed, for example, started with a promising premise and then veered into self-flagellation and misogyny.

Woman at War, however, did not disappoint. Halldóra Geirharðsdóttir gives a masterful performance as Halla, a happy middle-aged woman who appears content with her life as a choir director in an Icelandic city. She moves about her life with grace and serenity, riding her bicycle through the streets, swimming in the ocean, and talking with her sister and other friends.

But Halla leads a double life. Her apparently tranquil existence hides her true mission, a campaign against heavy industry that is destroying Iceland. A portrait of Nelson Mandela hangs on her wall at home, a constant reminder that yesterday’s terrorists may become the freedom fighters of history. This is, no doubt, a reference to the ANC sabotage campaigns that Mandela helped to lead in Apartheid South Africa beginning in 1961.

In his testimony when he was sentenced, Mandela describes his reasoning: “I do not deny that I planned sabotage,” he said. “I did not plan it in a spirit of recklessness nor because I have any love of violence. I planned it as a result of a calm and sober assessment of the political situation that had arisen after many years of tyranny, exploitation and oppression of my people by the whites.”

The same reasoning is true for eco-saboteurs today. In the era of climate chaos and government inaction, “extreme” acts like ecosabotage are not extreme at all. They are, in fact, some of the most reasonable responses imaginable.

The argument for sabotage in Woman at War is as undeniably real as the industry it tackles. Iceland’s abundant geothermal energy and hydropower extraction give it very low electricity prices, and has made it a global hot spot for aluminum smelting. The three aluminum smelters in Iceland use a full 73 percent of all electricity generated in the country.

Their power is supplied by geothermal energy harvesting facilities as well as a highly controversial hydroelectric dam that was opposed by environmental and community groups in the courts, via protest, and with direct action and ecosabotage. The smelters themselves are major polluters linked to birth defects, cancer, and bone deformations in nearby communities.

In the film, Halla’s attacks are not spontaneous. Like Mandela, she has obviously conducted a rigorous assessment of the situation. Her actions are meticulously planned. She receives intelligence from a friend high in the Icelandic government. She operates carefully, intelligently, implementing reasonable security precautions while avoiding wholesale paranoia.

At one point, Halla evades her face being recorded by a drone by wearing a Nelson Mandela mask, in an echo of Mandela’s words in his book Long Walk to Freedom: “Living underground requires a seismic psychological shift,” Mandela wrote. “One has to plan every action, however small and seemingly insignificant. Nothing is innocent. Everything is questioned. You cannot be yourself; you must fully inhabit whatever role you have assumed… The key to being underground is to be invisible.”

Like any effective underground figure, she follows the maxim that “Clandestine operational activity must be compartment[aliz]ed, it must be planned, it must be short in duration, and it must be rehearsed (or at least, composed of habitual actions).”

Rebecca Solnit, who has written some wonderful things, critiques Woman at War, writing that “our largest problems won’t be solved by heroes.” But Solnit then lauds Bill McKibben, founder of 350.org, an organization which (like the entire American environmental movement) has failed to stop even the growth of fossil fuel burning. McKibben’s entire approach hinges on a transition to green technology that, as I explain in my forthcoming book Bright Green Lies, has thus far failed to reduce emissions even by a fraction.

In contrast, eco-sabotage groups like MEND (the Movement for the Emancipation of the Niger Delta) have reduced oil output in Nigeria, Africa’s largest producer, by up to 40 percent on a sustained basis.

So which approach is really effective? Show me a country in which mass action has significantly reduced carbon emissions, and perhaps Solnit’s argument would hold more weight. Just two people conducting eco-sabotage against the Dakota Access Pipeline (DAPL) were nearly as effective in slowing the construction as tens of thousands were at Standing Rock. Imagine if a few more people had joined them. And a few more. And more.

As director Benedikt Erlingsson said of Halla in a recent interview, “She’s not a terrorist, she’s not creating terror, she’s not harming people. She’s only sabotaging structures. But she is doing what all fighters have been doing: for non-violent protest to work, it always needs to have an economic fist.”

Petitioning those in power to change things simply isn’t working. To have a chance of planetary survival, we need the most direct of direct actions.

Practically, there are a few lessons to be learned from Woman at War. For example, the film showcases perhaps the high end of effectiveness for a single saboteur. By acting in coordinated groups or securely linked cells, a larger number of people could be more effective. Additionally, the film shows the importance of building a culture of resistance. Halla is saved early on by a nearby farmer who detests the transmission lines and police crisscrossing the land his family has lived on for a thousand years. This element shows the importance of building a support network that can house, feed, transport, and otherwise support underground resistance—and won’t ask too many questions.

There is much to love about this film. Aesthetically, it is beautifully done. The music is superb. The Icelandic tundra, glaciers, rivers, hot springs, and stones are a presence all their own, and Halla inhabits this landscape throughout, repeatedly pressing her face into the thick moss as if into the embrace of a dear friend. She also demonstrates quite clearly that, in an asymmetric struggle, bushcrafts, physical fitness, and wilderness travel skills are a serious advantage for clandestine eco-resistance.

Woman at War bypasses American sexualization, casting a strong female lead acting on her own terms, without a hint of objectification. It even tackles prison well, showing that (to quote Mandela once again) “The challenge for every prisoner, particularly every political prisoner, is how to survive prison intact, how to emerge from prison undiminished, how to conserve and even replenish one’s beliefs.”

Ending a movie like this is hard. In reality, revolutionary work is likely to end with prison time, death, or international exile. But Woman at War closes deftly, in the same way it tackles tricky topics like morality, jobs, and family. Halla visits Ukraine to adopt a young girl, and on her return to the airport, is forced to carry her through a slowly-rising flood that has blocked the road. It is tranquil but daunting slow-moving emergency submerging the entire world. A fitting metaphor, then, for the theme of the entire film.

As I finish writing this review, spring is in full bloom. The birds are singing outside my small cabin in the Oregon woods. But I know that the slow-moving floods of climate change, species extinction, toxification, overpopulation, habitat destruction, and refugees are rising. Year by year, we are slipping into a nightmare. Woman at War is not exactly a template, but it is a great beginning point for a movement that could save us from the worst of what is coming, if only we are ready to listen.

The Legal System Will Not Save the Planet

The problem with putting a price on nature

I love the cover of the New York Times Magazine, by Pablo Delcan, for this week’s big story, “The Problem with Putting a Price on the End of the World.”

The article discusses the challenge with pricing carbon emissions properly so that we use less fossil fuels: because fossil fuels are so fundamental to every aspect of how we live in this modern culture, to price emissions higher means bringing a world of hurt to people who just want to be able to afford a home, or to commute to work, or put the next meal on the table.

The basic problem with pricing carbon as a solution to climate change is not, as the article states (and most people like to claim), that it is a “market failure”.

The problem is that pricing carbon doesn’t address the underlying issue: that our modern culture is inherently unsustainable, no matter how much we pay for the energy to run it.

The article argues that pricing carbon leads to a sluggish economy, which is bad.

No, what’s bad is the economy, period. Our modern economy is based on continual growth. We can’t “fix” the economy; we have to abolish it. Eliminate it. And to do that we need a vision of what is to replace it (and no, not “clean energy”!!) — because without a vision, people just get angry when they can no longer afford the necessities of life.

Unfortunately but unsurprisingly, this article pins hopes for the future on “clean” energy (something that doesn’t actually exist), and a growth economy based on renewables, within the framing of shifting away from fossil fuels not because carbon is expensive, but because renewables are a better, cheaper option, cause less pollution and less carbon, and will create jobs (i.e., basically the same argument as The Green New Deal). This approach simply changes the energy source that runs our unsustainable economy; it doesn’t change the underlying problem: the economy and the way we live our lives because of that economy.

Fighting for the Rights of Southern Resident Orcas

On December 18, 2018, the Center for Biological Diversity and the Wild Fish Conservancy threatened the Trump administration with a lawsuit under the Endangered Species Act (ESA) for allowing salmon fisheries to take too many salmon, which the critically endangered Southern Resident orcas depend on for food.

The impulse to protect the orcas is a good one. Southern Resident orcas are struggling to survive — only 75 remain. According to the statement by the Center for Biological Diversity and Wild Fish Conservancy, “The primary threats to Southern Resident killer whales are starvation from lack of adequate prey (predominantly Chinook salmon), vessel noise …that interferes with … foraging … and toxic contaminants that bioaccumulate in the orcas’ fat.”

You probably assume, when reading that list of primary threats to the orcas, that the threatened lawsuit would demand an end to these harmful activities. But it doesn’t. Instead, the organizations are merely asking the National Marine Fisheries Service — the agency responsible for issuing permits to Pacific coast fisheries — to deal with alleged violations of the ESA.

The Center for Biological Diversity and the Wild Fish Conservancy aren’t asking that activities harmful to Chinook salmon, and consequently to the Southern Resident orcas, be stopped. They aren’t asking for noisy vessels that disturb the whales’ foraging behaviors to be prohibited. They aren’t even asking for an end to the toxic contaminants that accumulate in the whales’ fat.

Why aren’t they asking for any of these things? Because under American law they aren’t allowed to ask for them.

All they are asking is that these harmful activities receive the proper permits.

Right now, laws like the Endangered Species Act are the main legal means for protecting threatened species and habitat in the United States. But these laws only allow us to challenge permit applications and ask that projects complete the permit process.

While it may hard to believe, these permits are designed to give permission to cause harm. Regulatory agencies only regulate the amount of harm that takes place. They do not, and cannot, stop ecocide. Instead they allow for softer, sometimes slower versions of ecocide.

To understand this, it helps to know a bit about how the Endangered Species Act actually works. The Act prohibits any person, including any federal agency, from “taking” an endangered species without proper authorization. “Take” is defined as: “to harass, harm, pursue, hunt, shoot, wound, kill, trap, capture, or collect, or to attempt to engage in any such conduct.”

You might expect that the Act completely prohibits any activity that “takes” an endangered species. But it doesn’t. Under the Act, federal agencies may harm members of an endangered species as long as the activity is “not likely to jeopardize the continued existence of any endangered species.”

While that may sound more promising, it isn’t. When a proposed action is likely to jeopardize an endangered species, the agency can then issue an Incidental Take Statement (ITS), which merely sets a limit on the number of individuals of an endangered species that can be taken.

In other words, a species that has already endured so much destruction can legally be further harmed if that harm is in compliance with certain terms and the correct forms are filled out.

or the resource is land taken from indigenous cultures and from wild animals for colonial settlers to farm….

or the resource is land taken from indigenous cultures and from wild animals for wind farms and solar farms…

or the resource is iron ore, copper, gold, coal, oil, gas, or sand taken from the land, taken from indigenous cultures and the poor for corporations and the rich people who run them…

or the resource is fresh clean water and fresh clean air, taken from us all by corporations to use as the dumping ground for their pollution, as commerce reigns supreme and supreme courts grant corporations more rights than people…

all oppression is related to resource extraction.
