That question is absurd: Life itself will not survive, except what is funneled through the mechanical collective.”1

There is so little time and even less hope here, in the midst of ruin, at the end of the world. Every biome is in shreds. The green flesh of forests has been stripped to grim sand. The word water has been drained of meaning; the Athabascan River is essentially a planned toxic spill now, oozing from the open wound of the Alberta tar sands. When birds fly over it, they drop dead from the poison. No one believes us when we say that, but it’s true. The Appalachian Mountains are being blown to bits, their dense life of deciduous forests, including their human communities, reduced to a disposal problem called “overburden,” a word that should be considered hate speech: Living creatures—mountain laurels, wood thrush fledglings, somebody’s grandchildren—are not objects to be tossed into gullies. If there is no poetry after Auschwitz, there is no grammar after mountaintop removal. As above, so below. Coral reefs are crumbling under the acid assault of carbon. And the world’s grasslands have been sliced to ribbons, literally, with steel blades fed by fossil fuel. The hunger of those blades would be endless but for the fact that the planet is a bounded sphere: There are no continents left to eat. Every year the average American farm uses the energy equivalent of three to four tons of TNT per acre. And oil burns so easily, once every possibility for self-sustaining cultures has been destroyed. Even the memory of nature is gone, metaphrastic now, something between prehistory and a fairy tale. All that’s left is carbon, accruing into a nightmare from which dawn will not save us. Climate change slipped into climate chaos, which has become a whispered climate holocaust. At least the humans whisper. And the animals? During the 2011 Texas drought, deer abandoned their fawns for lack of milk. That is not a grief that whispers. For living beings like Labrador ducks, Javan rhinos, and Xerces blue butterflies, there is the long silence of extinction.
We have a lot of numbers. They keep us sane, providing a kind of gallows’ comfort against the intransigent sadism of power: We know the world is being murdered, despite the mass denial. The numbers are real. The numbers don’t lie. The species shrink, their extinctions swell, and all their names are other words for kin: bison, wolves, black-footed ferrets. Before me (Lierre) is the text of a talk I’ve given. The original version contains this sentence: “Another 120 species went extinct today.” The 120 is crossed clean through, with 150 written above it. But the 150 is also struck out, with 180 written above. The 180 in its turn has given way to 200. I stare at this progression with a sick sort of awe. How does my small, neat handwriting hold this horror? The numbers keep stacking up, I’m out of space in the margin, and life is running out of time.
Twelve thousand years ago, the war against the earth began. In nine places,2 people started to destroy the world by taking up agriculture. Understand what agriculture is: In blunt terms, you take a piece of land, clear every living thing off it—ultimately, down to the bacteria—and then plant it for human use. Make no mistake: Agriculture is biotic cleansing. That’s not agriculture on a bad day, or agriculture done poorly. That’s what agriculture actually is: the extirpation of living communities for a monocrop for and of humans. There were perhaps five million humans living on earth on the day this started—from this day to the ending of the world, indeed—and there are now well over seven billion. The end is written into the beginning. As earth and space sciences scholar David R. Montgomery points out, agricultural societies “last 800 to 2,000 years … until the soil gives out.”3 Fossil fuel has been a vast accelerant to both the extirpation and the monocrop—the human population has quadrupled under the swell of surplus created by the Green Revolution—but it can only be temporary. Finite quantities have a nasty habit of running out. The name for this diminishment is drawdown, and agriculture is in essence a slow bleed-out of soil, species, biomes, and ultimately the process of life itself. Vertebrate evolution has come to a halt for lack of habitat, with habitat taken by force and kept by force: Iowa alone uses the energy equivalent of 4,000 Nagasaki bombs every year. Agriculture is the original scorched-earth policy, which is why both author and permaculturist Toby Hemenway and environmental writer Richard Manning have written the same sentence: “Sustainable agriculture is an oxymoron.” To quote Manning at length: “No biologist, or anyone else for that matter, could design a system of regulations that would make agriculture sustainable. Sustainable agriculture is an oxymoron. It mostly relies on an unnatural system of annual grasses grown in a mono- culture, a system that nature does not sustain or even recognize as a natural system. We sustain it with plows, petrochemicals, fences, and subsidies, because there is no other way to sustain it.”4
Agriculture is what creates the human pattern called civilization. Civilization is not the same as culture—all humans create culture, which can be defined as the customs, beliefs, arts, cuisine, social organization, and ways of knowing and relating to each other, the land, and the divine within a specific group of people. Civilization is a specific way of life: people living in cities, with cities defined as people living in numbers large enough to require the importation of resources. What that means is that they need more than the land can give. Food, water, and energy have to come from somewhere else. From that point forward, it doesn’t matter what lovely, peaceful values people hold in their hearts. The society is dependent on imperialism and genocide because no one willingly gives up their land, their water, their trees. But since the city has used up its own, it has to go out and get those from somewhere else. That’s the last 10,000 years in a few sentences. Over and over and over, the pattern is the same. There’s a bloated power center surrounded by conquered colonies, from which the center extracts what it wants, until eventually it collapses. The conjoined horrors of militarism and slavery begin with agriculture.
Agricultural societies end up militarized—and they always do—for three reasons. First, agriculture creates a surplus, and if it can be stored, it can be stolen, so, the surplus needs to be protected. The people who do that are called soldiers. Second, the drawdown inherent in this activity means that agriculturalists will always need more land, more soil, and more resources. They need an entire class of people whose job is war, whose job is taking land and resources by force—agriculture makes that possible as well as inevitable. Third, agriculture is backbreaking labor. For anyone to have leisure, they need slaves. By the year 1800, when the fossil fuel age began, three-quarters of the people on this planet were living in conditions of slavery, indenture, or serfdom.5 Force is the only way to get and keep that many people enslaved. We’ve largely forgotten this is because we’ve been using machines—which in turn use fossil fuel—to do that work for us instead of slaves. The symbiosis of technology and culture is what historian, sociologist, and philosopher of technology Lewis Mumford (1895-1990) called a technic. A social milieu creates specific technologies which in turn shape the culture. Mumford writes, “[A] new configuration of technical invention, scientific observation, and centralized political control … gave rise to the peculiar mode of life we may now identify, without eulogy, as civilization… The new authoritarian technology was not limited by village custom or human sentiment: its herculean feats of mechanical organization rested on ruthless physical coercion, forced labor and slavery, which brought into existence machines that were capable of exerting thousands of horsepower centuries before horses were harnessed or wheels invented. This centralized technics … created complex human machines composed of specialized, standardized, replaceable, interdependent parts—the work army, the military army, the bureaucracy. These work armies and military armies raised the ceiling of human achievement: the first in mass construction, the second in mass destruction, both on a scale hitherto inconceivable.”6
Technology is anything but neutral or passive in its effects: Ploughshares require armies of slaves to operate them and soldiers to protect them. The technic that is civilization has required weapons of conquest from the beginning. “Farming spread by genocide,” Richard Manning writes.7 The destruction of Cro-Magnon Europe—the culture that bequeathed us Lascaux, a collection of cave paintings in southwestern France—took farmer-soldiers from the Near East perhaps 300 years to accomplish. The only thing exchanged between the two cultures was violence. “All these artifacts are weapons,” writes archaeologist T. Douglas Price, with his colleagues, “and there is no reason to believe that they were exchanged in a nonviolent manner.”8
Weapons are tools that civilizations will make because civilization itself is a war. Its most basic material activity is a war against the living world, and as life is destroyed, the war must spread. The spread is not just geographic, though that is both inevitable and catastrophic, turning biotic communities into gutted colonies and sovereign people into slaves. Civilization penetrates the culture as well, because the weapons are not just a technology: no tool ever is. Technologies contain the transmutational force of a technic, creating a seamless suite of social institutions and corresponding ideologies. Those ideologies will either be authoritarian or democratic, hierarchical or egalitarian. Technics are never neutral. Or, as ecopsychology pioneer Chellis Glendinning writes with spare eloquence, “All technologies are political.”9

Decision Follows Lawsuit, Permit Suspension, Public Pressure
WASHINGTON— The U.S. Army Corps of Engineers announced Wednesday it will require a full “environmental impact statement” for the massive petrochemical complex Formosa Plastics proposes to build in St. James Parish, Louisiana. The decision is a major victory for opponents of the plant, who sued to block the project in January 2020 and convinced the Army Corps to suspend its permit last fall.
Wednesday’s announcement means the Army Corps will now do a complete analysis of the public health, environmental, climate, environmental justice and cultural impacts of what would be one of the world’s biggest plastic-making plants. Plaintiff groups representing the Black and low-income communities affected by the project — from an already polluted industrial corridor known as Cancer Alley or Death Alley — have long said a proper environmental review would show the project should never be built.
“The Army Corps has finally heard our pleas and understands our pain. With God’s help, Formosa Plastics will soon pull out of our community,” said Sharon Lavigne with RISE St. James, who earlier this year was awarded the Goldman Environmental Prize for her work defending her community from petrochemical polluters. “Nobody took it upon themselves to speak for St. James Parish until we started working to stop Formosa Plastics. Now the world is watching this important victory for environmental justice.”
RISE St. James, Louisiana Bucket Brigade and Healthy Gulf were represented in the litigation over this permit by the Center for Biological Diversity. Local opponents of the project have been aggressively dismissed, arrested and publicly criticized over their work to stop this project, which received huge taxpayer subsidies from the state.
“Today’s announcement is the ultimate David v. Goliath victory,” said Anne Rolfes, executive director of Louisiana Bucket Brigade. “We were not scared of Formosa Plastics and its $9 billion project, or the fact that our governor has been cheering for Formosa all along. St. James Parish residents are the ones who have shown leadership and wisdom. What the Corps has done today is common sense. Of course one of the biggest plastics plants in the world should require an environmental impact statement. Our state and federal officials should have demanded it from the outset. I am hopeful that this is the nail in the coffin of Formosa Plastics in St. James Parish. And don’t try to build somewhere else. Pack up and go home.”
The proposed facility would emit 13.6 million metric tons of greenhouse gases each year, the equivalent of 3.5 coal-fired power plants. It will also produce 800 tons of toxic air pollutants annually, doubling air emissions in St. James Parish, to produce plastic for single-use packaging and other products. Recent studies have linked exposure to air pollution with higher COVID-19 death rates. It’s one likely factor in the disease’s disproportionate impact on Black Americans.
The lawsuit sought to invalidate Clean Water Act permits issued by the Army Corps in 2019. It asserted that officials violated federal laws in approving the destruction and damage of wetlands, which help protect the region from hurricanes that are intensifying with climate change. The Corps also ignored the water, air, climate, and health impacts of the complex and failed to properly evaluate and protect burial sites of enslaved people discovered on the property.
“This long-overdue review will show the unacceptable harm Formosa Plastics’ massive petrochemical complex would inflict on this community, our waterways, and our climate,” said Julie Teel Simmonds, a senior attorney at the Center. “This terrible project shouldn’t have been rubber-stamped and it should never be built. Climate action and environmental justice mean we have to stop sacrificing communities and a healthy environment just to make throwaway plastic.”
The growing chorus of project opponents includes the United Nations Office of the High Commissioner on Human Rights, which called the project “environmental racism” in March and urged U.S. officials to reject the project.
Formosa Plastics’ massive proposed petrochemical complex would include 10 chemical manufacturing plants and numerous support facilities, spanning 2,500 acres, just one mile from an elementary school. By turning fracked gas into the building blocks for a massive amount of single-use packaging and other wasteful plastic products, the project would worsen climate change and the ocean plastic pollution crisis.
Last year Formosa Plastics agreed to pay a record $50 million in cleanup and restoration costs to settle a civil lawsuit after its Point Comfort plant discharged billions of plastic pellets into Texas waterways over many years. That settlement included a commitment to zero future plastic discharges from the Texas plant — a standard that has not been applied to its plant in Louisiana.

Nearly 100,000 people have signed a petition calling for the closure of a controversial oil and gas facility that has sickened residents of the U.S. Virgin Island. We in DGR deeply care about social justice, so we think it is important to expect president Biden to act against structural racism by shutting down an oil and gas facility that is poisoning a predominantly black community. But there are many oil refineries in the world and each one is poisoning their surrounding communities, human and nunhuman. As long as this cultures addiction to fossil fuels continues, it will obviously continue poisoning human and nonhuman communities.

A controversial oil refinery on St. Croix, one of the U.S. Virgin Islands, is in the government’s crosshairs after a third incident in just three months has sickened people. On May 5, after gaseous fumes were released from one of the oil refining units of Limetree Bay Refining, residents of the unincorporated Caribbean territory reported a range of symptoms, including burning eyes, nausea and headaches, with at least three people seeking medical attention at the local hospital. At its peak in 1974, the facility, which opened in 1966, was the largest refinery in the Americas, producing some 650,000 barrels of crude oil a day. It restarted operations in February after being shuttered for the past decade.
A Limetree spokesperson said that there was a release of “light hydrocarbon odors” resulting from the maintenance on one of the refinery’s cokers, high heat level processing units that upgrade heavy, low-value crude oil into lighter, high-value petroleum products. The noxious odor stretched for miles around the refinery, remaining in the air for days and prompting the closure of two primary schools, a technical educational center and the Bureau of Motor Vehicles (BMV), which local officials said was shuttered because its employees “are affected by the strong, unpleasant gas like odor, in the atmosphere.”
Limetree and the U.S. government conducted their own air quality testing, with different results. The National Guard found elevated levels of sulfur dioxide, while the company said it detected “zero concentrations” of the chemical just hours later. “We will continue to monitor the situation, but there is the potential for additional odors while maintenance continues,” said Limetree, which is backed by private equity firms EIG and Arclight Capital, the latter of which has ties to former President Donald Trump. “We apologize for any impact this may have caused the community.”
The May 5 incident follows two similar incidents in April at the refinery that the Virgin Islands Department of Planning and Natural Resources (DPNR) concluded were caused by the emission of excess sulfur dioxide from the burning of hydrogen sulfide, one of the impurities in petroleum coke, a coal-like substance that accounts for nearly a fifth of the nation’s finished petroleum product exports, mainly going to China and other Asian nations, where it is used to power manufacturing industries like steel and aluminum. Days after the U.S. Environmental Protection Agency (EPA) told the company that it was violating the Clean Air Act after the April incidents, Limetree agreed to resume sulfur dioxide monitoring, while contesting the violation. “If EPA makes a determination that the facility’s operations present an imminent risk to people’s health, consistent with its legal authorities, it will take appropriate action to safeguard public safety,” the agency said in a statement. The Biden EPA withdrew a key federal pollution permit for Limetree on March 25, but stopped short of shutting down the facility altogether.
Care2 has launched a public petition—already signed by more than 98,000 people—urging President Biden to shut down the Limetree Bay Refining facility. The petition also notes the risk that the refinery poses to the island’s biodiverse wildlife, saying that “turtles, sharks, whales, and coral reefs… [are] threatened by the Limetree Bay Refining plant—both by what it’s done in the past, and by what it’s spewing right now.” The group also frames the human rights and environmental justice aspect of the ongoing public health situation on the island in historical terms: “On top of the obvious problem that no person should be poisoned with oil, St. Croix is an island with a highly disenfranchised population. The vast majority of residents are Black, the [descendants] of enslaved Africans brought to work on sugar and cotton plantations. For generations, the U.S. government has cared little about the well-being of people there.” (One recent example happened in the wake of Hurricanes Irma and Maria, which landed on the island in September of 2017. Even two months after the storms hit, many residents of St. Croix who were evacuated to Georgia were unable to return home, and felt abandoned by the government. “I feel like we are the forgotten people and no one has ever inquired how do we feel,” said one of the St. Croix evacuees at the time.)
After the May 5 incident, Limetree said, “Our preliminary investigations have revealed that units are operating normally.” Perhaps it is normal for such facilities to emit toxic fumes. But what’s not normal is the fact that such fumes should present a constant threat to people and the environment, and that, according to the environmental group Earthjustice, about 90 million Americans live within 30 miles of at least one refinery. Adding insult to injury is the fact that Black people are 75 more likely to live near toxic, air-polluting industrial facilities, according to Fumes Across the Fence-Line, a report produced by the NAACP and the Clean Air Task Force, an air pollution reduction advocacy group. That report also found that more than 1 million African Americans face a disproportionate cancer risk “above EPA’s level of concern” due to the fact that they live in areas that expose them to toxic chemicals emanating from natural gas facilities.
You don’t need to live next door to a refinery to feel its impact on your health; in fact, you can be several miles away. A study conducted last year by researchers at the University of Texas Medical Branch (UTMB) found an increased risk of multiple cancer types associated with living within 30 miles of an oil refinery. “Based on U.S. Census Bureau data, there are more than 6.3 million people over 20 years old who reside within a [30-mile] radius of 28 active refineries in Texas,” said the study’s lead author, Dr. Stephen B. Williams, chief of urology and a tenured professor of urology and radiology at UTMB. “Our team accounted for patient factors (age, sex, race, smoking, household income and education) and other environmental factors, such as oil well density and air pollution and looked at new cancer diagnoses based on cancers with the highest incidence in the U.S. and/or previously suspected to be at increased risk according to oil refinery proximity.”
In granting Limetree’s permit in 2018—a move that E&E News reported was made to “cash in on an international low-sulfur fuel standard that takes effect in January [2020]”—Trump’s EPA said that the refinery’s emissions simply be kept under “plantwide applicability limit.” But then in a September 2019 report on Limetree—which has been at the center of several pollution debacles and Clean Air Act violations for decades—the agency said that “[t]he combination of a predominantly low income and minority population in [south-central] St. Croix with the environmental and other burdens experienced by the residents is indicative of a vulnerable community,” and added the new requirement of installing five neighborhood air quality monitors. “[G]iven several assumptions and approximations… and the potential impacts on an already overburdened low income and minority population, the ambient monitors are necessary to assure continued operational compliance with the public health standards once the facility begins to operate,” the agency stated. Limetree has appealed this ruling with the EPA’s Environmental Appeals Board, arguing that “the EPA requirements are linked to environmental justice concerns that are unrelated to operating within the pollution limits of the permit.”
“It is unclear when the EPA’s appeals board will rule on the permit dispute. The Biden-run EPA could withdraw the permit, and it is also reviewing whether the refinery is a new source of pollution that requires stricter air pollution controls,” reports Reuters, adding that the White House declined to comment.
President Biden has made environmental justice a central part of his policy, including the overhaul of the EPA External Civil Rights Compliance Office, which is responsible for enforcing civil rights laws that prohibit discrimination on the basis of race, color, national origin, sex or disability. “For too long, the EPA External Civil Rights Compliance Office has ignored its requirements under Title VI of the 1964 Civil Rights Act,” states Biden’s environmental justice plan. “That will end in the Biden Administration. Biden will overhaul that office and ensure that it brings justice to frontline communities that experience the worst impacts of climate change and fenceline communities that are located adjacent to pollution sources.”
Now it is time for Biden to make good on his campaign promise. John Walke, senior attorney and director of clean air programs with the Natural Resources Defense Council, told Reuters in March that the situation in St. Croix “offers the first opportunity for the Biden-Harris administration to stand up for an environmental justice community, and take a strong public health and climate… stance concerning fossil fuels.”

Lavigne is the founder and president of RISE St. James, a grassroots faith-based organization dedicated to opposing the siting of new petrochemical facilities in a heavily industrialized area along the Mississippi River between Baton Rouge and New Orleans known as “Cancer Alley.” Writing in Truthout in October 2020 about St. James Parish, Louisiana, the predominantly Black and low-income community where she lives, Lavigne pointed out that “Democratic presidential nominee Joe Biden mentioned St. James Parish in his clean energy plan speech because we’re notorious for having the country’s highest concentration of chemical plants and refineries, [one of] the highest cancer rates, the worst particulate pollution and one of the highest mortality rates per capita from COVID-19 in the nation,” She added, “For those of us living here, it’s not just Cancer Alley; it’s death row.”
The stated mission of the EPA is “to protect human health and the environment.” When so many Americans face a disproportionate cancer risk simply by living near toxic industrial sites such as oil and gas refineries, the EPA is derelict in its duty. The Limetree Bay Refining facility has presented President Biden with an early test of his commitment to environmental justice. Considering the facility’s terrible legacy of ecological and civil rights violations, three new public health incidents in just the past two months, and the disproportionate and ongoing health risks faced by the community’s predominantly Black and low-income population, it is finally time for the federal government to revoke Limetree’s license to operate on St. Croix. This is a perfect chance for President Biden to show the country and the world just how serious he is about environmental justice.

Cows are corralled in large groups, in small spaces, near to human settlements. The bacteria, disturbed by the upset of their microbial life-ways, shift their behavior. Now they move quickly between cows, they become more aggressive. Cows get sick.
Increased human-cow contact allows bacteria to pass from bovine into human bodies, and adapt to their newfound hosts. Humans build cities, into whose crowded centres ever more people migrate, to live breathing a grey swill of fumes, eating poorly, labouring to exhaustion in cramped, lightless, unventilated factories.
Going home to rundown tenements on piled garbage streets. It is the dawn of the glorious new Industrial Age, and in their great cities, humans are coughing blood. A bacterial disease is diagnosed: tuberculosis.
Over a century later, it continues to quietly fell over a million of the world’s poor each year.
There is a virus in the bellies of wild ducks, harmless to the birds. As ducks fly pond to pond they shed the virus into water, infecting other birds, who fly to other ponds, infecting yet more birds.
Humans domesticate ducks and begin raising them in captivity. Birds in cages have no ponds to fly to, so the virus cannot reproduce itself as it once did—it must change its habits. It adapts.
Now, it transmits rapidly between birds. It grows more virulent, since it no longer needs a living host: in captivity, healthy birds cannot flee the dying. The virus learns flexibility. It infects.
Soldiers are packed into squalid barracks, undernourished, cold and damp. Their immune systems exhausted by the stresses of combat. Outside the trenches, humans live in greater density, in closer proximity, in larger cities than ever before.
Many are recovering from immunity-battering bouts of measles, tuberculosis. A formerly innocuous bird virus spills into human bodies as a formidable pathogen. It spreads person to person across the earth’s surface until one-third of the total human population is ill. 50 million are estimated dead.
It is the Flu of 1918, the deadliest pestilence in human history.
There is a virus, its natural reservoir a small, insect-eating bat whose home is the forest. The forests are shrinking. Human cities go on expanding, there are more factories, more farms where humans store their captive legions of birds and pigs.
The bats’ habitat is fragmented by deforestation. The stress of that loss strains the sensitive animals’ immune systems, exciting the expression of a latent virus. Flying through what remains of the forest, stressed bats shed the virus. Now other animals are infected.
Humans hunt and trap wild animals and sell them at urban wildlife markets. The concentration of different animal species creates a fertile medium for viral recombination. Sustained human-animal contact grants adventuresome viruses access to human hosts.
At a wildlife market in a city with a population of millions in one of the world’s most polluted regions, a virus strays from a caged animal into a human body. Commercial air travel has made it possible for humans to cross oceans overnight.
They take with them whatever microbes their bodies harbor. A new viral disease emerges, within months it has spread across continents. The human death count steadily rises.
Covid-19 is one in a series of infectious diseases to unsettle the standard operating procedures of human societies. Disease has been civilization’s consort since our earliest history. Yet we are stunned by Covid-19, as if the concept of disease were alien—an “unprecedented event.” In a state of emergency, there is a forgetting, an attenuation of vision. Drifting out of focus goes the context of the emergency, the history, patterns, reoccurrences of emergencies. As ecofeminist philosopher Susan Griffin writes, “Whatever is in the background disappears in the focus of a gunsight.”
The mass media pandemic-panic and governments’ wartime rhetoric manipulate public perception. It amplifies anxiety, training that anxiety on an illusory “invisible enemy.” To exist in the state of emergency is torture for a public desperate for relief. So people are inclined to suspend reflection and accept the solutions handed down by those in power.
Fear disorients, distracts; it drives reactionary behavior dictated by the volatility of cortisol. Panic, once seeded, has a virality to rival any contagion. We materialize our imaginings into reality, by acting as if the worst-case scenarios have already arrived. Sirens scream. A stricken public rush to the supermarkets to prepare for imminent collapse. People panic buy toilet paper, creating a shortage. The emergency oozes through screens into everyday life as something palpable for all to experience, regardless of the facts of the outbreak. Panic intensifies, not helped by the authorities repeatedly blasting “This is an EMERGENCY”.
Responding to the emergency, politicians, intergovernmental organizations, and pundits have declared War on The Virus. The UN’s Department of Global Communications asserts, “The world faces a common enemy. We are at war with a virus.” In the United States, at the helm of “our big war,” President Trump leaps into action, militarizing the pandemic by activating the National Guard.
We are assured! We have the help of Biotech firms, hard at work on a vaccine. Billions of tax dollars paid out to prop up struggling corporations. We are assured, we will defeat this plasmid-coated adversary. The Virus will be vanquished. Crisis averted, emergency over, release the balloons, return to work, resume business as usual. Humanity has triumphed.
It is a habit of the Western mind to imagine that human existence is isolated from the natural world. That we can eat our way through the earth’s resources, laying waste to the environment without doing harm to ourselves. If the story of emerging viruses in the 20th-21st centuries has a moral, it is that human independence from the natural world is a delusion. Human health is contingent upon the health of the biosphere. When we brutalize the earth, we foreclose upon our own survival. Our actions enabled the spread of new pathogens. The structures and systems of our civilization have entrenched widespread susceptibility to infectious disease.
Anthropogenic environmental degradation is a precondition for disease susceptibility. This is evidenced by the high Covid-19 mortality rates in regions with poor air quality. Before Italy and Iran became coronavirus hotspots, they drew headlines for the deadly repercussions of unbreathable air. In China, ambient air pollution kills upwards of a million people annually.
As for the epicenters of Covid-19 mortality in the U.S, “Air Quality Health Advisory” ozone warnings are a summertime tradition in New York City. Louisiana boasts Cancer Alley. An 85-mile stretch of air-poisoning oil refineries and petrochemical plants along the Mississippi River. The same human systems that maximize vulnerability to disease make our societies unfit to respond effectively. In the U.S. the privatized, (for-profit) healthcare system has proven itself predictably useless under the pressure of a pandemic. There is no infrastructure in place for systematic testing. There are shortages of hospital beds, ventilators, nasal swabs and respirator masks. We are expected to be thankful that the biotech industry is highly motivated ( by money) to make a vaccine to save us.
Meanwhile, the U.S. government, in a bipartisan Disaster Capitalism trick lifted directly from Naomi Klein’s Shock Doctrine, has made hay while the sun of chaos shines. A $2.2 trillion package of handouts and loans will be distributed to corporations (airlines, the Pentagon and weapons manufacturers, industrial agriculture). For $1,200 each (per average-earning citizen) we are happy to subsidize corporate profiteering, warfare, environmental devastation.
The EPA has announced it will be suspending enforcement of pollution monitoring and reporting laws for the duration of the pandemic. There is no end date in sight. There is little consideration for pollution causing respiratory illness, which exacerbates the risk posed by Covid-19 . The U.S. is not alone in this. China has indicated it will be “modifying” environmental laws to hasten economic recovery now that its own Covid-19 crisis is cooling. Rejecting the panic driven amnesia, we can understand the connections now. The patterns from the present crisis to its predecessors. We can see that disease pandemics trace back to human actions and human systems. With tuberculosis and the Flu of 1918, it was the domestication of animals that spawned viral emergence. With Covid-19, it was progressive ruination of ecosystems and the commodification of wild creatures. Where we unbalance the natural world, we create ecological distress and disease. And once we are sick, it is social factors – industrialization, war, global capitalism, that raise death tolls. It was as true with tuberculosis as it was with the Flu of 1918 as it is with Covid-19.
The gravest threat to humanity is not any pathogen, but the diseased state of human civilization. Vulnerability to Covid-19 is predicted by preexisting chronic illness: diabetes, COPD, heart disease, liver disease, obesity and asthma. People with immune systems suppressed by pharmaceuticals and environmental toxins are also at higher risk. These conditions are the “diseases of civilization”. The upshot of human lifestyles disfigured by consumer capitalism.
Chronic disease is an off shoot of patterns of industrialised labor and consumption, the foods and intoxicants with which we overload our bodies chasing “fullness” and “pleasure”. We experience an accumulation of stress in toxic environments riddled with sexism, racism, poverty and the colonial mindset: the backdrop of industrial production. Although these conditions are endemic: it is indigenous people, people of colour, women and the poor who endure the highest incidence of affliction. The dispossessed will suffer most when confronted with infectious diseases such as Covid-19. The virus will flourish in bodies undermined by societal cruelties.
Demonizing a microbe as humanity’s nemesis scapegoats the natural world. This nurtures blindness to Covid-19’s background; the social history of infectious disease. If we pause, breathe, attempt a calmer review of context and history, what is revealed is that it is not The Virus, nor any pathogen, that threatens our continued life on earth. Human action precipitated the emergence of Covid-19. Humans razed the forests. Humans captured wild animals to sell at market. Humans squired a formerly harmless virus out into the world as a virulent pathogen. Human societies decimate the environment to glut the coffers of transnational corporations. To meet the insatiable demands of First World consumers, we collided with microbes once held within the fortifications of wild nature. Robust ecosystems. The unviolated bodies of animals. Like the virus of the hour, Junin, Machupo, Lassa and Ebola all spilled from wildlife into humans as a byproduct of deforestation and development. Novel flu strains continuously arise out of Confined Animal Feeding Operations, where humans warehouse domesticated animals in increasingly careless industrial conditions.
The world is comprised of microorganisms. To ‘wage war’ against microbes is folly. Infection and illness are inevitabilities beyond human control. So too is death. The social, cultural, structural pathologies that provoke viral emergence and needless mass suffering are our own inventions . It is in our power to remedy them. Protection from future pandemics is possible, but it’s not an antiseptic wipe, a face mask, a million ventilators, a vaccine, Medicare-for-All. It is preventing the viruses from emerging, by ending our violence against the natural world. We all, humans and non-humans, thread together within the delicate, interlacing of connections that binds us to the living earth. If we were guided by our deep knowledge of interdependence, rather than by fantasies of human detachment, we would not plunder as we do now. We would not be so reckless. We would know in our bodies that the destruction of the earth is self-destruction.
Protection from catastrophes of our own making are possible, yes, but only with a radical transformation of human civilization; the totality of global systems and institutions, including how we live and how we think. The human species will survive Covid-19, but without change, alignment to the natural world, there will be another virus, another pandemic culling of an impaired population, and another after that. One day, the earth we have blighted will have done with us.

As the world moves further into a state of climate crisis, it’s imperative that we study and critique the strategies being proposed to address greenhouse gas emissions, and develop our own strategies based on rigorous assessment of their effectiveness.
Many of the strategies currently being pursued by the mainstream environmental movement hinge on courts and on legislative change. This article will examine one these strategies—the “climate trust” lawsuits brought by the group Our Children’s Trust—in some detail. First, however, we must review a basic framework of how the court system, and more fundamentally, the legal system in general, serves ruling class interests within capitalism.
From early English laws like the Statutes of Merton and Westminster that authorized enclosure of the commons, to the Papal Bull “Inter Caetera” in 1493 which authorized the Doctrine of Discovery and the conquest and colonization of non-Christian lands west of the Azores, law within capitalism has always been an exercise in justifying systematic theft.
These ancient foundations continue to underlie law. For example, in the United States the Johnson v. M’Intosh Supreme Court case of 1823 is regarded as the foundation of modern property law and studied by nearly every law student. In the unanimous decision, Chief Justice John Marshall wrote that “the whole theory of their titles to lands in America, rests upon the hypothesis, that the Indians had no right of soil as sovereign, independent states. Discovery is the foundation of title, in European nations, and this overlooks all proprietary rights in the natives.”[i]
What is the Purpose of Law within Capitalism?
French Liberal School economist and laissez faire advocate Frederic Bastiat provided one of the most concise definitions of law within capitalism. “When plunder becomes a way of life for a group of men in a society,” he wrote in 1850, “over the course of time they create for themselves a legal system that authorizes it and a moral code that glorifies it.”[ii]
With this statement, Bastiat was attempting to critique socialism and collectivist tendencies. Marx, a contemporary of Bastiat, called him “The shallowest and therefore the most successful representative of the apologists of vulgar economics.” But Bastiat has inadvertently provided a functional description of law within capitalism.
In a similar manner, the free-market advocate, New York Times columnist, and Iraq War crusader Thomas Friedman inadvertently described the link between imperialist warfare and free-market capitalism perfectly when he wrote in the New York Times Magazine in 1999 that “[t]he hidden hand of the market will never work without the hidden fist. McDonald’s cannot flourish without McDonnell Douglas. And the hidden fist that keeps the world safe for silicon valley’s technologies to flourish is called the US army, air force, navy, and Marine Corps.”[iii]
Friedman’s piece argued for “sustainable globalization” which “cannot be maintained without the active [military] involvement of the United States,” and explicitly argued for increased cooperation between U.S. corporations and military.
The Institutionalization of Organized Theft
Critics of globalized capitalism agree with Friedman’s linkage of corporate power and military hegemony, but to borrow Bastiat’s term, see these entities as facilitating the plunder that defines modern capitalism, not ushering in Friedman’s neoliberal fantasy. Military aggression and economic colonization were the foundation of imperial power in Bastiat’s time, just as they are today. Today’s capitalist societies have evolved their methods. Instead of legalized chattel slavery,[iv] the United States now has a slave-like prison system and the global economy is fully dependent on systematic labor exploitation. Some of the most lasting impacts of globalization include the outsourcing of jobs to poor nations with artificially deflated labor costs, the outsourcing of pollution to what Lawrence Summers called “underpolluted” nations, and the explosion of international trade. All of this is facilitated by the IMF and World Bank, which leverage development loans to systematically privatize the wealth and dismantle social and environmental regulations within poor nations. Altogether, this organized theft leads to an average wealth transfer of roughly $2 trillion per year from poor countries to rich countries, not counting externalities.[v]
The accelerating extraction of wealth from the poor has been matched by similar growth in destructive theft from the planet. Extraction of primary resources—timber, foodstuffs, ore, fossil fuels, water, etc.—has tripled over the past 40 years to more than 70 billion tonnes annually.[vi] Greenhouse gas emissions have doubled since 1980, and more than 1 million species are threatened with extinction, threatening to unravel the ecological basis of life on this planet.[vii] Human disconnection from the natural world is at an all-time high as business privatizes even our most intimate private lives with pornography, dating apps, and ubiquitous data gathering.
By realistic economic measures, the owners of society are wealthier than ever and inequality is reaching record levels.[viii] And as Bastiat described, this arrangement of power is undergirded by a legal structure that authorizes and glorifies this exploitation.
The United States—still the epicenter of imperial power, despite a steady decline in influence since the invasion of Afghanistan in 2001—provides illustrative examples. The extraction of profits from workers and the land is the bedrock principle of American law. The idea that workers should be in control of their own communities and benefit from the work they and their neighbors do is not even a topic of discussion in courtrooms and legislative halls. Nature is owned and managed as property. The idea that nature should be respected as the source of all human goods and life is, at best, commodified into the ideology of “natural capitalism”, while true deep ecology ideals—that nature exists and has value for it’s own sake, on it’s own terms—remain fringe positions.
The Legal System as an Arena of Political Change
Movements for justice have always used the legal system and the courts as arenas of political struggle. The Civil Rights movement, the Feminist movement, the Labor movement, and the Environmental movement have all won significant victories in courtrooms. The feminist legal scholar Catherine MacKinnon, who is credited with the legal recognition of sexual harassment as a form of sex discrimination, wrote in collaboration with Andrea Dworkin that “law organizes power.”[ix]
Given the current supremacy of the capitalist state, the courts are an important arena of political struggle. To concede this legal battleground to reactionaries could be suicidal. But to rely only on legal methods is also a flawed strategy. Legal reform has never proved able to do more than slow the progression of capital’s death march.
The Voting Rights Act has now been dismantled, reversing a key gain of the Civil Rights Movement.[x] Roe v. Wade, which established Federal legality of abortion, has been under incessant attack for decades. Countless state laws have closed abortion clinics, limited funding, and attacked the principle of female bodily autonomy via more than 400 laws in the last 9 years alone.[xi] With the new Supreme Court, it’s likely Roe will be completely overturned. The Clean Water Act is currently being gutted.[xii] Union membership is at an all-time low as “right-to-work” laws proliferate, undermining the effectiveness of even bourgeois workplace organizing efforts.[xiii] This reflects global efforts to undermine minimum wages and other basic labor protections.[xiv]
Recently, environmentalists in the United States and elsewhere are testing a set of innovative legal strategies. These include the group “Our Children’s Trust,” which is filing lawsuits against the federal government for failing to uphold the “public trust doctrine,” a legal principle that the government is responsible for managing public resources for the benefit of the public. Our Children’s Trust is attempting to expand the purview of the trust doctrine to include the climate, and thus potentially force the U.S. government to fight climate change.
But the flaw in this plan is obvious right away: the U.S. government, like all capitalist states, has never existed to wisely steward public resources, but rather to facilitate their exploitation for private gain. In truth, even most socialist states have fallen victim to industrial arms races with capitalist societies or to an industrial productivism that values development of industry as the highest good, and have thus fallen well short of this ideal.
Rights of Nature, the Trust Doctrine, and The Necessity Defense
The trust doctrine approach is just one of the innovative legal strategies being pursued by the environmental movement today. Two others are the Rights of Nature movement, and the push for the “climate necessity defense.” The rights of nature movement seeks to expand basic rights, such as personhood, to non-human ecosystems. The necessity defense is the legal principle that it is sometimes legal to break the law in order to prevent a greater harm; the classic example is breaking a window to save a child from a home that is on fire. It has been used to defend protestors in a few high-profile cases of civil disobedience.[xv]
These legal strategies aim to advance ecological struggles by providing protections for ecosystems, by forcing changes in U.S. and international law to curtail global warming, and by protecting political dissidents.
Can they succeed? And what would success look like?
I argue that these efforts, while laudable, will not lead to significant change because of structural barriers. For example, let’s imagine that the “Our Children’s Trust” lawsuit was successful, and U.S. courts recognized the obligation of the federal government to safeguard climate stability, and ordered emissions reductions of, for example, 80 percent by 2030 and 100 percent by 2050. And let’s suppose they choose to implement the methods proposed by Our Children’s Trust.
Our Children’s Trust proposes a three-pronged strategy for halting global warming.[xvi] First, they call for 100 gigatons of carbon sequestration via reforestation, perennial agriculture, and soil conservation. Second, they call for reducing emissions by “designing our cities for walking and biking, investing in mass transit, constructing high-performance energy efficient buildings, transitioning to 100% clean energy, shifting to green manufacturing and durable products, and adopting restorative forestry and farming practices.” Finally, they propose fees on carbon pollution and ending subsidies to the fossil fuel industry.
Their first category of solutions is admirable, as long as “reforestation” is not twisted to mean expanding the monocrop plantations of industrial forestry. But as I exhaustively detail in my forthcoming book Bright Green Lies, their second category, technological solutions, is woefully insufficient for addressing global climate destabilization.
The Failure of Green Technology
According to the work of sociologist Richard York, renewable energy today rarely actually displaces fossil fuels. Instead, predictably, these energy sources are typically added on top of existing sources, helping to grow the capitalist economy. York writes that “Non-hydro renewable [energy] sources have a positive coefficient, indicating the opposite of displacement, but this coefficient is not significantly different from 0, indicating that renewables tend to simply be added to the energy mix without displacing fossil fuels.”[xvii] Another study in China had similar results, finding that “Non-hydro alternative energy did not show statistically significant displacement effect in any of the six regional grids.”[xviii]At a global level (which is ultimately the only significant scope for global warming), the burning of coal, oil, and gas has grown significantly even as wind and solar have boomed.[xix]
After five years of research, one climate solutions lab found that even “a wholesale adoption of renewable energy… would not have resulted in significant reductions of carbon dioxide emissions” and concluded that “Trying to combat climate change exclusively with today’s renewable energy technologies simply won’t work.”[xx]
Socialists have long argued that centralized planning and the lack of a growth imperative would allow non-capitalist societies to adopt new technologies cautiously and rationally. This remains a largely untested hypothesis in our era of global ecological crisis, but regardless, this is not what Our Children’s Trust is promoting. Instead, they chose to promote unproven and extremely expensive carbon capture technology (as one recent headline reads, “Best Carbon Capture Facility In World Emits 25 Times More CO2 Than Sequestered”[xxi]), electric cars, and energy efficiency which hasn’t made a dent in growth in consumption. In truth, efficiency within capitalism is almost certain to lead to Jevon’s Paradox: more profit, more investment, and more growth in resource use.[xxii]
“Green Cities” and Market Failures
Even dense, walkable cities—a favorite of “green growth” and de-growth advocates alike probably represent an illusory solution. As urban planning professor Michael Neuman succinctly explains, “Since 1960, while human population has doubled [and the majority of the world’s population has moved to cities], the global economy has quadrupled, and resource consumption quintupled,” he says. “Thus, we are getting less efficient and less sustainable as we move to cities, not more, contrary to popular belief and professional dogma.”[xxiii] Study after study from locations as widely spaced as Iran, Taiwan, and the Netherlands have shown little or no reduction in energy consumption resulting from increased urban density.
As with other market-based measures for environmental protection, carbon tax schemes have been almost completely ineffective in lowering emissions. For example, the European market is flooded with allowances, and has at best reduced emissions by 2 or 3 percent across the continent.[xxiv] At worst, it has simply incentivized pollution outsourcing and “carbon laundering” as seen most prominently in the Volkswagen emissions case.
Given these realities, even a positive ruling in the Our Children’s Trust case wouldn’t significantly slow or stop global climate destabilization. Direct approaches, like stopping fossil fuel extraction, are not discussed in their strategy, and there is no critique of capitalism apparent either.
Some proponents argue that major policy proposals like The Green New Deal or lawsuits like the Our Children’s Trust cases represent organizing focal points which expand the scope of acceptable debate.[xxv] This is certainly true. But while false solutions to the problems of capitalism are always acceptable to ruling class, they will never solve the problems they purport to address. It is past time to build explicitly anti-capitalist organizations to address the ecological crisis, and to arm them with effective (read: revolutionary) methods.
The Necessity of Dismantling Industrial Capitalism
The reason Our Children’s Trust isn’t tackling this issue is likely the same reason The Green New Deal didn’t include a proposal to shut down the fossil fuel industry. As Brad Hornick writes in Resilience, “[Stopping anthropogenic climate disruption] implies a radical retrenchment or collapse of the dominant industries and infrastructure based upon fossil fuel production, including automobiles, aircraft, shipping, petrochemical, synthetic fabrics, construction, agribusiness, industrial agriculture, packaging, plastic production (disposables economy), and the war industries.”
In other words, stopping climate chaos requires an end to capitalism, to much of the global economy, and to U.S. hegemony. This is not popular in society, nor is it politically acceptable—even thinkable—in courtrooms. The U.S. court system will never order the dismantling of the global economy and of U.S. empire. In the 19th century, Mikhail Bakunin wrote that “The supreme law of the State is self-preservation at any cost.” This remains true today.
Legally speaking, judges can rule anything they want, as long as they can justify it using legal precedent. But there are also specific legal and doctrinal barriers that confine all judges who sincerely believe in the structure of American law. Namely, as mentioned earlier, the notion that nature is property, that property can be rightfully destroyed or consumed by its owner, and the principles of corporate rights all stand in the way in the significant legal change. Further, even favorable court rulings would depend on the Executive and Legislative branches of the U.S. government, as well as on police, military, and other Federal employees, to enforce such a legal shift.
To rely on the law alone is to concede to a never-ending tug of war—an endless battle which the ruling class wages using billions in lobbying dollars. But institutions are not monolithic. Ideological power struggles within them can change the material conditions for resistance taking place within the broader culture. And there is some promise in all of these legal strategies. For example, the Rights of Nature approach has the possibility to instill a new, fundamental respect for the integrity of the natural world throughout certain populations. The climate necessity defense approach has promise for protecting activists who engage in non-violent direct action (which we should note has been thus far entirely ineffective in stopping the murder of the planet). Therefore, the promise these new legal approaches represent is primarily cultural. In military terminology, these are shaping actions, not decisive ones.[xxvi]
Reform Will Not Halt The Crisis
These legal strategies may change the framing conditions and lead to reform. But as the last 50 years can attest, reforms will not be enough to halt the ecological crisis. At worst, ill-fated movements can divert valuable resources and energy into dead-end efforts. Left historians do not look kindly on Nelson Mandela’s pro-capitalist turn late in life, but he articulated an important consideration when he justified his decision to create the Unkhonte We Sizwe, an armed underground insurgency, writing that “There is no moral goodness in using an ineffective weapon.”[xxvii]
Modern movements would do well to consider this.
David Brower, the founder of Earth Island Institute and Friends of the Earth, and former director of the Sierra Club once said, “All I have done in my career is to slow the rate at which things get worse.” In this historical moment, we don’t have time to merely slow the destruction. We need to rapidly halt it and to reverse it. This means choosing effective methods, and at a minimum, dismantling capitalism.
The struggle to halt the ecological crisis will not be primarily fought in courtrooms, legislated by policymakers, sold by corporations, or decided by foundation-funded NGOs. It will be fought by people’s movements and by revolutionaries who are willing to fight for the survival of the human species and the global community of biotic life. That’s something that the courts will never do.
