Greenland’s government bans oil drilling, leads indigenous resistance to extractive capitalism

In 2016, Greenland’s then minister responsible for economic development, Vittus Qujaukitsoq, welcomed the appointment of Rex Tillerson, the former CEO of Exxon Mobil, as US secretary of state. Despite representing the centre-Left party Siumut (Forward) and being surrounded by some of the most visible consequences of the warming world, Qujaukitsoq and his colleagues saw the growing potential for mining and drilling brought by the melting glaciers on the world’s biggest island as an opportunity to bring in the cash which would allow the long-desired independence from Denmark.

They aren’t alone. While the melting of Arctic ice is causing the world’s oceans to overflow and disrupting its weather systems, it has also unleashed a whole new geopolitical race. Earlier this year, the US Geological Survey estimated that the region’s rocks contain 13% of the world’s undiscovered oil, and 30% of undiscovered gas – carbon sinks which have been greedily eyed up by states and oil companies alike. And many of these reserves lie in the seas west of Greenland – where there are an estimated 17.5 billion undiscovered barrels of oil, enough to supply the whole planet for six months, at current usage rates.

And because the Arctic is the fastest warming part of the planet, the ice shielding these prehistoric deposits from prying drills is thinning, and disappearing, at an alarming rate.

But if some see this as an opportunity, others understand the absurdity of using climate change as a means to extract more fossil fuels and further change the climate. And this, alongside broader questions about mining, have shaped politics in the country this year.

In the spring, the governing Siumut party split, and its liberal coalition partners, the Democrats, resigned from the government, triggering a snap election in May.

The winner was the eco-socialist party Inuit Ataqatigiit. And in June, the new government banned all future oil and gas exploration from Greenland’s territory.

“The price of oil extraction is too high. This is based upon economic calculations, but considerations of the impact on climate and the environment also play a central role in the decision,” the government stated in July.

It’s not just oil and gas drilling that are contentious. When Donald Trump notoriously inquired about purchasing the island in 2019, he’d just had a briefing on its deposits of a number of minerals, many of which are likely to play a crucial role in the geopolitics of the coming decades. Among these are large quantities of uranium, and what are thought to be the world’s second biggest reserves of rare earth minerals – demand for which has soared in recent years because of their use in batteries for electric cars, computer chips and other tools of the high tech, low carbon economy.

Seen that way, Trump’s statement was probably less a random outburst and more a crude expression of the reality of Greenland’s role in the future of global geopolitics.

Biden, as ever, works in more subtle ways. In February, in discussion with tech giants like Alphabet (Google) and Facebook, he signed an executive order instigating a review of the supply chain of rare earth metals due to a global shortage and China’s dominance of the market. It seems implausible that the review won’t have produced significant discussion in US intelligence circles about the world’s largest deposits outside China, just a few hundred miles from Maine.

In March, the Polar Research and Policy Initiative expressed concerns about “the security implications of China’s near monopoly of rare earths and other minerals for the UK and its North American, European and Pacific allies”, especially given their significance to “strategically important sectors such as defence and security, green energy and technology”. The think tank called on the ‘five eyes’ intelligence alliance between the US, UK, Australia, New Zealand and Canada to team up with Greenland as part of a strategic resources partnership.

Greenland, says the website Mining Technology, “could be vital for tipping the scales in a trade war between global superpowers”.

In the midst of this global gallop for Greenland, with the world’s major powers, billionaire investors and intelligence agencies getting in on the act, the country has had some coverage in the global media of late.

What is often left out of the conversation, however, is the fascinating domestic dynamics among this Arctic island’s 57,000 people. Greenlanders’ struggle for sovereignty in the context of global capitalism, extractivism and climate collapse is an inspiring example of 21st-century indigenous resistance.

A young socialist indigenous climate leader

“There are two issues that have been important in this election campaign: people’s living conditions is one. And then there is our health and the environment,” Inuit Ataqatigiit leader Múte Bourup Egede told the Greenlandic public broadcaster KNR following his election victory in April.

Egede, 34, is the youngest prime minister Greenland’s had since it achieved a degree of home rule in the 1970s, and has led the democratic socialist and pro-independence party since 2018.

In the recent election, the party, known as IA, centred its campaign on its opposition to an international mining project by Greenland Minerals, an Australian-based and Chinese-owned company that is seeking to extract uranium and neodymium from the Kvanefjeld mine in the south of the country. Neodymium is a crucial component of a broad range of technologies, from some kinds of wind turbine to electric cars, because it can be used to make small, lightweight, but powerful and permanent magnets, while uranium is used for both nuclear power and nuclear weapons.

“We must listen to the voters who are worried. We say no to uranium mining,” Egede told the KNR. His party also promised to ban all explorations of radioactive deposits, and, while it does not oppose the mining of rare earth minerals in principle, it insists it must be better regulated.

Egede and the IA won 37% of the vote, ending the tenure of Siumut, the party which had been in power for most of the time since 1979. Siumut was supportive of the Kvanefjeld mining project, assisting Greenland Minerals to gain preliminary approval and ending a previous zero tolerance policy for uranium mining.

There is now a bill being debated in the Greenland parliament to ban the uranium mining project and all mining that contains radioactive by-products.

According to Mark Nuttall, an anthropologist at the University of Alberta and the head of the Climate and Society research programme at the Greenland Climate Research Centre: “This [election] has sent shivers down the spine of many mining executives as to what kind of future mining would take place in Greenland.”

Under the direction of Egede, the IA-led government has also taken several significant steps in recent months to curb fossil fuel production.

Last week in Glasgow, Egede announced that Greenland will be joining the Paris Agreement. In 2016, under the leadership of Siumut, Greenland had invoked a territorial exemption to the climate agreement when Denmark joined.

Greenland, which is technically a self-governing territory of Denmark, claimed at the time that the country was dependent on its oil, gas and natural mineral reserves for its economy.

“The Arctic region is one of the areas on our planet where the effects of global warming are felt the most, and we believe that we must take responsibility collectively. That means that we, too, must contribute our share,” Egede said last week.

Egede’s government also pledged to develop its renewable energy capability, especially hydropower: “Greenland has hydropower resources that exceed our country’s needs. These large hydropower resources can be utilised in collaboration with national and international investors who need large amounts of cheap and renewable energy.”

The Northwest Passage

The rush for the rare earth minerals vital to so many low carbon technologies isn’t the only way that climate change is moving the country from the periphery of global geopolitics to its core. When the huge container ship the Ever Given blocked the Suez Canal in March, the world was reminded how much of its trade passes through its two major transcontinental waterways – Suez and Panama.

As much of the Arctic Ocean becomes ice-free for greater parts of the year, new potential trade routes open up, most significantly, the Northwest Passage across the top of North America, and the Northern Sea Route, above Eurasia.

The vast majority of Greenland’s settlements – including the capital, Nuuk – lie on the west coast of the country, along the Labrador Sea and Baffin Bay. When travelling from Asia or western North America to Europe or the east coast of North America through the Northwest Passage, this is the final stretch, positioning Nuuk as a potential hub on a future major shipping route.

The struggle for sovereignty

Nearly 90% of the population of Greenland are indigenous Inuit people, who have inhabited the island for thousands of years. Although they’ve been colonised for the last thousand years by Nordic powers, they have maintained their own language and culture.

Norsemen first settled on the island in the tenth century, and in 1261 Greenland formally became part of Norway. In 1814 Greenland became a Danish territory – and in 1953 the island became fully integrated into the Danish state. (During World War II, when Denmark was conquered by the Nazis, Greenland was de facto under US control.)

“The official Danish view was that Greenland was actually a dependency; it wasn’t a colony in the sense of its colonies in the West Indies and other places,” Nuttall explained. This, he said, was “because of this historic view that Greenland had long been part of this Nordic Commonwealth from the Norse settlements of the tenth century onwards”.

But the Inuit people don’t always see it that way. During the Black Lives Matter global movement in 2020, younger Greenlanders, including the 21-year-old hip hop artist Josef Tarrak-Petrussen, called for the removal of Danish colonial statues in Nuuk.

Denmark finally granted home rule in 1979. And in 2008 Greenland voted in favour of the Self-Government Act, which transferred more power to the island’s government – and effectively marked the beginning of state formation.

This self rule act recognises Greenland as a nation with the right to independence if it chooses it. Currently Greenland has nearly full sovereignty, with the exception of the areas of foreign policy and defence. The Arctic island currently receives an annual grant of around $585m from Denmark.

In recent years, questions around sovereignty have in many ways defined the political and environmental policies of the island. Many of the political parties support independence.

However, this financial dependence on Denmark makes the prospect of full independence quite difficult: the grant accounts for nearly 20% of the island’s income, while fishing makes up around 90% of its exports.

In order to gain full autonomy from Denmark, Greenland needs to develop a self-sufficient economy. However, this likely requires the development of lucrative extractive industries which will deepen the island’s dependence on (foreign) international capital.

“If we go back ten years, mining was seen as the major way to [become politically independent], and there was great excitement,” said Nuttall.

However in recent years this attitude towards mining has changed considerably due to a host of factors including a downturn in global commodity markets, a greater emphasis on renewable energy and attention given to the climate crisis.

“Mining is going to be one pillar of an economic development strategy that will include other things such as the development of tourism, expansion of the fishing industry… and expanding renewables,” Nuttall explained.

The current government is now focusing on investments in the island’s enormous hydropower potential, which has the potential to grow as glaciers melt and which will allow a reduction in petrol imports, one of the country’s main expenses. Kalistat Lund, the minister for agriculture, self-sufficiency, energy and environment, stated that the government is “working to attract new investments for the large hydropower potential that we cannot exploit ourselves”.

The island is also currently expanding its airports and promoting tourism. Currently the only flights available to Greenland are from Reykjavik or Copenhagen.

Greenland often appears in discussions about climate change – usually in the context of films of starving polar bears, adorable Arctic foxes and rutting muskox; or melting glaciers diverting the Gulf Stream and raising global sea levels, flooding cities across the planet. Ice cores from Greenland, like those of Antarctica, help us understand historic variations in the composition of our atmosphere and in our climate, and have been vital for scientists’ understanding of the science of climate change.

These things are all true, and each Arctic species being pushed to extinction by the warming of the world is a tragedy. But what’s also true is that Greenland is home to tens of thousands of people, with their own history and culture, politics and organisations; a people who, after a thousand years of colonisation, are starting to assert both their independence from Denmark and their sovereignty in the face of the global market. And, who, along with other indigenous communities around the world, are starting to lead a fightback against the industrial, extractive capitalism that’s killing the planet.

Wall Street investors have hit the jackpot. Soon they’ll be able to buy, own, and dictate The Commons, public lands, the world of Mother Nature. In fact, a pilot project is already in the works with ecosystems up for sale as Wall-Streeters anxiously prepare to gobble up the valued benefits of Mother Nature.

According to the NYSE PR Dept. they’ll IPO nature: “To preserve and restore the natural assets that ultimately underpin the ability for there to be life on Earth.” What? Really?

And, according to NYSE COO Michael Blaugrund: “Our hope is that owning a natural asset company is going to be a way that an increasingly broad range of investors have the ability to invest in something that’s intrinsically valuable, but, up to this point, was really excluded from the financial markets.”

Then, does this mean that neoliberal capitalism is becoming nature’s beneficent caretaker so environmentalists can stop wringing their hands about the horrendous loss of wild vertebrate life, down a whopping 68%, and loss of wetlands and loss of huge chunks of rainforests these past few decades, all of which echoes a guttural sound of impending extinction? Answer: Don’t count on it.

For starters, there’s something extraordinarily distasteful and downright disgusting about Wall Street buying control of nature’s resource capabilities. It bespeaks of an upside down world where the ludicrous becomes acceptable, but is it really acceptable? Is it?

The main character in this new scheme to own the world is a new asset class with a very plain name that says it all: Natural Asset Company or NAC. Yes, if you are a billionaire, get ready to buy up to 30% of the world’s natural resource beneficence to society. It’s going to be offered on the biggest auction block of the world, the New York Stock Exchange under the cover of sustainability of nature and protection of biodiversity, wink, wink!

Of course, this prompts a series of questions, headlined by when does Mother Nature morph into a tollbooth?

In simplest of terms, NACs allow for the formation of specialized corporations that hold the rights to the ecosystem services produced on a given chunk of land. The services might be sequestration of carbon or clean water or possibly rare Tibetan mountain air or maybe a lake teeming with trout in the wilderness. The possibilities are endless when auctioning off major chunks of an asset as big as the planet.

The NAC will maintain, manage and grow the natural asset that it has commoditized, working towards maximizing the profit potential of the natural asset, although, of course, this is not emphasized in the PR material. Nevertheless, it could lead to near-infinite profits. After all, the living Earth does rejuvenate and replenish and service ecosystems on its own accord, a natural process that goes on forever. Why not own it?

If ever there has been a time for the people of the world to drop whatever they are doing and focus on one issue, now is that time. The Commons is for sale! Think long and hard about that proposition, study it, discuss it, and decide whether to agree that Mother Nature should be monetized. If not in agreement, then do something, tell everybody, tell anybody who’ll listen, carry poster boards in the street, join a protest march, bang pots and pans, do something to relieve that breakneck pressure building around your temples!

The Intrinsic Exchange Group, in partnership with the NYSE, is currently working with the Costa Rica government on a pilot project of NACs in the country in order to institute its protocol for ownership of forests, lakes, waterfalls, mountains, meadows, caves, wetlands, in essence, all of nature. Costa Rica is the proving grounds for ownership of Mother Nature, whether she likes it or not.

First, NAC identifies a natural asset, like a forest for example, which is quantified using special protocols that have already been developed by various coalitions amongst multinational corporations, which in and of itself is remarkably terrifying. The NAC decides who has the rights to the natural asset’s productivity and how it is to be managed. It is then monetized via an IPO on the stock exchange. Thus, the NAC becomes “the Issuer” to potential buyers of the natural asset that the NAC represents. Essentially, NAC is a real estate agent of Mother Nature. The buyers are institutional investors, or the occasional billionaire, that want to own the rights to the benefits of wetlands or rainforests or natural water springs or rarified mountainous air or hot springs or whatever they want to own. The world is their oyster to buy, own, enjoy, and profit by.

Throughout all human history nature has been The Commons or the cultural and natural resource for all of society inclusive of natural processes like air and water. But now private investors are deleting The Commons with claims of “conservation and sustainability” of 30% of what’s called “protected areas” of our precious worldwide assets.

According to initial calculations, NACs will unlock $4Quadrillion in assets as a new feeding ground for Wall Street investors to buy the rights to clean water and clean air and trout streams and bass-laden lakes and gorgeous picturesque waterfalls and lagoons, an entire forest, or maybe eventually extend into the oceans. Who knows the range of possibilities once nature is transacted on Wall Street.

Monetizing nature!

What’s next, what’s left?

The Commons is property shared by all, inclusive of natural products like air, water, and a habitable planet, forests, fisheries, groundwater, wetlands, pastures, the atmosphere, the high seas, Antarctica, outer space, caves, all part of ecosystems of the planet.

The sad truth is Mother Nature, Inc. will lead to extinction of The Commons, as an institution, in the biggest heist of all time. Surely, private ownership of nature is unseemly and certainly begs a much bigger relevant question that goes to the heart of the matter, to wit: Should nature’s ecosystems, which benefit society at large, be monetized for the direct benefit of the few?

What this adds up to should be clear enough, yet many people who should know better choose not to see it. This is business-as- usual: the expansive, colonizing, progressive human narrative, shorn only of the carbon. It is the latest phase of our careless, self-absorbed, ambition-addled destruction of the wild, the unpolluted, and the nonhuman. It is the mass destruction of the world’s remaining wild places in order to feed the human economy. And without any sense of irony, people are calling this “environmentalism.1 —PAUL KINGSNORTH

Once upon a time, environmentalism was about saving wild beings and wild places from destruction. “The beauty of the living world I was trying to save has always been uppermost in my mind,” Rachel Carson wrote to a friend as she finished the manuscript that would become Silent Spring. “That, and anger at the senseless, brutish things that were being done.”2 She wrote with unapologetic reverence of “the oak and maple and birch” in autumn, the foxes in the morning mist, the cool streams and the shady ponds, and, of course, the birds: “In the mornings, which had once throbbed with the dawn chorus of robins, catbirds, doves, jays, and wrens, and scores of other bird voices, there was now no sound; only silence lay over the fields and woods and marshes.”3 Her editor noted that Silent Spring required a “sense of almost religious dedication” as well as “extraordinary courage.”4 Carson knew the chemical industry would come after her, and come it did, in attacks as “bitter and unscrupulous as anything of the sort since the publication of Charles Darwin’s Origin of Species a century before.”5 Seriously ill with the cancer that would kill her, Carson fought back in defense of the living world, testifying with calm fortitude before President John F. Kennedy’s Science Advisory Committee and the U.S. Senate. She did these things because she had to. “There would be no peace for me,” she wrote to a friend, “if I kept silent.”6

Carson’s work inspired the grassroots environmental movement; the creation of the Environmental Protection Agency (EPA); and the passage of the Clean Air Act, the Clean Water Act, and the Endangered Species Act. Silent Spring was more than a critique of pesticides—it was a clarion call against “the basic irresponsibility of an industrialized, technological society toward the natural world.”7 Today’s environmental movement stands upon the shoulders of giants, but something has gone terribly wrong with it. Carson didn’t save the birds from DDT so that her legatees could blithely offer them up to wind turbines. We are writing this book because we want our environmental movement back.

Mainstream environmentalists now overwhelmingly prioritize saving industrial civilization over saving life on the planet. The how and the why of this institutional capture is the subject for another book, but the capture is near total. For example, Lester Brown, founder of the Worldwatch Institute and Earth Policy Institute—someone who has been labeled as “one of the world’s most influential thinkers” and “the guru of the environmental movement”8—routinely makes comments like, “We talk about saving the planet.… But the planet’s going to be around for a while. The question is, can we save civilization? That’s what’s at stake now, and I don’t think we’ve yet realized it.” Brown wrote this in an article entitled “The Race to Save Civilization.”9

The world is being killed because of civilization, yet what Brown says is at stake, and what he’s racing to save, is precisely the social structure causing the harm: civilization. Not saving salmon. Not monarch butterflies. Not oceans. Not the planet. Saving civilization. Brown is not alone. Peter Kareiva, chief scientist for The Nature Conservancy, more or less constantly pushes the line that “Instead of pursuing the protection of biodiversity for biodiversity’s sake, a new conservation should seek to enhance those natural systems that benefit the widest number of [human] people…. Conservation will measure its achievement in large part by its relevance to [human] people.”10 Bill McKibben, who works tirelessly and selflessly to raise awareness about global warming, and who has been called “probably America’s most important environmentalist,” constantly stresses his work is about saving civilization, with articles like “Civilization’s Last Chance,”11 or with quotes like, “We’re losing the fight, badly and quickly—losing it because, most of all, we remain in denial about the peril that human civilization is in.”12

We’ll bet you that polar bears, walruses, and glaciers would have preferred that sentence ended a different way.

In 2014 the Environmental Laureates’ Declaration on Climate Change was signed by “160 leading environmentalists from 44 countries” who were “calling on the world’s foundations and philanthropies to take a stand against global warming.” Why did they take this stand? Because global warming “threatens to cause the very fabric of civilization to crash.” The declaration con- cludes: “We, 160 winners of the world’s environmental prizes, call on foundations and philanthropists everywhere to deploy their endowments urgently in the effort to save civilization.”13

Coral reefs, emperor penguins, and Joshua trees probably wish that sentence would have ended differently. The entire declaration, signed by “160 winners of the world’s environmental prizes,” never once mentions harm to the natural world. In fact, it never mentions the natural world at all.

Are leatherback turtles, American pikas, and flying foxes “abstract ecological issues,” or are they our kin, each imbued with their own “wild and precious life”?14 Wes Stephenson, yet another climate activist, has this to say: “I’m not an environmentalist. Most of the people in the climate movement that I know are not environmentalists. They are young people who didn’t necessarily come up through the environmental movement, so they don’t think of themselves as environmentalists. They think of themselves as climate activists and as human rights activists. The terms ‘environment’ and ‘environmentalism’ carry baggage historically and culturally. It has been more about protecting the natural world, protecting other species, and conservation of wild places than it has been about the welfare of human beings. I come at from the opposite direction. It’s first and foremost about human beings.”15

Note that Stephenson calls “protecting the natural world, protecting other species, and conservation of wild places” baggage. Naomi Klein states explicitly in the film This Changes Everything: “I’ve been to more climate rallies than I can count, but the polar bears? They still don’t do it for me. I wish them well, but if there’s one thing I’ve learned, it’s that stopping climate change isn’t really about them, it’s about us.”

And finally, Kumi Naidoo, former head of Greenpeace International, says: “The struggle has never been about saving the planet. The planet does not need saving.”16 When Naidoo said that, in December 2015, it was 50 degrees Fahrenheit at the North Pole, much warmer than normal, far above freezing in the middle of winter.

In 1975, Robert Hunter and I were the first people to physically block a harpooner’s line of fire when we intercepted a Soviet whaling fleet and placed our bodies between the killers and eight fleeing, frightened sperm whales. We were in a small inflatable boat, speeding before the plunging steel prow of a Russian kill boat. As the whales fled for their lives before us, we could smell the fear in their misty exhalations. We thought we could make a difference with our Gandhi-inspired seagoing stand. Surely these men behind the harpoons would not risk killing a human being to satisfy their lust for whale oil and meat. We were wrong.

The whalers demonstrated their contempt for our nonviolent protests by firing an explosive harpoon over our heads. The harpoon line slashed into the water and we narrowly escaped death. One of the whales was not so lucky. With a dull thud followed by a muffled explosion, the entrails of a female whale were torn and ripped apart by hot steel shrapnel.

The large bull sperm whale in the midst of the pod abruptly rose and dove. Experts had told us that a bull whale in this situation would attack us. We were a smaller target than the whaling ship. Anxiously, we held our breath in anticipation of sixty tons of irate muscle and blood torpedoing from the depths below our frail craft.

The ocean erupted behind us. We turned toward the Soviet ship to see a living juggernaut hurl itself at the Russian bow. The harpooner was ready. He pulled the trigger and sent a second explosive missile into the massive head of the whale. A pitiful scream rang in my ears, a fountain of blood geysered into the air, and the deep blue of the ocean was rapidly befouled with dark red blood. The whale thrashed and convulsed violently.

Mortally wounded and crazed with pain, the whale rolled, and one great eye made contact with mine. The whale dove, and a trail of bloody bubbles moved laboriously toward us. Slowly, very slowly, a gargantuan head emerged from the water, and the whale rose at an angle over and above our tiny craft. Blood and brine cascaded from the gaping head wound and fell upon us in torrents.

We were helpless. We knew that we would be crushed within seconds as the whale fell upon us. There was little time for fear, only awe. We could not move.

The whale did not fall upon us. He wavered and towered motionless above us. I looked up past the daggered six-inch teeth and into the eye the size of my fist, an eye that reflected back intelligence and spoke wordlessly of compassion and communicated to me the understanding that this was a being that could discriminate and understood what we had tried to do. The mammoth body slowly slid back into the sea.

The massive head of this majestic sperm whale slowly fell back into the sea. He rolled and the water parted, revealing a solitary eye. The gaze of the whale seized control of my soul, and I saw my own image reflected back at me. I was overcome with pity, not for the whale but for ourselves. Waves of shame crashed down upon me and I wept. Overwhelmed with horror at this revelation of the cruel blasphemy of my species, I realized then and there that my allegiance lay with this dying child of the sea and his kind. On that day, I left the comfortable realm of human self-importance to forever embrace the soulful satisfaction of lifelong service to the citizens of the sea.

The gentle giant died with my face seared upon his retina. I will never forget that. It is a memory that haunts and torments me and leaves me with only one course to chart toward redemption for the collective sins of humanity. It is both my burden and my joy to pledge my allegiance to the most intelligent and profoundly sensitive species of beings to have ever inhabited the Earth––the great whales.

Reykjavik, Iceland, November 1986

Despite the criticisms, the name-calling, and the controversy that have arisen from our work since 1975, one indisputable fact emerged from a raid made by my crew (which included Rod Coronado of the U.S. and David Howitt of the UK) on two whaling ships in Reykjavik in 1986 in order to enforce an international moratorium on commercial whaling that had been established that year: it was successful.

The two whaling ships were razed, although their electronics and mechanical systems had been totally destroyed. Insurance did not cover the losses because the owners had stated that terrorists sank the ships, and apparently they were not insured for terrorism.

Most importantly, from that day of November 8, 1986, to sixteen years later in the year 2002, the Icelanders did not take another whale. What talk, compromise, negotiations, meetings, letters, petitions, and protests had not accomplished, we achieved with a little monkey-wrenching activity in the wee hours of the morning.

Were we terrorists? No, not even criminals, for we were never charged with a crime, even though we made ourselves available for prosecution. We had simply done our duty, and we put an end to an unlawful activity.

The only repercussion was that Iceland moved before the International Whaling Commission (IWC) in 1987 that the Sea Shepherd Conservation Society be banned from holding observer status at the meetings of the IWC. After this passed, Iceland resigned from the IWC, leaving us with the distinction of being the only organization to enjoy the status of banishment from the IWC.

How ironic, I thought, to be the only organization banned from the IWC because we were the only organization to have ever enforced an IWC ruling.

It was not much of a punishment. I had never enjoyed listening to the delegates of the member nations barter whales like they were bushels of wheat or pork bellies. I also never had much use for the posturing of the nongovernmental organizations pretending that they were actually making a difference by attending this annual circus. All that we were interested in were the rulings of the IWC, and we fully intended to continue to enforce those rulings.

I have been asked many times why we consider the IWC rulings important. Why not just oppose all whaling everywhere? The answer is that we do oppose all whaling by everyone, everywhere. However, we only actively attack whaling operations that are in violation of international conservation law. The reason for this is simple: We do not presume to be the judges and jury. We simply execute the rulings of the IWC or the Convention on International Trade in Endangered Species of Wild Fauna and Flora (CITES) or any rulings from international conservation authorities, and we do so in accordance with the definition of intervention as defined by the 1982 United Nations World Charter for Nature, Part III (Implementation), Principle 21, Section (e): “States and, to the extent they are able, other public authorities, international organizations, individuals, groups and corporations shall… Safeguard and conserve nature in areas beyond national jurisdiction.”

As a seaman, I have a great and abiding respect for the traditions of the law of the sea. To attack without a vested authority would be piracy. Thus, the difference between a privateer like Sir Francis Drake and a pirate like Blackbeard was that the former was in possession of a letter of marque from a sovereign authority and the latter practiced the same trade solely upon his own authority.

I have never considered it my place to judge the illegal activities of others. However, I feel that when there are laws and international treaties that it is the responsibility of individuals and nongovernmental organizations to strive toward the implementation of these rulings, especially in light of the fact that there is no international body empowered to police these international laws. Nation-states intervene when it is advantageous for them to do so, but little enforcement is carried out in the interests of the common good of all citizens of the planet.

It is worth noting that it was not the British or Spanish navies that brought the piracy of the Caribbean under control in the 17th century. There were too many conflicts of interest, too much corruption, and too little motivation for any real action to have been taken. The bureaucracies in the British admiralty and the Spanish court did nothing because the very nature of a bureaucracy is the maintenance of the status quo. The achievement of first shutting down piracy on the Spanish Main is attributed to one man––a pirate himself.

Henry Morgan did what two nations chose not to do: he drove the pirates to ground and ended their reign of terror. As a result, the “pirate” was made governor of Jamaica, although history would show that the man was far more effective as a pirate than as a politician. In fact, he was more of a pirate as a politician than he was as an actual pirate.

When Andrew Jackson failed to get the support of the merchants of New Orleans to back his attack on the British, it was a pirate who came to his service in the personage of Jean Lafitte. When the United States successfully endeavored to cast off the yoke of British rule, it was a pirate who achieved the most dramatic and successful naval victory at sea. That person was captain John Paul Jones. Consequently, it is a pirate who was the founder of what is today the world’s most powerful navy.

Today, with the pirates of corrupt industry aided by corrupt politicians plundering our oceans for the last of the fish, killing the last of the whales, and polluting the waters, we find that there is very little real resistance to their activities upon the high seas. Once again it is time for some good pirates to rise up in opposition to the bad pirates, and I believe that the Sea Shepherd Conservation Society is just such an organization of good pirates.

When our critics call us pirates, I have no problem with that. In fact, we have taken their criticisms and in an aikido-like manner; we have incorporated their accusations into our image. Our ships are sometimes painted a monochromatic black. We have designed our own version of the pretty red [a flag which, when translated to French, becomes “joli rouge” and is rumored to have inspired the “jolly roger” phrase applied to pirate flags], and our black-and-white flag flies from our mast during campaigns. We even carry cannons, with the difference being that our guns fire cream pies and not red-hot balls.

As good pirates, we have evolved to suit the time and culture in which we live, and this being a media-defined culture, our primary weapons are the camera, the video, and the internet. Like modern-day Robin Hoods, we take from the greedy and give back to the sea. We don’t profit materially, but we profit tremendously both spiritually and psychologically.

Editor’s note: We know less about the bottom of the sea than we know about outer space. We really require no scientific evidence to know that mining is bad for the environment wherever it occures. It should not be done on land, under the sea or on other planets. The ISA needs to reject the deep sea mining industry’s claims that mining for metals on the ocean floor is a partial solution to the climate crisis.   • The high cost of studying deep-sea ecosystems means that many scientists have to rely on funding and access provided by companies seeking to exploit resources on the ocean floor.

When Cindy Van Dover started working with Nautilus Minerals, a deep-sea mining company, she received hate mail from other marine scientists. Van Dover is a prolific deep-sea biologist, an oceanographer who has logged hundreds of dives to the seafloor. In 2004, Nautilus invited Van Dover and her students to characterize ecosystems in the Manus Basin off Papua New Guinea, a potential mining site with ephemeral hydrothermal vents teeming with life in the deep ocean.

Van Dover was the first academic deep-sea biologist to conduct baseline studies funded by a mining company, an act considered a “Faustian pact” by some at the time. Since then, more deep-sea biologists and early-career scientists aboard research vessels funded by these firms have conducted such studies. But partnering with mining companies raises some thorny ethical issues for the scientists involved. Is working with the mining industry advancing knowledge of the deep sea, or is it enabling this nascent industry? While there are efforts to disclose this scientific data, are they enough to ensure the protection of deep-sea ecosystems?

“I don’t think it’s sensible or right to not try to contribute scientific knowledge that might inform policy,” Van Dover said. With deep-sea mining, she added, “we can’t just stick our heads in the sand and complain when it goes wrong.”

More than half of the scientists in the small, highly specialized deep-sea biology community have worked with governments and mining companies to do baseline research, according to Lisa Levin, professor of biological oceanography at the Scripps Institution of Oceanography. Collecting biological samples in the deep sea is expensive: a 30-day cruise can cost more than $1 million. The U.S. National Science Foundation, the European Union and the National Science Foundation of China have emerged as top public funders of deep-sea research, but billionairesfoundations and biotech companies are getting in on the act, too.

Governments and mining companies already hold exploration licenses from the U.N.-affiliated International Seabed Authority (ISA) for vast swaths of the seafloor. Although still in an early stage, the deep-sea mining industry is on the verge of large-scale extraction. Mining companies are scouring the seabed for polymetallic nodules: potato-shaped rocks that take a millennium to form and contain cobalt, nickel and copper as well as manganese. Nauru, a small island in the South Pacific, earlier this year gave the ISA a two-year deadline to finalize regulations — a major step toward the onset of commercial deep-sea mining. The ISA is charged with both encouraging the development of the deep-sea mining industry and ensuring the protection of the marine environment, a conflict of interest in the eyes of its critics.

The Metals Company, a mining company based in Vancouver, Canada, formerly known as DeepGreen, recently said that it spent $75 million on ocean science research in the Clarion Clipperton Zone (CCZ) in the Pacific. The company has established partnerships with “independent scientific institutions” for its environmental and social impact assessments. Kris Van Nijen, managing director of Global Sea Mineral Resources said, “It is time, unambiguously and unanimously, to back research missions … Support the science. Let the research continue.” UK Seabed Resources, another deep-sea mining firm, lists significant scientific research that uses data from its research cruises in the CCZ.

The ISA requires mining companies to conduct baseline research as part of their exploration contracts. Such research looks to answer basic questions about deep-sea ecosystems, such as: what is the diversity of life in the deep sea? How will mining affect animals and their habitats? This scientific data, often the first time these deep-sea ecosystems have been characterized, is essential to assessing the impacts of mining and developing strategies to manage these impacts. Companies partner with scientific institutions across the United States, Europe and Canada to conduct these studies. But independence when it comes to alliances with industry is fraught with ethical challenges.

“If deep-sea science has been funded by interest groups such as mining companies, are we then really in a position to make the decision that is genuinely in the best interest of deep ocean ecosystems?” asks Aline Jaeckel, senior lecturer of law at the University of New South Wales in Australia. “Or are we heading towards mining, just by the very fact that mining companies have invested so heavily?”

The ethics of independent science

There’s a risk of potential conflicts of interest when scientists are funded by industry. While mining companies often tout working with independent scientists, in company-sponsored research vessels, “having somebody independent on board would be somebody who has presumably no financial affiliation in any way shape or form,” says Levin of the Scripps Institution of Oceanography.

When working with mining companies to collect baseline data, scientists are compensated through funding, which can be as high as $2.9 million, for their research labs. Many go on to publish journal articles based on data gathered on company-sponsored ships, advancing science in a relatively unknown realm where access is expensive and sparse.

While knowledge of the deep sea has advanced in recent decades, scientists are still trying to learn how these ecosystems are connected and the impact of mining over longer periods of time. The deep pelagic ocean — mid-water habitats away from the coasts and the seabed — is the least studied and chronically undersampled. There is also a dearth of deep-sea data for the Pacific, South Atlantic and Indian Oceans, where researchers (and mining companies) are increasingly focusing their attention.

For mining companies, science adds legitimacy, argues Diva Amon, a deep-sea biologist and director of SpeSeas, Trinidad and Tobago. “I think they recognize the value of science in appealing to consumers … and stakeholders as well.”

While it is common for scientific research to be funded by public agencies, when such funding dries up, scientists may be compelled to seek funding from or collaborate with interest groups. In other scientific endeavors like tobacco researchpublic health, climate science and clinical drug trials, there are policies to manage conflicts of interest, because history is rife with examples of industry influencing the designoutcome and communication of research in their favor. Some argue that even if industry-funded scientists publish research that is methodologically sound, industry influence on a broad scale can bias research results in imperceptible ways that erode trust in science.

Being funded by industry is not an issue if scientists are able to publish their research without restrictions, even if results are negative for the contractor, says Matthias Haeckel, a deep-sea biologist who is coordinating a mining impact project in the CCZ, funded by the European Union. “The question is if it’s up to this degree of independency, and that’s difficult to know from the outside … for me it’s sometimes a transparency issue. It’s not clear what the contracts with the scientists are.”

Deep-sea biologists have published research that does not work in the industry’s favor. A survey of megafauna diversity on the seafloor of the CCZ found that of the 170 identified animals, nearly half were found only on polymetallic nodules that are of interest to mining contractors. The study suggests that the nodules are an important habitat for species diversity. Biodiversity loss associated with mining is likely to last forever on human time scales, due to the slow rate of recovery in deep-sea ecosystems.

For some scientists, the key difference between being funded by an entity like the National Science Foundation versus the industry is control. Mining companies can ask scientists to sign nondisclosure agreements because companies in competition are concerned about the details of their sampling programs being made public, says Jeff Drazen, a deep-sea scientist at the University of Hawai‘i who is conducting research funded by The Metals Company. While there is a general understanding that scientists are free to publish their research, there can be embargos on when the research is released and requirements for consultation with the contractors.

“Many of them want you to sign an NDA before you can even talk to them. With the current contract we have with The Metals Company, none of our people have signed NDAs, and that was one of the reasons we decided to work with them,” Drazen says. “This is a common part of the business world to sign these NDAs — and that is antithetical to science, so that’s a cultural shift for most of us academics.”

The ISA has issued guidelines for baseline studies, but the decision of what and how much to sample rests on the company and scientists involved. “Scientists have to be careful not to necessarily be driven entirely by what the person funding the research wants,” says Malcolm Clark, a deep-sea biologist at New Zealand’s National Institute of Water and Atmospheric Research. “We’ve got to be very objective and make it very clear what’s required for a robust scientific project, and not just respond to the perceived needs of the client. Easy to say — very, very difficult to actually put into practice.” Clark also sits on the Legal and Technical Commission, a body within the ISA tasked with assessing mining applications.

‘Damned if you do, damned if you don’t’

Scientists are still trying to fathom the depths of our oceans, both to understand the sensitive ecosystems that thrive there, and the minerals that can be extracted from polymetallic nodules that have formed over millennia. Less than 1% of the deep sea has been explored. The interest in exploiting ocean minerals is coupled with advancements in scientific research. A study published earlier this year found that deep-sea research languished when this interest in exploitation waned in the 1980s and ’90s.

For baseline research, “if this fundamental first-time characterization of these ecosystems is going to be done, it should be done by experts, so there’s quality assurance,” Levin said in a lecture in 2018 on the ethical challenges of seabed mining. “You’re damned if you do and damned if you don’t at some level.”

There’s also the perceived conflict of interest: the intangible effects of working closely with industry representatives, where collecting data means going out together on a research vessel for several weeks at a time.

“We’re humans, we’re building relationships, and going to sea is a particularly bonding experience because you’re out there isolated and working together. I cannot imagine how that kind of relationship will not at some point interfere with scientific judgment,” says Anna Metaxas, a deep-sea biologist at the Dalhousie University in Canada, whose research has not been funded by mining companies. It’s not the collection of data that Metaxas is concerned about, “it’s what you do with the data and how you end up communicating to whom and when.”

“What I’m noticing with many PIs [primary investigators] working with mining contractors is that they don’t want to bite the hand that feeds them,” says Amon. “As a result, they are less willing to speak to the public and the press, which is really unfortunate.”

The Wall Street Journal reported that according to two people familiar with the matter, Jeff Drazen was facing the possibility of having his funding revoked after publicly criticizing seabed mining. In an interview with Mongabay, Drazen declined to comment on the matter.

Other prominent scientists who work with mining contractors did not respond to interview requests for this article.

The trouble with DeepData

Since the ISA started giving out exploration contracts, the data that contractors collected was kept in a “black box” for more than 18 years, hidden from the world with the key in the hands of the contractors, the scientists who conducted this research, and a few people within the ISA. Because academics are involved, some of this data and analysis would eventually become available as peer-reviewed scientific literature.

In 2019, the ISA developed DeepData, a public database where contractors are required to submit the baseline data they collect. But the only data available to the public is environmental data. Resource data, particularly related to polymetallic nodules that are of interest to mining contractors, is off-limits and remains proprietary. The distinction between environmental and resource data is a “gray area,” according to Clark. What is deemed confidential is up to the mining contractors and the secretary-general of the ISA.

The nodules, rich in metals such as cobalt and nickel, are a breeding ground for deep-sea octopuses, and home to new species of deep-sea spongesdiverse animals and microbes not found in surrounding waters or sediments. The communities of organisms that rely on these nodules and sediment vary with the abundance of the nodules.

“Miners are going after the components of the habitat,” says Craig Smith, a deep-sea scientist at the University of Hawai‘i. “But we can’t really assess the abundance of that habitat without knowing the abundance of the nodules.” In fisheries, for example, industry-sensitive data is aggregated to help with management decisions, but such data is considered proprietary for the nodules.

The metallic content of these nodules is also a trade secret, though the information could be relevant for environmental assessments. Toxicity from broken-down ores could be created in the sediment plumes or wastewater that’s reinjected in the water column as a byproduct of the mining process, potentially affecting fish and other biodiversity. Where exactly in the water column mining companies will discharge the wastewater is also confidential.

Drazen, whose research (funded by The Metals Company) is looking at mining impacts on the midwater column, says the mining process will discharge mud and chemicals. “There’s a whole suite of potential effects on a completely different ecosystem above the seafloor. We depend upon the water column ecosystem … a lot of animals we like to eat … forage on deep-sea animals,” he says. The discharge of metals and toxins over potentially large areas could contaminate seafood. A recent study suggests that elements in discharge waters could spread further than mining areas, affecting tuna’s food, distribution, and migration corridors. There is increasing evidence that tuna, swordfish, marine mammals and seabirds rely on deep-sea fish, and foraging beaked whales could also be diving down to the seafloor in search of food.

DeepData is experiencing teething problems. A workshop to assess biodiversity for the CCZ in 2019 found inconsistencies in the data, making it difficult to synthesize across the CCZ. Different sampling methods can make it difficult to provide a cohesive picture.

“There’s still a bit of work in progress with DeepData. But certainly, the willingness is there to have it serving people with appropriate needs,” Clark says. “We do still need to be careful of the commercial confidentiality as it relates to the geochemical information in particular.”

The ISA did not respond to requests for comment.

An opaque decision-making body

The structure of the ISA, particularly its de facto decision-making body, the Legal and Technical Commission, is also fraught with transparency challenges. The Legal and Technical Commission assesses mining applications, which currently involve exploration contracts for the deep sea, but all of its meetings are held behind closed doors. The commission is composed of 30 experts nominated by their countries — some by governments that also hold exploration contracts — with only three deep-sea biologists on board.

“Even if some mining companies might genuinely fund what might be considered independent science, we still end up with a problem that the decision about whether or not to mine and the decision around environmental management of seabed mining rests entirely on data that is provided by the mining companies,” says Jaeckel of the University of New South Wales. “There is a lot of trust placed on mining companies.” There is no way to independently verify this data either, because deep-sea science is expensive, she adds. The degree to which companies are accurately reporting the baseline data to the ISA is not clear.

The commission is the only body within the ISA that sees the content of contractor’s applications, so the baseline data that contractors submit to be able to monitor impacts are only visible to the commission. There is an audit of the scientific data by the commission which reviews a contractor’s confidential annual reports. And then there’s public scrutiny of environmental impact assessments by NGOs.

Nauru Ocean Resources Inc., a wholly-owned subsidiary of The Metals Company, is “going to have to produce something really good,” says Clark of the company’s upcoming environmental impact assessment. Clark is a deep-sea biologist who was nominated to sit on the commission by New Zealand, which does not hold an exploration contract with the ISA. “Otherwise, the whole industry’s potential will be affected because it will taint the view of public and NGOs as to what contractors are doing — are they doing a serious and good job at the underlying research or are they trying to cut corners and push the ISA into making hasty decisions?”

In 2017, the commission approved an exploration contract for the Lost City, a metropolis of hydrothermal vents in the Atlantic Ocean that the Convention of Biological Diversity has recognized as an ecologically or biologically significant marine area that should be conserved. Marine scientists issued an open letter to the ISA to turn to independent scientists when evaluating requests for mineral exploration, and some have long called for open meetings and an independent scientific committee to advise the commission. Scientists are now petitioning for a pause on deep-sea exploitation out of concern about impacts on the marine environment.

That baseline research with industry might enable mining is “a very naïve perspective,” adds Smith of the University of Hawai‘i. “My gut feeling is that mining will go forward. It would be really wise to just permit one operation to go forward initially and monitor the heck out of it for 10 years. That would make a lot more sense than permitting multiple operations without even knowing what the real footprint will be in terms of disturbance.”
