The unholy and hated corporate leviathan known as Dominion Energy has begun felling trees for the Atlantic Coast Pipeline, a project poised to cross hundreds of rivers and streams and bore underneath the Appalachian Trail. Dominion’s ACP (along with EQT’s Mountain Valley Pipeline) disproportionately target communities of color and working class families in Appalachia. These projects have been rammed through via Dominion’s political and economic monopoly over every aspect of Virginia’s energy economy.
Dominion has already commenced with clearing and surveying using crews from Utah and Texas, despite their ear numbing promises of jobs for Virginians. We send out cheerful greetings to comrades everywhere.

Three residents of Central Appalachia and supporters with Mountain Justice chained themselves to an industrial tank of black water in front of Alpha Natural Resources’ Bristol, Va., headquarters to protest Alpha’s mountaintop removal strip mining and coal slurry operations across the region.
“I’m risking arrest today because mountaintop removal has to end now for the future viability of Appalachia,” says Emily Gillespie of Roanoke, Va., whose work with the Mountain Justice movement is inspired by Appalachian women’s history of non-violent resistance. The tank of water represents coal contamination from affected communities across the Appalachian region.
The group called for Alpha to stop seeking an expansion of the Brushy Fork coal slurry impoundment in Raleigh County, W.Va. “We want Kevin Crutchfield, CEO of Alpha Natural Resources, to produce a signed document expressing that they won’t seek the expansion of the Brushy Fork Impoundment before we leave,” Junior Walk, 23, from the Brushy Fork area said.
“I live downstream from Alpha’s Brushy Fork coal slurry impoundment on Coal River. If that impoundment breaks, my whole family would be killed,” Walk said, “Even if it doesn’t, we’re still being poisoned by Alpha’s mining wastes everyday. I’m here to bring the reality of that destruction to the corporate authorities who are causing it, but who don’t have to suffer its consequences.”
More than 20 peer-reviewed studies since 2010 demonstrate a connection between mountaintop removal coal mining operations and increased cases of kidney, lung, and heart diseases, as well as increased birth defects and early mortality. The ACHE act, currently in sub committee in Washington, calls for a moratorium on new mountaintop removal operations until a definitive, non-partisan study can demonstrate the reason for these community health emergency levels of health impacts.
The impoundment at Brushy Fork holds back almost 5 billion gallons of toxic sludge and is considered the largest earthen dam in the Western hemisphere. Recently leaked records show that coal slurry impoundments in Appalachia failed 59 out of 73 total structural tests performed by the Office of Surface Mining. “Alpha is only profitable because they’re allowed to gamble with our lives—and we’re the ones who pay the cost of their negligence and toxic pollution,” Walk said.
Alpha has lost numerous lawsuits relating to pollution from mining wastes in recent years, but they continue to violate safety regulations and expand their hazardous operations.
After refusing to take responsibility for the massive floods caused by the King Coal Highway and their destructive mountaintop removal mining practices, Alpha continues to push forward similar projects, such as the controversial Coalfields Expressway in Virginia.

Five states—Indiana, Virginia, Nebraska, Texas, and Georgia—account for forty percent of the total amount of toxic discharges to U.S. waterways in 2010, according to a new report released today by Environment America. Wasting Our Waterways: Industrial Toxic Pollution and the Unfulfilled Promise of the Clean Water Act also reports that 226 million pounds oftoxic chemicals were discharged into 1,400 waterways across the country.
“America’s waterways are a polluter’s paradise right now. Polluters dumped 226 million pounds of toxic chemicals into our lakes, rivers and streams in 2010,” said Shelley Vinyard, Clean Water Advocate with Environment America. “We must turn the tide of toxic pollution by restoring Clean Water Act protections to our waterways.”
The Environment America report documents and analyzes the dangerous levels of pollutants discharged to America’s waters by compiling toxic chemical releases reported to the U.S. EPA’s Toxics Release Inventory for 2010, the most recent data available.
Major findings of the report include:
- Pollution from just five states—Indiana, Virginia, Nebraska, Texas, and Georgia—accounted for nearly forty percent of the total amount of pollution dumped into our waterways in 2010
- Food and beverage manufacturing (slaughterhouses, rendering plants, etc.), primary metals manufacturing, chemical plants, and petroleum re¬fineries were some of the largest polluters. AK Steel dumped the most toxic pollution—nearly 30 million pounds—into our waterways in 2010.
- In 2010, industries discharged approximately 1.5 million pounds of cancer-causing chemicals, like arsenic, chromium, and benzene, into America’s waterways. Nevada’s Burns Creek received the largest volume of carcinogens in 2010, while neighboring Mill Creek placed third.
- Nitrates accounted for nearly 90 percent of the total volume of discharges to waterways reported in 2010. Nitrates are toxic, particularly to infants consuming formula made with nitrate-laden drinking water, who may be susceptible to methemoglobinemia, or “blue baby” syndrome, a disease that reducesthe ability of blood to carry oxygen throughout the body.
Environment America’sreport summarizes discharges of cancer-causing chemicals, chemicals that persist in the environment, and chemicals with the potential to cause reproductive problems ranging from birth defects to reduced fertility. Among the toxic chemicals discharged by facilities are arsenic, mercury, and benzene. Exposure to these chemicals is linked to cancer, developmental disorders, and reproductive disorders.
“The Clean Water Act’s original objective was to clean up all of America’s waterways by 1985—27 years ago,” said Rob Kerth, Analyst for Frontier Group and co-author of the report.“Many people born in 1985 have kids of their own now, yet still millions of pounds of toxic chemicals are being dumped into our waterways.”
In order to curb the toxic pollution threatening waterways like the Chesapeake Bay, the Colorado River and Puget Sound, Environment America recommends the following:
- Pollution Prevention: Industrial facilities should reduce their toxic discharges to waterways by switching from hazardous chemicals to safer alternatives.
- Protect all waters: The Obama administration should finalize guidelines and conduct a rulemaking to clarify that the Clean Water Act applies to all of our waterways – including the 2.5 million miles of streams in and 117 million Americans’ drinking water for which jurisdiction under the Clean Water Act has been called into question as a result of two polluter-driven Supreme Court decisions in the last decade.
- Tough permitting and enforcement: EPA and state agencies should issue permits with tough, numeric limits for each type of toxic pollution discharged, ratchet down those limits over time, and enforce those limits with credible penalties, not just warning letters.
“The bottom line is that America’s waterways shouldn’t be a polluter’s paradise, they should just be paradise. We need clean water now, and we are counting on the federal government to act to protect our health and our environment,” concluded Vinyard.

The Union of Concerned Scientists has documented 15 “near-misses” at 13 U.S. nuclear plants during 2011 and evaluates the response of the Nuclear Regulatory Commission to each event in a report released today.
The second in an annual series of reports, “The NRC and Nuclear Power Plant Safety 2011 Report: Living on Borrowed Time” details 15 special inspections launched by the federal agency in response to problems with safety equipment, security shortcomings, and other troubling events at nuclear power plants.
The overview is provided by David Lochbaum, the director of UCS’s Nuclear Safety Project. He worked at U.S. nuclear plants for 17 years and was a boiling water reactor technology instructor for the Nuclear Regulatory Commission.
“While none of the safety problems in 2011 caused harm to plant employees or the public, their frequency – more than one per month – is high for a mature industry,” Lochbaum writes.
In the 40 years that the Union of Concerned Scientists has evaluated safety at U.S. nuclear power plants, “We have repeatedly found that NRC enforcement of safety regulations is not timely, consistent or effective,” the report states.
The UCS says its findings match those of the agency’s internal assessments, as well as of independent agents such as the NRC’s Office of Inspector General and the federal Government Accountability Office, which is the investigative arm of Congress.
Many of these 15 “near misses” occurred because reactor owners either tolerated known safety problems or took inadequate measures to correct them, Lochbaum finds.
For example, the owner of the Oconee nuclear plant in South Carolina installed a backup reactor core cooling system in 1983. However, in 2011 – more than a quarter-century later – workers discovered a problem with the system that would have rendered it useless in an accident.
Another significant safety-related event in 2011 occurred at the Braidwood and Byron nuclear plants in Illinois. Workers at those plants had instituted a practice in 1993 of deliberately draining water from the piping to a vital safety system. They did so to reduce corrosion caused by the drawing of untreated lake water into the system. However, writes Lochbaum, “their solution would have prevented this vital safety system from functioning properly during an accident.”
In addition to “near misses” at these three nuclear plants, 12 others are documented in the report.
- At Callaway in Jefferson City, Missouri, operated by Union Electric Co., routine testing of an emergency pump intended to prove that it was capable of performing its safety functions during an accident actually degraded the pump. The pump’s manufacturer recommended against running the pump at low speeds, but this recommendation was ignored during the tests.
- At Cooper in Nebraska City, Nebraska, operated by the Nebraska Public Power District, workers replacing detectors used to monitor the reactor core during low-power conditions were exposed to high levels of radiation when they deviated from the prescribed procedure.
- At Millstone Unit 2 in Waterford, Connecticut, operated by Dominion, despite a dry run of an infrequently performed test on the control room simulator and other precautionary measures, errors during the actual test produced an unexpected and uncontrolled increase in the reactor’s power level.
- At North Anna in Richmond, Virginia, operated by Dominion, an earthquake of greater magnitude than the plant was designed to withstand caused both reactors to automatically shut down from full power.
- At Palisades in South Haven, Michigan, operated by Entergy, when a pump used to provide cooling water to emergency equipment failed in September 2009 because of stress corrosion cracking of recently installed parts, workers replaced the parts with identical parts. The replacement parts failed again in 2011, disabling one of three pumps.
- Also at Palisades, workers troubleshooting faulty indicator lights showing the position of the emergency airlock door inadvertently shut off power to roughly half the instruments and controls in the main control room. The loss of control power triggered the automatic shutdown of the reactor and complicated operators’ response.
- At Perry in Cleveland, Ohio, operated by FirstEnergy, problems during the replacement of a detector used to monitor the reactor core during low-power conditions exposed workers to potentially high levels of radiation.
- At Pilgrim in Plymouth, Massachusetts, operated by Entergy, security problems prompted the NRC to conduct a special inspection. Details of the problems, their causes, and their fixes are not publicly available.
- Also at Pilgrim, when restarting the reactor after a refueling outage, workers overreacted to indications that the water inside the reactor was heating up too rapidly, and lost control of the reactor. The plant’s safety systems automatically kicked in to shut down the reactor.
- At Turkey Point Unit 3 in Miami, Florida, operated by Florida Power and Light Co., a valve failure stopped the flow of cooling water to equipment, including the reactor coolant pump motors and the cooling system for the spent fuel pool.
- At Wolf Creek in Burlington, Kansas, operated by the Wolf Creek Nuclear Operating Co., workers overlooked numerous signs that gas had leaked into the piping of safety systems, impairing the performance of pumps and flow-control valves.
The report also cites instances when onsite NRC inspectors made “outstanding catches of safety problems” at the Fort Calhoun, Hatch, and LaSalle nuclear plants before these impairments led to events that required special inspections, or to major accidents.
