Save Right Whales Coalition Files Supreme Court Brief Challenging BOEM’s Unlawful Offshore Wind Approvals

 

NEW HAMPSHIRE (April 14) — The Save Right Whales Coalition (SRWC) has filed an amicus brief with the U.S. Supreme Court urging the Court to review two cases challenging the Bureau of Ocean Energy Management’s (BOEM) approval of the Vineyard Wind 1 offshore wind project. The brief argues that BOEM unlawfully reinterpreted the Outer Continental Shelf Lands Act (OCSLA) to expand its discretionary authority and bypass statutory protections for ocean users and marine ecosystems.

“Congress imposed clear, enforceable limits on BOEM’s authority,” said Lisa Linowes a spokesperson for SRWC. “Rather than following the law, BOEM reshaped it to serve policy objectives — without public input or congressional approval.”

Key Points from the Amicus Brief:

  • Improper Balancing of Mandatory Protections: BOEM reinterpreted OCSLA § 8(p)(4), which requires the agency to “ensure” compliance with twelve independent statutory safeguards — including protections for navigation, fishing, and the environment — by introducing a balancing framework that treats these protections as negotiable.
  • Textual Revision to Expand Authority: To support this reinterpretation, BOEM also modified a key provision of OCSLA (§ 8(p)(4)(I)) by repositioning a parenthetical phrase (“as determined by the Secretary”) in a way that artificially broadened the agency’s discretion over what qualifies as “reasonable uses” of the outer continental shelf and what level of interference is permissible — a subtle but powerful change that had the effect of rewriting the statute through guidance rather than legislation.
  • Avoidance of Formal Rulemaking: In April 2021, BOEM issued a memorandum setting forth its new interpretation of the statute, which it then applied to approve Vineyard Wind 1 and ten other offshore wind projects. Despite immediately implementing this revised framework, BOEM waited three years to begin the formal rulemaking process required by the Administrative Procedure Act (APA), thereby denying stakeholders the opportunity for notice-and-comment participation.
  • Unlawful Substitution of Compensation for Prevention: Rather than ensuring that offshore development avoids interfering with reasonable ocean uses — as the statute demands — BOEM relied on compensatory mitigation such as developer-funded payments or offsets. The brief argues that this approach replaces legal compliance with after-the-fact financial remedies, in direct conflict with Congress’s mandate to prevent interference. In a January 2025 planning document, BOEM conceded “There are no existing Federal regulations that require compensation for economic loss from displacement attributed to offshore wind energy installations.”

“This is a revealing admission,” said Linowes. “BOEM is approving projects it knows will harm fishermen and other ocean users, while relying on voluntary, developer-funded payments that have no basis in law. Compensation is not prevention — and it’s not a substitute for statutory compliance.”

Why This Case Matters

OCSLA § 8(p)(4) requires BOEM to ensure offshore wind projects comply with multiple statutory safeguards, including protecting existing ocean uses. The APA prohibits agencies from adopting binding rules or new interpretations without public rulemaking. The SRWC brief contends that BOEM’s failure to follow these legal obligations reflects a pattern of administrative overreach, enabled by improper judicial deference.

“If left unchecked BOEM’s conduct would allow agencies to bypass Congress by issuing internal memos and shifting statutory meaning without transparency or accountability,” Linowes said.

What Are the Rights of Nature?

Editor’s notes: “A Washington state city has granted part of the Snohomish River watershed legal rights that can be enforced in court. In nearly all cases, state legislatures heavily lobbied by commercial industries have preempted the laws, rendering them unenforceable. But the Everett initiative could be the first to withstand such a challenge. Democrats, typically more open to stronger environmental protections than Republicans, currently control Washington’s Legislature and governorship.”

Efforts to apply the rights of nature in Ecuador have often failed. Legal challenges can become highly politicised and there is little legal infrastructure beyond general constitutional principles.

For example, in a case brought after road builders had dumped material into the Vilcabamba River, plaintiffs claimed to represent nature in court. However, they were not genuinely advocating for the river’s rights – their main concern was protecting their downstream property.

An ecocentric perspective

Ultimately, defending the rights of nature in court will be a struggle if the nature in question – the river, forest or lake – is not represented by someone with an ecocentric perspective. That means prioritising the intrinsic value of nature itself, rather than focusing on how it can serve human interests.

“According to the third Kawa, the people and the river are intrinsically linked, so Te Awa Tupua isn’t merely the river but also includes the surrounding communities — which challenges Western notions of property and human-made law. The relationship between the Iwi and the river goes beyond mere geographical proximity and includes spiritual and affective care for each other.”

Biodiversity is declining at rates unprecedented in human history. This suggests the ways we currently use to manage our natural environment are failing.

One emerging concept focuses on giving legal rights to nature.

Many Indigenous peoples have long emphasised the intrinsic value of nature. In 1972, the late University of Southern California law professor Christopher Stone proposed what then seemed like a whimsical idea: to vest legal rights in natural objects to allow a shift from an anthropocentric to an intrinsic worldview.

“Rights of nature” is a movement aimed at advancing the understanding that ecosystems, wildlife and the Earth are living beings with inherent rights to exist, evolve and regenerate.

Legal rights are the highest form of protection in most governance systems. In the United States, humans and non-humans have enforceable legal rights, like corporations’ right to freedom of speech.

At the same time, most legal systems treat nature as rightless property that humans can own, use and destroy. That means the law views sentient species like elephants and bald eagles, as well as life-supporting ecosystems like forests and coral reefs, no differently than objects like microwaves or cars.

For the people behind the rights of nature movement, that way of thinking is deeply flawed. It’s also scientifically inaccurate.

Humans are part of nature and depend on ecosystems for survival—from the food we eat to the water we drink and air we breathe. Evolutionary biology shows that humans share a common ancestor with all other life on Earth. Forests, rivers and other biomes provide conditions for human life to thrive. And humans have always shaped the environment and have been shaped by it.

Understanding this interconnectedness is key to understanding that human flourishing ultimately depends on a healthy Earth. Rights of nature activists say most societies have forgotten that basic truth, harming their own wellbeing—and threatening their very survival—as a result.

When did this forgetting happen? Academics have traced the notion that humans are separate from, and superior to, nature back to Renaissance-era thinkers like René Descartes, who compared animals to machines. The idea is also woven into the Bible’s book of Genesis, with God giving man “dominion” over the Earth. Others point to the advent of cities, when masses of people lost regular contact with nature.

Modern legal systems have been shaped by these developments and ideas, thus institutionalizing the belief that nature is an object, or thing, beneath humans.

“Until the rightless thing receives its rights, we cannot see it as anything but a thing for the use of ‘us’—those who are holding rights at the time,” law professor Christopher Stone wrote in the seminal 1972 law review article, “Should Trees Have Standing?” Stone noted that the law has always evolved to extend rights to new groups: moving from white, property-owning men to include women, people of color and children.

In 2006, a rural, conservative Pennsylvania town plagued by industrial pollution enacted the world’s first rights of nature resolution. Since then, scores of countries—including Ecuador, Spain, Bolivia, Colombia, Panama, India, the United States and Uganda—have had court rulings or enacted laws at the national or subnational level recognizing nature’s rights.

The advocates behind these laws argue that if nature’s rights are respected, humans will benefit.

How Do Rights of Nature Laws Differ From Environmental Regulations?

In the course of human history, environmental law is a relatively young field. In the United States, it largely developed in the late 1960s in response to mass pollution wrought by industrialization. Rivers caught fire, pervasive smog blanketed cities and chemicals like DDT were sprayed indiscriminately.

Policymakers enacted legislation like the Clean Water Act and Toxic Substances Control Act to regulate human activity and limit impacts of industry on human health. Those laws did curtail pollution. But rights of nature advocates argue that those conventional laws haven’t stopped the severe environmental problems we face today, like climate change, biodiversity loss and mass pollution.

Advocates say conventional environmental laws have a central flaw: They’re designed to permit pollution. They only control how much.

Rights of nature laws start from an entirely different place. Ecosystems, wildlife and Earth itself are treated as living beings with inherent rights deserving of the highest form of legal protection. The central concern of rights of nature laws is to maintain and preserve the integrity of ecosystems, requiring governments to take a preventative, rather than a reactionary, approach.

Ecuador’s Constitutional Court has said this mandates government officials to respect what is known as the “precautionary principle,” or the idea that, absent adequate scientific evidence, it is better to avoid certain risks that could lead to irreversible damage of ecosystems.

How Do These Laws Work in Practice? 

The laws do not give nature’s rights absolute primacy over all other rights and interests.

No legal right is absolute. A right to free speech ends when that speech is defamatory or incites violence. Judges balance competing rights in the decisions they make every day. Nature’s rights are no different.

Rights of nature jurisprudence is still a young field. Most countries with such laws on the books haven’t had lawsuits attempting to enforce them. It’s also important to note that not all rights of nature laws are the same—there is wide variation in how the laws are written and what rights are recognized.

But Ecuador, which constitutionalized nature’s rights in 2008, has seen dozens of cases. There, Mother Earth, or Pachamama, has a right to “integral respect for its existence and for the maintenance and regeneration of its life cycles, structure, functions, and evolutionary processes.”

The Ecuadorian Constitution also requires the government to prevent the “extinction of species, the destruction of ecosystems, and the permanent alteration of natural cycles.”

Not all cases have been favorable for ecosystems. Ecuador’s economy is still largely dependent on oil revenues and other extractive industries.

But Ecuadorian courts have ruled in favor of mangroves, cloud forests, rivers, endangered frogs and coastal marine ecosystems, thwarting mining operations, industrial fishing and other nature-damaging activities. In some cases, courts have ordered the government to restore damaged ecosystems. Cases decided in favor of nature usually have a compelling reason for why nature’s rights ought to prevail over competing interests, like a high risk of extinction for certain species.

In the cloud forest case, the Ecuadorian Constitutional Court explained the importance of protecting a sensitive ecosystem from mining impacts, saying: “[T]he risk in this case is not necessarily related to human beings … but to the extinction of species, the destruction of ecosystems or the permanent alteration of natural cycles.”

In deciding these cases, Ecuadorian courts have depended heavily on scientific experts and evidence. Judges have also looked holistically at the health of ecosystems, rather than at piecemeal levels of pollution—a departure from the way courts tend to evaluate conventional environmental laws.

Scientists have come to the forefront of the movement in other ways. In Panama, for instance, marine biologists were instrumental in the passage of that country’s national rights of nature law.

How Are Rights of Nature Laws Enforced?

Trees and wild animals can’t walk into a courtroom and make their case. But rights of nature laws give ecosystems and species the ability to act in their own capacity under the law with help from people, similar to other non-human entities like corporations, business partnerships, ships and nonprofits.

This is done through a longstanding concept called legal personhood. That legal construct is most commonly used to allow businesses to enter into contracts, sue, be sued, own property and, in the case of corporations, limit the liability of its shareholders.

Each of those nonhuman entities is represented by a human guardian. Similar arrangements are used for minors and incapacitated people in court proceedings.

Who Is Behind This Movement? 

Indigenous peoples have been at the forefront of the movement in several ways.

The worldviews of many Indigenous cultures—that humans are part of nature and owe responsibilities to other living beings—are foundational for the movement.

Honoring and preserving those worldviews and related knowledge for centuries has been no small thing. Indigenous communities have faced a long, dark history of colonization and other attempts aimed at eradicating their culture and separating them from their territories. Today, people in many Indigenous communities are still harassed, attacked and sometimes killed for defending water and land.

Indigenous peoples have also been behind many of the laws and court rulings advancing the movement. In New Zealand, Māori people fought for a settlement with the national government, resulting in legal personhood for a river, national park and mountains.

It was Ecuador’s strong Indigenous movements that led to the country becoming the first in the world in 2008 to constitutionally recognize Mother Earth’s rights. Ecuador’s Constitutional Court has also drawn on Indigenous knowledge in deciding rights of nature cases.

Bolivia’s Indigenous movements were behind that country’s 2010 and 2012 laws recognizing the rights of Mother Earth. Enforcement of nature’s rights in Bolivia has proved difficult, however.

Across North America, many Indigenous nations have passed rights of nature laws.

And in Peru, a coalition of Indigenous women won rights for the Marañón River ecosystem, a place the oil industry has heavily polluted for decades. The fight for the Marañón River came at great personal cost for Mariluz Canaquiri Murayari, president of Huaynakana Kamatahuara Kana, and other women in the organization, who were harassed and threatened for their advocacy.

What Are the Criticisms of Rights of Nature Laws?

The biggest opposition to the movement has come from industry groups—developers, the industrial agricultural sector and other polluting industries—and politicians aligned with those interests.

Those opponents argue that giving nature a higher level of protection will impede development and lead to an explosion of litigation. In practice, that hasn’t happened. Barriers to pursuing lawsuits, like the high cost of attorney fees, are substantial.

But the laws do threaten the interests of industries and businesses that have made money off extracting from and monetizing the natural world in unsustainable ways.

Some critics of the movement have questioned whether, if nature has rights, it also has duties: Can a river be sued if it floods and harms humans? Rights of nature advocates respond to this by saying that legal rights, duties and liability are always tailored to the entity they are assigned to.

Corporations, for instance, don’t have a right to family. Nature doesn’t have the capacity to act with intent and therefore should not have legal liability for harm it causes, advocates argue.

Another prevalent charge is that the rights of nature movement is an attempt to force human societies to surrender modern comforts and technology. In practice, though, advocates have sought to rebalance human interests with the health of ecosystems by placing better guardrails around human activity, ensuring the integrity and sustainability of Earth is maintained now and into the future. Advocates argue that humanity isn’t harmed by that but benefits instead.

They also say nothing so quickly forces people to surrender modern comforts as a disaster that destroys their homes and communities, and megadisasters are far more common in a warming world.

Is the Rights of Nature Just a Legal Movement?

No. Beyond the legal realm, the movement has seeped into mainstream culture, religious discourse, the arts, corporate governance, education and cultural revival.

Pope Francis’ encyclical Laudato Si’, and papal exhortation Laudate Deum, said humans have a moral duty to protect the Earth.

“For ‘we are part of nature, included in it and thus in constant interaction with it,’” Francis wrote in Laudate Deum.

Ecuadorian activists say the country’s constitutional recognition of nature’s rights has made their country more pluralistic by incorporating the worldviews of Indigenous peoples and is changing the way everyday people think about the Earth, their home.

“We now have a whole generation of young people who have grown up only knowing that nature has rights,” Ecuadorian political scientist Natalia Greene told Inside Climate News. “The law has influenced peoples’ understanding of nature and that is very powerful.”

Butterflies Declined by 22% in Just 2 Decades Across the US

A study in the United States found a dramatic 22% decline in butterfly populations between 2000 and 2020.

Previous research has focused on a specific butterfly species or regions of the country. For this study, researchers wanted to understand overall butterfly population trends across the U.S.

They gathered records of 12.6 million individual butterflies across 554 species, from more than 76,000 surveys, many conducted by citizen science groups in nearly 2,500 locations.

The researchers found that total butterfly numbers were down by 22% over the first two decades of this century. It’s a concerning trend, said Collin Edwards, lead author of the study and an ecological modeler with the state of Washington Fish and Wildlife Department.

To put it in context, “for someone who was born in 2000, one out of every five butterflies had disappeared by the time they became an adult,” Edwards told Mongabay by phone.

The 22% decline is an average. Of the 554 species examined, 107 declined by at least 50% and 22 species declined by more than 90%.

At the same time, nine species saw population increases. The eastern population of the monarch (Danaus plexippus) doubled in 2025, though its overall population is still down roughly 80%, prompting the iconic butterfly to be proposed for the U.S. endangered species list.

Several of the nine species that increased in population are predominantly found in Mexico; the U.S. is the northern edge of their range. Edwards said with a warming climate, many butterfly species are shifting their habitats north.

“If the southern edge of their limit is just barely cold enough for them, as the climate warms, that’ll get worse. But the northern edge where it used to be a little bit too cold will start to get warm enough,” Edwards said.

This study adds to a growing body of research showing a global decline in insect populations, raising concerns about a depleting food source for many animals including birds and frogs, which are facing population crashes in their own right.

Furthermore, while bees get most of the glory, butterflies are also critical pollinators. A 2021 study in Texas found butterflies provide about $120 million per year in pollination services for cotton.

Tierra Curry, a senior scientist with the Center for Biological Diversity, told Mongabay by email that “this is a landmark study” that “shows that we need to take urgent action to safeguard butterflies. Every action we take to help pollinators also helps us because our fate is directly tied to their health.” Curry wasn’t involved with this research.

Edwards said this study focused on butterflies because that’s the order of insects they had data for, but he added there’s “every reason to think that if butterflies are declining there are probably similar declines in other groups of insects,” especially since the drivers of decline — habitat loss, climate change and pesticides — affect most insects.

On December 14th 1982, a blockade was launched to stop the construction of a hydroelectric dam that would have flooded Tasmania’s Franklin and Gordon rivers and surrounding old-growth forests. Over the next 3 months, over 1,340 people were arrested for trespassing, occupying roads and work sites, and chaining themselves to equipment. The protest gained widespread national and global support and played a major role in the cancellation of the project.

In 1976, the Hydro Electric Commission of Tasmania solidified their plans with the Australian government to build a dam across the Franklin and Gordon Rivers, in the Franklin-Gordon Wild Rivers National Park. The Tasmanian Wilderness Society formed not long after this announcement to take action against the Hydro Electric Commission and their plans to bulldoze the surrounding wilderness for the construction of the dam. The director of the Wilderness Society and leader of the anti-dam campaign for the following seven years was Bob Brown, a local environmentalist and general practitioner.

From 1976 through 1981, the Tasmanian Wilderness Society focused on creating awareness and education through public meetings, pamphlets, and tours of the Franklin River.  They focused heavily on the danger to endangered species and ancient rain forests that flooding would have as a result of the Hydro Electric dam being built.

In 1981, the discovery of ancient aboriginal paintings in caves of the lower Franklin River region ignited the controversy. The caves were filled with not only Aboriginal paintings, but campfires, tools and animal bones that dated back thousands of years. This discovery created an even larger debate over the construction of the dam, bringing it into the political sphere, as Australia was nearing both state and federal elections. Candidates chose a side of the issue to include in their platform. Throughout their actions, the Tasmanian Wilderness Society maintained pressure to urge politicians to take a definite stance on the Franklin Dam issue.

The Tasmanian state government announced plans to hold a referendum to engage citizens in the Hydro Electric Commission’s decision. The Wilderness Society asked that a “NO DAMS” option be included in the referendum.  In the lead-up to the referendum, the campaigners distributed yellow, triangular “NO DAMS” stickers.  The Tasmanian government announced that the referendum would have two options, both of which took the construction of the dam as given.  The two options only differed by location: Gordon Below Franklin and Gordon above Olga.  The Wilderness Society encouraged voters to take part in a “Write-in”, by writing “NO DAMS” on their ballot in protest.  When the government held the referendum on 12 December 1981, 33% of the voters wrote “NO DAMS” on their ballots.

Although federally the Australian Labour Party was quite popular in their anti-dam platform, pro-dam political parties were more popular in the Tasmanian state.  In May 1982, the Liberal party under Robin Gray (a pro-dam politician) won the majority of seats in Tasmania and Gray became the Premier. Upon his election, he announced plans to begin construction. The dam itself was to cover 33 kilometers of the Franklin River and 37 kilometers of the Gordon River.

In response to this decision, in August and September, Bob Brown went on tour screening films of the Franklin River to raise support and awareness.  Brown and the Wilderness Society also organized rallies to gain the attention of influential political figures. During a Melbourne rally, David Bellamy, a British botanist and T.V. presenter toured expressed their anti-dam positions to the 5,000 participants.  The goal of this portion of the campaign was to increase pressure on the Prime Minister Malcolm Fraser to intervene through Tasmanian State government and stop the dam. Fraser did not intervene and override the state legislation, as he believed it was a state government issue
and not a federal one.

In November 1982, 14,000 people converged on the streets of Melbourne for another rally.  Bob Brown announced that they would blockade the construction of the dam site beginning on 14 December 1982.

On 14 December 1982, 2,500 people converged at the dam site to participate in the blockade.  Protesters made a human chain through the forest to prevent construction workers from entering the site.  Protesters also blockaded by water on canoes, to prevent police from bringing machinery into the site by a barge. These blockaders maintained morale and enthusiasm through the use of song. Protesters developed songs over the course of the campaign that were regularly sung during rallies, marches, in jail, and at the blockade site. Folk singer Shane Howard wrote the official anthem of the campaign, titled “Let the Franklin Flow”. During the course of the blockade, police arrested 1,440 people. David Bellamy and Claudio Alcorso (a Hobart Millionaire) participated in the blockade and were arrested.

On 1 March 1983, the Wilderness Society held a day of action during which 231 people were arrested in their boats on the Gordon River and the Wilderness Society’s flag was flown above the Hydro Electric Commission building in Hobart, Australia.

The Tasmanian Wilderness Society drew further attention on 2 March 1983 by printing full-page colour photographs in Australian newspapers of the Franklin River area. The captions on these publications read, “Could you vote for a party that would destroy this?” This was an attention-grabbing act as few publications used colour at the time.

On 5 March 1983, the Australian Labour Party under new Prime Minister, Bob Hawke (who maintained an anti-dam platform) won the federal election and announced that he
would halt the dam construction. The Australian Labour Party introduced regulations under the National Parks and Wildlife Conservation Act 1975.  Additionally, Hawke declared the Franklin River area a World Heritage site, outlawing the dam under the World Heritage Properties Conservation Act 1983.

The Tasmanian state ignored the new regulations, as they believed that the federal government could not legally intervene in this state-level issue. The company contracted by the Tasmanian government continued clearing the site until the federal government brought the Tasmanian government to High Court on 31 May 1983. On 1 July 1983, the High Court ruled in favour of the federal government and proclaimed that they could legally enforce the international standards for a World Heritage Site on a state government.

The Franklin River campaign was so successful that it largely ended the generation of electricity through hydro dams in Australia. The federal government demanded that the Tasmanian government give a compensation package of $270 million to the Wilderness Society.

Today’s cheerleaders for increased birth rates are well aware of the silent cause of the ongoing rapid decline in male sperm counts. It’s the very industries these corporate managers run and governments regulate that is the blame. So you can be almost 100 percent sure that they are not going to address the real problem in order to achieve the goal of increasing human birth rates.

Bottlenose dolphins leapt and torpedoed through the shallow turquoise waters off Florida’s Sarasota Bay. Then, a research team moved in, quickly corralling the small pod in a large net.

With the speed of a race car pit crew, veterinarians, biologists and their assistants examined the animals, checking vital signs while taking skin, blood and other samples. They held a petri dish over each dolphin’s blowhole until it exhaled, with an intensity similar to a human cough. Then, they rolled up the net and the dolphins swam off unharmed. A pod in Louisiana’s Barataria Bay was similarly tested.

Generations of dolphins have been part of this ongoing dolphin health study, which has been run by the Sarasota Dolphin Research Program since 1970. It tracks populations and individuals and also looks for health issues related to pollutants in the marine environment.

In the lab, scientists discovered that all 11 of the dolphins had breathed out microplastic fibers, shed from synthetic clothing, says Leslie B. Hart, associate professor at the College of Charleston and an author on this research. The fibers resembled those found in human lungs in previous studies, proving that dolphins, like us, are breathing plastic. In people, microplastic has been linked to poor lung function and possible lung disease.

An earlier collaboration linked phthalates circulating in the dolphins’ blood to alterations in their thyroid hormone levels — an effect also found in humans that can impact nearly every organ in the body. Phthalates, toxic chemicals found in flexible plastics, readily leach into the environment. The full effects on marine mammals remain unknown.

The dolphin studies are part of a larger quest to understand how plastic pollution is impacting the world’s wildlife. While thousands of human studies have demonstrated damage from tiny plastic particles entering both cells and organs throughout the body, little is known about animal impacts because long-term field studies are difficult and costly. “We’re really just starting to skim the surface,” Hart says.

Beyond the threat plastics pose to individual animals and species, other researchers have detected broader, global harm, a new report warns. Plastic pollution is transforming Earth systems needed to support life, worsening climate change, increasing biodiversity loss, making oceans more acidic and more.

The plastics crisis is escalating rapidly: Each year, petrochemical manufacturers make more than 500 million tons of plastics –– but the world recycles just 9%. The rest is burned, landfilled or ends up in rivers, rainwater, the air, soil or the sea. Today, the planet is awash in plastic. “It’s everywhere. It’s pervasive and it’s persistent,” says Andrew Wargo, who focuses on ecosystem health at the Virginia Institute of Marine Science.

Since the 1930s the polymers industry has completely altered daily life: Plastics are in our homes, cars, clothes, furniture, and electronics, as well as our single-use throwaway water bottles, food packaging and takeout containers.

In 2022, the U.N. Environment Assembly voted to address the plastic crisis by creating a legally binding international plastics treaty in hope of curbing and regulating production. But plastics-producing nations, including China, Russia, Saudi Arabia, Iran and the U.S. resisted progress, influenced by a $712 billion plastics and petrochemicals industry and its lobbyists.

A critically important fifth round of negotiations begins Nov. 25 when delegates hope to hammer out final treaty language for ratification by U.N. member states.

Meanwhile, the natural world is in great danger, threatened by a biodiversity crisis, a climate crisis and serious degradations of planetary systems. Researchers are now scrambling to understand the growing threat plastics pose to the health of all living organisms.

Plastics conquer the world

Bakelite, the first synthetic plastic product ever made, came on the market in 1907. By the 1950s, production ramped up, changing the course of history and revolutionizing modern life. Plastics facilitated innumerable human innovations — and spawned a throwaway culture. Add in poorly regulated petrochemical manufacturing processes and industrial fishing’s plastic gear, and global plastic pollution stats soared.

People have now produced some 11 billion metric tons of plastic. Globally, we discard 400 million tons of plastic waste every year; without controls imposed on overproduction, that may reach 1.1 billion tons within the next 25 years.

It can take 500-1,000 years for plastic to break down, and scientists are beginning to question whether it ever fully degrades. Today, 50-75 trillion microplastic particles litter the seas, according to a United Nations estimate, 500 times more than all the stars in our Milky Way galaxy. Microscopic life in the ocean has been dubbed “the Plastisphere,” with early research finding that even phytoplankton, the food-web base vital to marine ecosystems, is under threat.

Plastic debris was first noticed in the oceans in the early 1960s. For a long time, ecologists’ main wildlife concerns focused on the threat to sea turtles and other marine creatures that ate plastic bags or became tangled in plastic fishing nets. Now, everything from zooplankton to sharks and seabirds eat it and are exposed to it.

Hart emphasizes the problem’s global scope: “Plastic pollution has been found on every continent and in every ocean, in people, terrestrial wildlife and marine wildlife.” It contaminates creatures across the tree of life and concentrates up the food chain, threatening

every living thing, from insects, rodents, rhinos and frogs to clams, whales, snakes, wildcats and a host of migratory animals. Carried to the poles on wind and tide, even Arctic foxes and penguins carry microplastics.

Insidious plastic harm to health

It’s well known that animals regularly mistake plastic debris for food. Shearwaters and other seabirds, for example, can choke and starve when plastic pieces block their digestive tracts or pierce internal organs. At least 1,565 species are known to ingest plastic. For decades, scientists have noted dead animals ensnared in plastic nets, fishing gear or six-pack rings.

But those big pieces of petrochemical plastic (along with their chemical additives) don’t decompose; they degrade into ever-smaller pieces, getting smaller and smaller. Eventually, they break down into microplastics, tiny particles no bigger than a grain of sand, or become nanoparticles, visible only under a high-powered microscope. These microplastics can leach toxic chemicals. Of the more than 13,000 chemicals currently used in plastics, at least 3,200 have one or more “hazardous properties of concern,” according to a U.N. report.

Most of what we know today about the health impacts of plastics and their chemical additives is based on human medical research, which may offer clues to what happens to animals; that’s unlike most health research, which is done on animals and extrapolated to people.

We know from human medical research that microplastics can damage cells and organs and alter hormones that influence their function. Plastic particles have crossed the blood-brain barrier. They have lodged in human bone marrow, testicles, the liver, kidneys and essentially every other part of the body. They enter the placenta, blood and breast milk. Exposure may affect behavior and lower immunity.

And what plastics do to us, they likely do to animals. The phthalates found in Florida dolphins, for example, along with phenols, parabens and per- and polyfluoroalkyls, are just a fraction of the many endocrine disruptors released by plastics and their chemical additives that can alter hormone levels and derail body functions. Exposure may affect behavior and lower immunity.

Doctors have confirmed links between plastic and human disease and disability. “They cause premature birth, low birth weight, and stillbirth as well as leukemia, lymphoma, brain cancer, liver cancer, heart disease and stroke,” Phil Landrigan, a pediatrician and environmental health expert stated in a press conference earlier this year.

Endocrine-disrupting chemicals can also interfere with reproduction in humans: They’re partially responsible for sperm counts that dropped to one-seventh of 1940s levels. These chemicals can also damage the placenta and ovaries. Experts think this is likely happening in animals, too, raising serious concern for endangered species already in decline.

In the wild, animals are now exposed daily to microplastics, eating and breathing them, while many freshwater and marine species swim in a plastic soup. But little is known about the long-term impacts of chronic exposure or what microplastics do within animal tissues, with even less understood about what happens when microplastics shrink to nano size and easily enter cells.

There are some data: Oysters produce fewer eggs. Pregnant zebrafish can pass nano-polystyrene to their embryos, while other research showed plastic exposure slowed fish larvae growth rates. Seabirds, including shearwaters, develop “plasticosis,” a newly declared disease characterized by thick scarring in the stomach due to plastic ingestion, which inhibits digestion. Microplastics also damage the heart structure of birds and permeate the liver, muscle and intestines in cod.

In lab experiments, microplastics in the lungs of pregnant rats easily passed to their fetuses’ brains, hearts and other organs. In adult mice, plastic nanoparticles crossed the blood-brain barrier, triggering swift changes that resembled dementia. In a wild animal, cognitive decline can quickly prove fatal, making it difficult to find food, avoid predators, mate or raise young.

In the lab, fish were more susceptible to a common virus after a one-month exposure to microplastic. They then shed more virus (a fish public health problem) and died in high numbers. Surprisingly, “there’s a lot of similarities between fish and humans, so that we have a lot of the same immune pathways,” explains Wargo, an author on this study. However, the reaction depended on the type of plastic. Nylon fibers had the biggest effect; most nylon sheds from synthetic clothing.

One challenge to researching health impacts, Wargo explains, is that “plastics oftentimes are lumped into one category, but they’re [all] very different: their structure, chemical composition, their shape and size,” creating thousands of variations. These factors influence how toxic they are, he says, which likely varies between individual animals and different species. Investigation is further complicated and obstructed by petrochemical companies that zealously guard their proprietary polymer product formulas.

The ubiquity of plastics and their global presence means that polymers likely have many undetected and unstudied wildlife health impacts. Some impacts could be masked by other environmental stressors, and untangling and analyzing the particulars will likely take decades.

What we do know is that the poor health, decline or disappearance of a single species within a natural community ripples outward, affecting others, and damaging interconnected ecological systems that have evolved in synchrony over millennia. Here’s just one speculative concern: We know microplastics can bioaccumulate, so apex predators, which balance ecosystems by keeping prey species in check, may be at high risk because they consume and build up large concentrations of microplastics and additive chemicals in their organs.

Plastics harm wildlife –– and humans –– in additional ways: by polluting the air and contributing to climate extremes. Currently, about 19% of plastic waste is incinerated, releasing potentially harmful chemical aerosols into the air. In addition, plastic production sends 232 million metric tons of greenhouse gases into the atmosphere yearly. Then there’s the pollution and carbon released from fracking and drilling operations to source the oil and gas to make these products.

Lastly, the microplastics animals and humans ingest are “Trojan horses.” These tiny particles absorb and carry a wide range of pollutants and bacteria, which then can enter and lodge within our bodies.

Stanching ‘a global-scale deluge of plastic waste’

Climate change and the plastics crisis spring from the same source: The world’s seven largest plastic manufacturers are fossil fuel companies. The U.S. produces the most plastic waste of any country, more than the entire EU combined: 42 million metric tons annually, or 287 pounds per person, according to a 2022 congressional report. It noted that “The success of the 20th-century miracle invention of plastics has also produced a global-scale deluge of plastic waste seemingly everywhere we look.”

Consumers can take small actions to protect themselves and limit plastic pollution by avoiding single-use plastics and carrying reusable bags and stainless-steel water bottles. Disposable fast-food packaging makes up almost half of plastic garbage in the ocean, so cutting back on takeout and bottled water could help.

But realistically addressing the planet’s plastics emergency requires a global paradigm shift that reframes the discussion. Many nations still think of plastics as a waste management issue, but responsibility needs to fall on the shoulders of regulators — and the producers, specifically fossil fuel companies and petrochemical manufacturers.

An international consortium of scientists has stressed the need for “urgent action” in the run-up to this month’s United Nations plastics treaty negotiations, the fifth and hopefully final summit intended to establish international regulations.

The U.S. had been among the largest, most influential dissenters in efforts to limit global plastics production and identify hazardous chemicals used in plastics. But in August 2024, prior to the U.S. presidential election, the Biden administration publicly announced it had toughened its position, supporting production limits, but submitted no position paper. Then, this week it returned to its earlier stance that would protect the plastics industry from production caps.

The plastics treaty summit in Busan, South Korea, beginning Nov. 25 and ending Dec. 1, aims to finalize treaty language that will then need to be ratified by the world’s nations. Regardless of the summit’s outcome, scientists continue to uncover new evidence of plastic’s dangers to humans, animals and the planet, raising the alarm and need for action.
